This Transfer is for a 4'x65' open grate decking catwalk with steps at end to water. Any other activity within 100' of the wetland boundary requires a permit from this office. SCTM# 1000-116-7-6 The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my'determination that the proposed actions are INCONSISTENT with the below listed LWRP policy and therefore are INCONSISTENT with the LWRP: 6.3 Protect and restore tidal and freshwater wetlands. The applicant has not demonstrated that the following dock standards pursuant to § 275-11. Construction and operation standards have been met. 9.3 Preserve the public interest in and use of lands and waters held in public trust by the state and the Town of Southold. A. Limit grants, leases, easements, permits or lesser interest in lands underwater in accordance with an assessment of potential adverse impacts of the proposed use, structure, or facility on public interest in public lands under water. The dock structure will extend further into public waters with inadequate water depths to support an engine driven vessel in the future. No restrictions on the perpetual use of small vessels on the dock are proposed. The use of public launching areas is a better alternative for small vessels. The dock structure would result in a net decrease in public access to public underwater lands and the nearshore area. The applicant currently enjoys access to public water via an existing private, dock structure. The incremental and segmented extensions of permanent, dock structures into environmentally sensitive areas does not meet this policy. The Board reviewed my application and approved a"structure seaward of the hwm" of 55 feet which would have translated into a"walkway"with a total length of 94 feet. Based on a hydrographic map prepared by Sea Level Mapping on August 5, 2005 a 94 foot "walkway" extending 55 feet seaward of the high water mark would provide approximately a foot of water at the end of the dock, even when the tide was at"low water". A foot of water at low tide would have met my needs. The Army Corps of Engineers also reviewed the plans for my dock and as far as I can tell they had no objections to a 94 foot "walkway". In fact in a letter to me on March 7, 2007 the Corps stated that my request was"minor in nature...". On February 5, 2007 the New York State Department of Environmental Conservation gave me a permit to proceed with the dock provided the entire "walkway"would not exceed 65 feet.(At 65 feet the seaward end of the dock would be right at the"edge of the bog". Even so there would be about 6"of water at low tide; not much but enough to launch a small kayak.) At some point—and I can not remember the date other than it was before starting construction of the dock - Mr Charles Hamilton of the Department of Environmental Conservation came to my home to see where I planned to build the dock. He was accompanied by a Trustee, but I can't remember who it was. (I want to say Jim King but I am not sure.) I asked Mr Hamilton why my application for a 94 foot walkway was not approved. His reply; He didn't think at 94 feet it would"look right". Rather than arguing with Mr Hamilton I accepted the 65 foot limitation. The dock was completed in early July and on July 23, 2007 the Trustees issued a Certificate of Compliance . l � Fast forward a couple of years. As a result of Suffolk County dredging the entrance to Halls Creek the"edge of the bog" has moved further away from the seaward end of my dock so that at low tide I have no water at the dock; not even the 6"I had when the dock was completed. (See attached pictures of my dock taken this morning.) Therefore, I would like the Trustees' approval to lengthen my dock so that I can once again use the dock as intended. To that end I ask the Trustees to visit my property and to support my request for lengthening the dock to provide at least some water at low tide. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department on June 1, 2005, as well as the records available to me, it is my recommendation that the proposed action is INCONSISTENT with the denoted following Policy Standards and therefore is INCONSISTENT with the LWRP. It is recommended that the board deny the application as proposed. Pursuant to Chapter 95, the Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action. Policy ]. Foster a pattern of development in the Town of Southold that enhances community character,preserves open space, makes efficient use of infrastructure, makes beneficial use of a coastal location, and minimizes adverse effects of development. This proposal is to construct a fixed open walkway 4 x 130' with a hinged ramp 4' x12' and a floating dock 6' x 12' and install 2 spiles to secure the floating dock in Mud or Hall Creek in New Suffolk. The action is located within REACH 8 in the Agricultural Conservation zoning district. The proposed action will remain private and will not support a pattern of development that enhances community character nor preserves "public" open space. Additionally, the proposed action does not make beneficial use of a coastal location in the interest of public safety nor has the applicant proposed sufficient mitigative design and construction best management practices that will minimize the adverse effects of the action on the environment, scenic view shed or community to the greatest extent possible. Policy 2. Protect and preserve historic and archaeological resources of the Town of Southold There