Pleasant Road Cutchogue, NY SCTM#114-01-04 Gentlemen:: The following action was taken by the Board of Town Trustees during a Regular Meeting, held on May 24, 2001, regarding the above matter. WHEREAS, Inter-Science Research Associates, Inc. on behalf of ROBERT PELLEGRINI applied to the Southold Town Trustees for a permit under the provisions of the Wetland Ordinance of the Town of Southold, application dated April 19, 2001 WHEREAS, said application was referred to the Southold Town Conservation Advisory Council for theic findings and recommendatio'0s, and WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on May 24, 2001 at which time all interested persons were given an opportunity to be heard, and, WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area, and, WHEREAS, the Board has considered all the testimony and documentation submitted concerning this application, and, WHEREAS, the structure complies with the standard set forth in Chapter 97-18 of the Southold Town Code. WHEREAS, the Board has determined that the project as proposed will not affect the health, safety and general welfare of the people of the town, NOW THEREFORE BE IT. RESOLVED, that the Board of Trustees approved the application oflnter,_gcience Research ~4ssociates, Inc. on behalf of ROBERT PELLEGRINI for a Wetland Permit to remove existing residence and shed, re-locate the existing water tower, construct new residence with accessory structures, install new sanitary system and driveway. No site disturbance will occur closer than 75' from the wetland boundary. Staked haybales around the top of the bluff during construction. BE IT FURTHER RESOLVED that this determination should not be considered a determination made for any other Department or Agency which may also have an application pending for the same or similar project. Permit to construct project will expire two years fi'om the date it is signed. Fees must be paid, if applicable, and permit issued within six months of the date of this notification. Dear Mr. Krupski: Please be advised the we (Inter-Science) have been retained by the above referenced property owner (Robert Pellegrini) to coordinate the permit work leading towards (1) the removal of the existing residence and (2) the construction of a new single family residence with accessory structures. The subject property is accessed by Home Pike Road in Southold, fi'onts Mattituck Creek and contains approximately 2,000 s.f. of tidal wetland as flagged by Inter-Science. The new residence will be setback 86'from the wetland boundary. The new residence will be located no closer to the wetland than the existing residence. As indicated on the enclosed site plan. project limiting fencing and havbales will installed no less than 75'from the wetland boundary. It is our position that the proposed action is located outside of NYSDEC Tidal Wetland Jurisdiction. Consequently, we have requested the issuance of a DEC Non-Jurisdiction Letter on the grounds that all site disturbance will be located seaward of the crest of the bluff/the I0' contour.
