The following action was taken by the Southold Town Board of Trustees at their Regular
Meeting held on Wednesday, September 25, 2002.
RESOLVED, that the Southold Town Board of Trustees Approve an Amendment to Permit
#5104 to change the retaining wall length increased from 55' to 58' to stabilize fiber rolls instead
of timbers and the overall length of the fiber rolls is reduced from 45' to 40' length of the
walkway is increased from 4'x18' to 4'x27', 4'x16' ramp is eliminated and 6'x20' float
eliminated fixed L section 10' in overall length with steps at the seaward end is attached to the
walkway and two 2 pile dolphins are eliminated with the stipulation of a non-turf buffer. One
Year Extension to Permit #5104.

CONSERVATION ADVISORY COUNCIL
At the meeting of the Southold Town Conservation Advisory Council held Monday,
September 23, 2002, the following recommendation was made:
Moved by Melvyn Morris, seconded by Drew Dillingham, it was
RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL WITH
A CONDITION of the Amendment Request of JOSEPH ZITO to Amet~l~t[tll~l~'t~
increase the length of the retaining wall to 58',.e~H~z~t~ te~of the bank using fiber
rolls instead of timbers and the overall ength of the fiber rolls is reduced from 45' to 40',
the length of the walkway is increased from 4'X 18' to 4'X 27', the 4'X 16' ramp is
eliminated, the 6'X 20' float is eliminated, the gwo 2-pile dolphins are eliminated and a
fixed "L" section 10' in overall length with steps at the seaward end is attached to the
walkway.

The CAC recommends Approval of the application with the condition of a 10',.~on-turf
buffer.

9'5" x 9'5" storage shed; to construct a 58' retaining wall with a non-turf buffer placed landward
of the wall; to place toe stabilization fiber rolls 40' in overall length; to place approx. 25 c.y. of
clean sand behind toe stabilization fiber rolls extending 15' landward; to install 6' high stockade
fencing on both sides of yard with seaward ends at the HWM; to construct a 4' x 27' fixed walk-
way dock at the south end of the retaining wall, with a fixed L-section 10' in overall length,
extending north fi.om the side of the fixed walkway at its seaward end, with steps at the seaward
end of the L-section. A boat at the dock may extend no further than 1/3 across the creek. Located:

The New York District, U.S. Army Corps of Engineers, has
received a request for Department of the Army authorization for
the following activity:

ACTIVITY:
Construct a 4 foot by 18 foot fixed walkway
connected to a 4 foot by 16 foot hinged walk-ramp
with a 6 foot by 20 foot float plus two 2-pile
dolphins to secure the float. The purpose of this
work is to provide mooring for a private
recreational vessel.
WATERWAY:
an unnamed canal off Great Peconic Bay
LOCATION:
Mattituck, Town of Southold, Suffolk County, NY
As this is minor in nature, authorization may be by Letter
of Permission. This is in accordance with current Federal
Regulations governing work in navigable waters of the United
States. To accomplish the coordination required, prior to the
issuance of a Letter of Permission, your review of the enclosed
drawings is requested.
Pursuant to Section 307 (c) of the Coastal Zone Management
Act of 1972 as amended (16 U.S.C. 1465 (c) (3) (A)), the applicant
has certified that the activity complies with and will be
conducted in a manner that is consistent with the approved state
coastal zone management program.
To allow for the timely processing of the subject
application, your comments are requested within 15 days of the
date of this letter.

Dear Mr. Fitzgerald,
The following action was taken by the Board of Town Trustees
during a Regular Meeting, held on January 26, 2000, regarding
the above matter:
WHEREAS, JOSEPH ZITO, applied to the Southold Town Trustees for
a permit under the provisions of the Wetland Ordinance of the
Town of $outhold, application dated January 5, 2000 and,
WHEREAS, said application was referred to the Southold Town
Conservation Advisory Council for their findings and
recommendations, and
WHEREAS,-a.~ublic Hearing was held by the Town Trustees with
respect to said application on January 26, 2000, at which time
all interested persons were given an opportunity to be heard,
and,
WHEREAS, the Board members have personally viewed and are
familiar with the premises in question and the surrounding area,
and,
WHEREAS, the Board has considered all the testimony and
documentation submitted concerning this application, and,
WHEREAS, the structure complies with the standard set forth in
Chapter 97-18 of the Southold Town Code,
WHEREAS, the Board has determined that the project as proposed
will not affect the health, safety and general welfare of the
people of the town,
NOW THEREFORE BE IT,
RESOLVED, that the Board of Trustees approves the application of
JOSEPH zITO to construct a 9'5" X 9'5" storage shed, a 55'
retaining wall, place toe stabilization timbers 45' in overall
length, place approx. 25 c.y. of clean beach sand behind toe
stabilization timbers extending 15' landward, install 6'
stockade fence on both sides of yard, the seaward end will be at
the HWM, construct a 4' X 18' walkway, at south end of wall, and
a non-turf buffer placed landward of the wall, a 4' X 16' ramp
and a 6' X 20' float with 2- 2 pile dolphins. The boat and float
be no further Qut than 1/3 across creek, and new plans showing
an "L" configuration instead of "T". Located: 3600 Deep Hole
Drive, Mattituck.
BE IT FURTHER RESOLVED that this determination should not be
considered a determination made for any other Department or
Agency which may also have an application pending for the same
or similar project.
Permit to construct and complete Droject will exDire two years
from the date it is signed. Fees must be paid, if applicable,
and permit issued within six months of the date of this
notification.
Two inspections are required and the Trustees are to be notified
upon completion of said project.

Mr. Zito wishes to propose an amendment to the referaneed permit so that the dock structure may
conform to that fina![y approved by the NYSDEC.
The following changes are proposed:
The retaining wall length is increased from 55' to 58'.
· Toe stabilization is achieved through the use of fiber rolls instead of timbers and the overall
length of the fiber rolls is reduced from 45' to 40'.
· The length ofthe walkway is increased fi-om 4, x 18'to4'x 27'.
· The 4' x 16' ramp is e/iminated.
· The 6' x 20' float is eliminated.
· A fixed L-section 10' in overall length with steps at the seaward end is attached to the walk-
way.
· The two 2-pile dolphins are eliminated.
A new drawing, Project Plan, Revised July 2, 2002, is enclosed.