is no opportunity to meet this policy Policy 3. Enhance visual quality and protect scenic resources throughout the Town of Southold Policy Standard 3.1 Enhance visual quality and protect scenic resources throughout the Town of Southold including: The proposed action will not A. Minimize the introduction of structural design components (including utility lines, lighting, signage and fencing) which would be discordant with existing natural scenic components and character, B. Screen components of development which detract from visual quality, C. Using appropriate siting, scales, forms, and materials to ensure that structures are compatible with and add interest to existing scenic components. D. Preserve existing vegetation and establish new indigenous vegetation to enhance scenic quality, and E. Protect visual quality associated with agricultural land, open space and natural resources. Policy 4. Minimize loss of human life, structures, and natural resources from flooding and erosion. No loss of human life is expected as a result of the action. If approved the structure will be designed and constructed to tolerate flooding and minimize erosion. Policy 5. Protect and improve water quality and supply in the Town of Southold The materials used to construct the dock are unknown and should be identified. I recommend the elimination of the use of CCA-treated materials in marine waters. Wood pressure-treated with a chromated copper arsenate (CCA) is the most commonly used material for pilings for small docks. There has been extensive study of the toxicity of these compounds in the marine environment that suggests that the degree of toxicity depends on the chemical form as it reaches the target organism. The forms will change over time and in response to sediment types, amounts of organic material present, oxygen levels and water movement (Luoma and Carter, 1991). Laboratory studies by Weis et al. (1991, 1992) have shown that leachate from CCA -treated wood can be toxic to estuarine species. Leaching decreases by about 50% daily once the wood is immersed in seawater. Approximately 99%of the leaching occurs within the first 90 days (Cooper, 1990, Brooks 1990; in Sanger and Holland, 2002). If CCA is permitted, please implement the following Best Management Practices recommended by National Oceanic and Atmospheric Administration's (NOAA) to minimize leaching into the water: Where CCA-treated materials are to be used, soaking it in saline waters for 90 days prior to installation will allow leaching to occur in a controlled setting ,or Place a sleeve over the piling to prevent leaching. In addition to potential water quality impacts, the shallow depth of the Hall's Creek,prevents power boat traffic from reaching the upper estuary. The use of the dock must be identified. The installation of the proposed dock may promote power boat traffic and the possible following negative impacts may occur as a result of the shallow depth and narrowness of Hall's Creek Impacts to submerged aquatic vegetation, Contamination from fuel discharges, Erosion on shorelines, and Re-suspension of bottom sediments and turbidity To further the above policy and to reduce turbidity in the event that the proposed action is approved, the following Best Management Practice is strongly recommended: The encirclement of the entire project area with a floating turbidity screen to remain in place 7 days post construction of the dock. Policy 6. Protect and restore the quality and function of the Town of Southold ecosystems including Significant Coastal Fish and Wildlife Habitats and wetlands. The proposed action is located within a DEC Critical Environmental Area. The proposed construction practices of the dock have not been identified. It is recommended that the applicant identify the proposed construction practices. Activities during dock construction can destroy vegetation either above or below the tide line by pulling them from the substrate or destroying their root system. The peat beds underlying salt marshes can also be compacted through the improper use of heavy equipment. In sea grass beds, the installation of pilings may have immediate impacts as well as cause long- term changes. Installation through"jetting"with high-pressure hoses typically disturbs a surrounding area—depopulating grasses there prior to construction. Once areas are depopulated, the presence of pilings may lessen chances of regrowth. Beal, Schmit, and Williams (1999) suggest that changes in seagrass communities in the vicinity of pilings may be caused by the modification of currents, sediment deposition, attraction of bioturbators, and leaching from chemically treated wood. Both marsh grasses and sea grasses have adapted to living in extended periods of sunlight. Their photosynthetic pathways vary from many terrestrial plants allowing them to be highly productive in their natural settings. Shading can have significant impacts on the health and productivity of these plants. It is recommended that the Board minimize shading from dock structures to the greatest extent possible. Based upon the above the action is inconsistent with the following policy standards. Policy Standards 6.1 Protect and restore ecological quality throughout the Town of Southold. The proposed action does not propose a restoration plan of areas that may be impacted (if any) during construction. 6.2 Protect and restore tidal and freshwater wetlands. The proposed action will result in a net loss of tidal wetlands. 