The Board of Town Trustees took the following action during its regular meeting held on
Wednesday, August 29, 2001 regarding the above matter:
WHEREAS, Patricia C. Moore, Esq. on behalf of KURT FREUDENBERG & JANET IL
LATHEM applied to the Southold Town Trustees for a permit under the provisions of thc
Wetland Ordinance of the Town of Southold, application dated July 27, 2001, and,
WHEREAS, said application was referred to the Southold Town Conservation Advisory Council
for their findings and recommendations, and,,
WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on
August 29, 2001, at which time all interested persons were given an opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are familiar with the premises in
question and the surrounding area, and,

NARRATIVE REGARDING FREUDENBERG/LATHAM CONSTRUCTION

Sirs,
In August of 2001 I traveled to Mattituck to review the proposed plans for the proposed home of Kurt
Freudenberg and Janet Latham on behalf of my mother, Isabel Munch, the owner of the westerly
adjacent property.
At that time I reviewed the position of the proposed home based upon the surveyors building position
stakes. The only objection I had was the location of the garage and the route of the driveway which
approached within 7 feet of the property line and runs through the mature growth trees on the property
thereby eliminating most of the natural screening between the properties
On August 29, 2001 a friend, Mike Davis of Port Jefferson, and I attended the wetland permit heating
for this proposed construction. At that time I met with Kurt Freudenberg and his attorney, Patricia C.
Moore. After explaining my concern and provided computer drawings (copies attached) to Mr.
Freudenberg and Ms. Moore, Mr. Freudenberg agreed to relocate the garage and driveway from the
west side of the house to the south side of the house. This agreement was witnessed by Ms. Moore and
Mr. Davis.
Upon receiving the Public Notice regarding Mr. Freudenberg's request for a Pier and Dock Assembly,
I noticed that the footprint of the home had moved, however the garage and driveway remained in the
original westerly configuration, thereby maintaining the unattractive garage view from my mothers
property and a driveway configuration that would remove most of the mature growth screening and
passes within 7 feet of the common property line.
It is my desire to assure that the verbal agreement reached with Mr. Freudenberg and witnessed by Ms.
Moore and Mr. Davis, be implemented in actual construction.
I have attached come computer depictions of the potential impact on my mothers property under the
proposed plan and the agreed upon change. I am sure you will agree that the preservation of natural
screening is desirable and I request that you aid me in this effort.
Please inform me what I should do to ensure this positive change.

Enclosed is the revised survey which shows the
Board's requested 50' limit of clearing from the 6'
elevation contour. Due to the topography of the parcel
the 6' contour results in a much larger ~limit of
clearing" area than the owner had expected. We would
respectfully request that you place this on your work
session agenda so that we can discuss the ~limit of
clearing" line.
The owners have two children and the limit of
clearing line eliminates any rear yard. We ask that you
reconsider and modify your recommendation.
The owner has no objection to placement of the
haybales during construction.

Dear Lauren,
I am sending this letter to provide a record for your fdes of the events that transpired during
my trip to Long Island to review the plans submitted by Kurt Freudenberg and Janet Latham to
build a new home on the property adjacent my Mother's home in Mattituck.
On Wednesday, August 29m, Mike Davis and I traveled out to Matfituck to compare and
evaluate the proposed construction site with respect to the accuracy of a survey that was provided
by Pat Moore, Esq. and the potential visual impact on Mom's adjacent property.
The measurements that Mike and I made conftrmed the accuracy of the survey. The only
negative aspect we encountered involved the p~oposed orientation of the garage doors and the
driveway. The depicted driveway, at its closest point, is just slightly over 7 feet from Mom's property
line and would involve the removal of a majority of the mature tree growth and with it the existing
natural screening between the two properties. In addition, during the winter when the leaves ate
down, the Eastward view from Mom's deck would be facing the adjacent property's garage doors.
Using his computer design system, Mike was able to generate some accurate three-
dimensional drawings based on the survey provided, depicting the view that would exist if the
building were built as planned. Although I feel that every effort was made to locate the house in
such a way as to have the least impact on Mom's property, it became evident that with the loss of
the mature growth and the western facing garage doors, the visual impact would be significant. The
