Samuels last dated August 23, 2005 and determined the proposed construction of a new residence on a pre-existing foundation and new sanitary system to be out of the Wetland jurisdiction under Chapter 97 of the Town Wetland Code and Chapter 37 of the Town Code. Therefore, in accordance with the current Tidal Wetlands Code (Chapter 97) and the Coastal Erosion Hazard Area (Chapter 37) no permit is required. Please be advised, however, that no construction, sedimentation, or disturbance of any kind may take place seaward of the tidal wetlands jurisdictional boundary or seaward of the coastal erosion hazard area as indicated above, or within 25' landward from the top of the bluff, without further authorization from the Southold Town Board of Trustees pursuant to Chapter 97 and/or Chapter 37 of the Town Code. It is your responsibility to ensure that necessary precautions are taken to prevent ?y sedimentation or other alterat!on or disturbance to the ground~s-u-~ace or ~/eg~t~bon ~th~n Ti~tal Wetlands jufisdict~3n and Coastal Erosion Hazard Area, which may result from your project. Such precautions may include maintaining adequate work area between the tidal wetland jurisdictional boundary and the coastal erosion hazard area and your project or erecting a temporary fence, barrier, or hay bale berm. However, any activity within 100' of a Wetland line or seaward of the Coastal Erosion Hazard Area would require permits from this office. Cutchogue, NY 11935 RE: EDWARD & ADRIENNE SOLOMON 1205 POINT PLEASANT RD, MATTITUCK SCTM# 114-1-4 Dear Mr. Samuels: The Board of Town Trustees took the following action during its regular meeting held on Wednesday, April 19, 2006 regarding the above matter: WHEREAS, Samuels and Steelman Architects as agent for EDWARD & ADRIENNE SOLOMON applied to the Southold Town Trustees for a permit under the provisions of Chapter 97 of the Southold Town Code, the Wetland Ordinance of the Town of Southold, application dated March 27, 2006, and WHEREAS, said application was referred to the Southold Town Conservation Advisory Council and to the Local Waterfront Revitalization Program Coordinator for their findings and recommendations, and, WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on April 19, 2006 at which time all interested persons were given an opportunity to be heard, and, WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area, and, WHEREAS, the Board has considered all the testimony and documentation submitted concerning this application, and, WHEREAS, the proposal complies with the standards set forth in Chapter 97 of the Southold Town Code, 2 . . WHEREAS, the Board has determined that the project as proposed will not affect the health, safety and general welfare of the people of the town, RESOLVED, that the Board of Trustees approve the application of EDWARD AND ADRIENNE SOLOMON to construct an in-ground swimming pool and enclosure fence with the conditions that there be a dry well for pool backwash and the two fences in the intertidal area be removed back to the toe of the bluff and all as depicted in the plans prepared by Samuels and Steelman Architects revised 4/27/06. Permit to construct and complete project will expire two years from the date the permit is signed. Fees must be paid, if applicable, and permit issued within six months of the date of this notification. Inspections are required at a fee of $50.00 per inspection. (See attached schedule.)