6.3 Protect vulnerable fish, wildlife, and plant species, and rare ecological communities. The proposed action is located within a NYSDEC Critical Environmental Area. No design or construction mitigation or best management practices have been proposed to minimize adverse impacts to the greatest extent possible. Policy 7. Protect and improve air quality in the Town of Southold. No significant impact to air quality will occur as a result of the proposed action. Policy 8. Minimize environmental degradation in Town of Southold from solid waste and hazardous substances and wastes. See Policy 5 response above. Policy 9. Provide for public access to, and recreational use of, coastal waters, public lands, andpublic resources of the Town of Southold. The proposed action will remain private and will not support a pattern of development that enhances community character nor preserves "public"open space. Policy 10. Protect Southold's water-dependent uses and promote siting of new water- dependent uses in suitable locations. The proposed action is for the construction of a private dock located within a DEC listed Critical Environmental Area. The 2001 aerial photos indicate that the current number of dock density in Hall's Creek is very low (4). The shallow depth of the creek coupled with the extremely shallow depth of the creek inlet limits the use of the creek by motorized vessels. The creek does and will support manual powered personal recreational vessels, such as kayaks, rowboats etc. with shallow drafts. The physical attributes and limitations of Hall's Creek will not support or promote the concentration of maritime activities. Further, the proposed action will not protect or enhance the physical, cultural and environmental attributes of Hall's Creek. Based upon such, the proposed action does not meet the following policy standards. 10.3 Allow for continuation and development of water-dependent uses within the existing concentration of maritime activity in harbors, inlets and creeks. A. Ensure that public actions enable these harbors, inlets and creeks to continue to function as concentrations of water-dependent uses. B. Protect and enhance the economic, physical, cultural, and environmental attributes which make up the character of these harbors, inlets and creeks. 10.4 Minimize adverse impacts of new and expanding water-dependent uses and provide for their safe operation. A. Limit the potential for adverse impacts associated with development of a new water- dependent use by promoting the location of new development at appropriate sites. Appropriate sites include: 1. sites which have been previously developed, 2. sites which require minimal physical alteration to accommodate development, 3. sites that already possess public infrastructure or locational characteristics that would support a water-dependent use. B. Avoid development of new water-dependent uses at sites that are located outside of the traditional concentrations of water-dependent uses or at sites that exhibit important natural resource values or where the proposed use will cause significant adverse affects on community character, surrounding land and water uses, or scenic quality, Policy 11. Promote sustainable use of living marine resources in Long Island Sound, the Peconic Estuary and Town waters. The action is proposed within Hall's Creek, a listed NYSDEC Critical Environmental Area which entitles the area to a heightened level of protection. The proposed action will not support the following policy standards. A. Ensure that commercial and recreational uses of living marine resources in the Town of Southold are managed in a manner that: 1. places primary importance on maintaining the long-term health and abundance of marine fisheries, 2. results in sustained useable abundance and diversity of the marine resource, 3, does not interfere with population and habitat maintenance and restoration efforts, 4, uses best available scientific information in managing the resources 5. minimizes waste and reduces discard mortality of marine fishery resources, 6. restricts commercial and recreational activities, including the use of certain gear types, gear sizes and practices that have negative impacts on marine habitats. B. Protect and manage native stocks and restore sustainable populations of indigenous fish and wildlife species and other marine living resources. The protection of native stocks includes protecting the genetic integrity of recognizable native populations that can be placed at risk by inappropriate stocking. Native stocks also need to be protected from adverse impacts due to introduction of non-indigenous species. C. Foster the occurrence and abundance of the Town's marine resources through: 1. protection of spawning grounds, habitats, and water quality, 2. enhancement and restoration of fish and shellfish habitat, 3. the prevention of over-fishing. 11.2 Provide for commercial and recreational use of the Town of Southold's finfish, shellfish, crustaceans, and marine plants. A. Maximize the benefits of marine resource use so as to provide: 1. a valuable recreational resource experience, 2. viable business opportunities for commercial and recreational fisheries. C Protect the public health and the marketability of marine and fishery resources by: 1. maintaining and improving water quality of fishery and marketable marine resources to protect public health. 11.4 Promote recreational use of marine resources.
