The following action was taken by the Southold Town Board of Trustees at their Regular
Meeting held on Wednesday, November 17, 2004:
RESOLVED, that the Southold Town Board of Trustees APPROVE the Amendment to Permit
#5456 to allow the construction of a house with a different footprint, and which would be
constructed 10' further from the wetlands, with the condition of a 20' non-disturbance buffer from
the top of the bank, and the rear yard of the house, from the 10' contour seaward, be
maintained with native plantings, and all as depicted on the survey prepared by John T. Metzger
last dated May 20, 2004.
BE IT FURTHER RESOLVED, that the Southold Town Board of Trustees APPROVE the last
One-Year Extension to Permit #5456.

RESOLVED, that the Southold Town Board of Trustees APPROVE the Amendment to Permit
#5456 to allow the construction of a house with a different footprint, but which would be
constructed within the same building envelope shown in the original proposal, with the condition
of a non-turf buffer in the entire area seaward of the house, drywells are installed to contain the
roof rrm-off, and a staked double hay bale line is installed prior to and during construction, and
for a One-Year Extension to Permit #5456, all as depicted on the survey prepared by John T.
Metzger last revised November 17, 2003.

Dear Mr. Raynor:
The following action was taken by the Board of Town Trustees during a Regular Meeting, held
on November 20, 2001, regarding the above matter.
WHEREAS, HenryRaynor on behalf of Frank Martorana applied to the Southold Town
Trnstees for a permit under the provisions of the Wetland Ordinance of the Town of Southold,
application dated October 26, 2001
WHEREAS, said application was referred to the Southold Town Conservation Advisory Council
for their findings and reconunendations, and
WHEREAS, a Public Hearing was held by the Town Trustee.':. with respecl to said application on
November 20, 200! at which time all interested ~ we~ e
person. - given an opportunity to be heard,
and,
WHEREAS, the Board members have personally viewed aud are familiar with ihe premises in
question and the surrounding area, and,
WHEREAS, the Board has considered all the testimony arid do~:umentation submitted
concerning this application, and,
WHEREAS, the structure complies with the standard set forth in Chapter 97-18 of the Southold
Town Code.
WHEREAS, the Board has determined that the project as proposed will not affect the health,
safety and general welfare of the people of the town,
NOW THEREFORE BE IT.
RESOLVED, that the Board of Trustees approved the application of Frank Martorana for a
Wetland Permit for rebuilding dwelling will be at the present rem' yard setback all excavating
will be done landward of the existing setback line and to the road side of structure proposed
dwelling will be two story Proposed elevated walkway will be 3 feet wide by approximately 20
feet long. Floating dock will be 4 feet wide and 20 feet long and constructed predominantly with
CAA ~naterials. With the stipulation that we receive a revised plan showing width of the creek
and the length of dock. House gutters, leaders and drywells to contain roof run-off. Haybales
and silt fencing during construction.
BE IT FURTHER RESOLVED that this determination should not be considered a determination
made for any other Department or Agency, which may also have an application pending for the
same or similar project.
Pemfit to construct project will expire two years from the date it is signed. Fees must be paid, if
applicable and permit issued within six months of the date of the notification.

Two inspections are required and the Trustees are to be notified when project is started and on
completion of said project.

Because of delays in obtaining a permit from NYSDEC, it is necessary that we ask for another
one-year extension to this permit which is due to expire onl 1/20/04. The $50 fee is enclosed.
In addition, we would like to amend the permit to allow the construction of a house with a
different footprint, and which would be constructed 10 feet further from the wetlands, as required
by NYSDEC, than the project previously approved (10/22/03) by the Trustees. To assist you in

To further define the application before the Board of Trustees, I would like to
outline the followin.q elements:
The proposed rebuilding of the existing dwelling will be at the present rear yard
setback and not be any closer to Deep Hole Creek.
All excavating will be done landward of the existing setback line and to the road
side of the structure.
The proposed dwelling will be a two story structure. The proposed elevated
walkway will be 3 feet wide by approximately 20 feet long. The floating dock will
be 4 feet wide by approximately 20 feet long and constructed predominantly with
CAA materials.
