The following action was taken at the Southold Town Board of Trustees regular meeting held on
Wednesday, October 22, 2003:
RESOLVED, that the Southold Town Board of Trustees APPROVE the request for a Transfer
of Permit #5301 from Anthony Shannon to Jason McCabe. Permit was granted on March 21,
2001 to install a 4' high chain-link fence on the north and south sides of property and to re-
vegetate the 50' wide non-disturbance buffer, and as depicted on the plan prepared by Land Use
Ecological Services, Inc. dated May 2, 2002.

Dear Board of Trustees:
Recently we received a call from your office regarding our property. One concern
of yours was the hay bales that were missing from the property. After our last meeting, at
which time we were pre-approved for our permit, we removed the hay bales under the
assumption that we were going to start work on the area. We then received a phone call
from your office advising us we needed to get approval from the DEC, which we were
unaware off We are currently working with a DEC consultant on this matter and are
waiting to hear from them. We were tmaware that it was going to be such a lengthy
process. As soon as we hear from the DEC you can be assured we will be in contact with
you. In the meantime, the hay bales will be replaced. As far as revisions to the plans you
requested, they were dropped offto you and then returned to us in order for us to present
them to the DEC. Those original plans are no longer going to be used.
We are now planning on making right our violations by moving the fence back to
create a 25-foot buffer zone, which was agreed upon, and also plant the ground cover
where we were told.
We have included a copy of our survey with our revised plans. As you can see we
decided to "keep it simple". We are looking forward to making things right and having
this matter resolved as soon as possible.

Dear Mr. Shannon:
The Board of Town Trustees took the following action during its regular meeting held on
Wednesday, March 21, 2001 regarding the above matter:
WHEREAS, ANTHONY SHANNON applied to the Southold Town Trustees for a permit under
the provisions of the Wetland Ordinance of the Town of Southold, application dated January 2,
2001, and,
WHEREAS, said application was referred to the Southold Town Conservation Advisory Council
for their findings and recommendations, and,
WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on
March 21, 2001, at which time all interested persons were given an opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are familiar with the premises in
question and the surround'rog area, and,
WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application, and,
WHEREAS, the structure complies with the standards set forth in Chapter 97 of the Southold
Town Code,
WHEREAS, the Board has determined that the project as proposed will not affect the health,
safety and general welfare of the people of the town,
NOW THEREFORE BE IT,
RESOLVED, that the Board of Trustees approve the application of ANTHONY SHANNON to
install a 4' chain-link fence on the north and south sides of the property only and not parallel to
the water, and to re-vegetate the 50' wide non-disturbance buffer in accordance with the
approved planting specifications, all as depicted on the plan dated May 2, 2002.
BE 1T FURTHER RESOLVED that this determination should not be considered a determination
made for any other Department or Agency, which may also have an application pending for the
same or similar project.
Permit to construct and complete project will expire two years from the date it is signed. Fees
must be paid, if applicable, and permit issued within six months of the date of tiffs notification.
Inspections are required at a fee of $5.00 per inspection. (See attached schedule.)

Dear Mr. Krupski:
Enclosed please find the planting specifications approved by the DEC. After meeting with the DEC
they have expressed no problem in regard to where the fence currently lies. We would ask for you to
reconsider your position on moving the fence. As time has passed since meeting with you last the
fence has already been taken over by tall thick growth and is barely visible at all. There is no longer
any runoff, the area has completely grown back. We will also be adding a variety of grasses and
plants (found in the specifications). This brings me to my next question. The DEC has requested a
fifty- foot buffer zone. In meeting with the Board of Trustees, a twenty-foot buffer zone was agreed
upon. Please advise me as to what decision takes jurisdiction in this matter.
This matter has taken quite some time, and it is my hope that we can come to an amicable decision
where all parties are satisfied.

Dear Mr. Krupski:
Mr. Shannon has informed me that he has received an additional summons regarding the above
referenced property.
Please be advised that we are endeavoring to resolve the same issue with NYSDEC, so that the
necessary restoration can be approved by both agencies.
In this regard, we requested NYSDEC to issue a Violation Notice which commenced the settlement
procedure. This notice was issued on October 5, 2001 (copy attached) with a settlement conference
scheduled for December 20, 2001. At this conference the legality of the dwelling was questioned as
were the setbacks mandated under NYSDEC permit to Frank Murphy.
Cun'ently, we have established that the dwelling meets the 75' requirement and have requested a
settlement conference. To date, I have not received the date and time of the conference.
I hope you understand that DEC has been backiagged with violation settlements. Mr. Shannon and I are
attempting to expedite the settlement quickly.

C. GRANDFATHER FEE {TOWN WATERS): Subject to a caee by case

D. Coast Erosion Hazard Area (CEHA):
1. Minor projects: $50.00 for all projects where there

§ 58-1. Providing notice of public hearings.
[HISTORY: Adopted by the Tow~ Board of the Town of
Southold 12-27-1995 as L.L. No. 25-1995. Amendments
noted where applicable.]
§ 58-1. Providing notice of public hearings.
Whenever the Cede calls for a public hearing, this section
shall apply. Upon determining that an application is complete,
the board or commission reviewing the same shall fix a time
o. nd place for a public hearing thereon. The board or commission
reviewing an application shall provide for the giving of notice:
A. By causing a notice giving the time, date, place and
nature of the hearing to be published in the official
newspaper within the period prescribed by law.
B. By requiring tile applicant to erect the siKn provided by
the town, which shall be prominently displayed on the
premises facing each public or private street which the
property involved in the application abuts, giving notice
of the application, the nature of the approval sought
thereby and the time and place of the public hearing
thereon. The sign shall be set back not more than ten
(10) feet from the property line. The sign shall be
displayed for a period of not less than seven (7) days
immediately preceding the date of the public hearing.
The applicant or his/her agent shall file an affidavit that
s/he has complied with this provision.
C. By requiring the applicant to send notice to the owners
of record of every property which abuts and every
property which is across from any public or private street
