One concern of yours was the hay bales that were missing from the property. After our last meeting, at which time we were pre-approved for our permit, we removed the hay bales under the assumption that we were going to start work on the area. We then received a phone call from your office advising us we needed to get approval from the DEC, which we were unaware off We are currently working with a DEC consultant on this matter and are waiting to hear from them. We were tmaware that it was going to be such a lengthy process. As soon as we hear from the DEC you can be assured we will be in contact with you. In the meantime, the hay bales will be replaced. As far as revisions to the plans you requested, they were dropped offto you and then returned to us in order for us to present them to the DEC. Those original plans are no longer going to be used. We are now planning on making right our violations by moving the fence back to create a 25-foot buffer zone, which was agreed upon, and also plant the ground cover where we were told. We have included a copy of our survey with our revised plans. As you can see we decided to "keep it simple". We are looking forward to making things right and having this matter resolved as soon as possible. Thank you for your time and consideration. BE 1T FURTHER RESOLVED that this determination should not be considered a determination made for any other Department or Agency, which may also have an application pending for the same or similar project. Permit to construct and complete project will expire two years from the date it is signed. Fees must be paid, if applicable, and permit issued within six months of the date of tiffs notification. After meeting with the DEC they have expressed no problem in regard to where the fence currently lies. We would ask for you to reconsider your position on moving the fence. As time has passed since meeting with you last the fence has already been taken over by tall thick growth and is barely visible at all. There is no longer any runoff, the area has completely grown back. We will also be adding a variety of grasses and plants (found in the specifications). This brings me to my next question. The DEC has requested a fifty- foot buffer zone. In meeting with the Board of Trustees, a twenty-foot buffer zone was agreed upon. Please advise me as to what decision takes jurisdiction in this matter. This matter has taken quite some time, and it is my hope that we can come to an amicable decision where all parties are satisfied. Please be advised that we are endeavoring to resolve the same issue with NYSDEC, so that the necessary restoration can be approved by both agencies. In this regard, we requested NYSDEC to issue a Violation Notice which commenced the settlement procedure. This notice was issued on October 5, 2001 (copy attached) with a settlement conference scheduled for December 20, 2001. At this conference the legality of the dwelling was questioned as were the setbacks mandated under NYSDEC permit to Frank Murphy. Cun'ently, we have established that the dwelling meets the 75' requirement and have requested a settlement conference. To date, I have not received the date and time of the conference.
