The proposed action is located within REACH 1. The proposed action has been reviewed to Chapter 95, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposed action is generally CONSISTENT with the Policy Standards and therefore is CONSISTENT with the LWRP provided that the following standard best management practices are implemented to further the intent of the LWRP Policies 5, 6, and 11. Prohibit the removal or reclamation of the sand as indicated and described. The area is vegetated and demonstrates the attributes of an evolving marsh ecosystem. All efforts should be employed to minimize impacts to this area during construction. Require that the new vinyl bulkhead be backfilled with clean sand from an off-site location. Require the installation of a floating turbidity screen around the entire project area. The turbidity screen should remain in place a sufficient amount of time post project to minimize turbidity. Pursuant to Chapter 95, the Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action. Box 1734 2422 3Vestj~tia£ia ~enue attituck, 11952-0905 Dear Board of Trustees: The 100 foot bulkhead on my property is kicking out from under, threatening the erosion of the 20 foot bank it supports into Mattituck Creek. Permits (copies enclosed) for the bulkhead have issued by the: Board of Town Trustees, N.Y.S. Department of Environmental Conservation, and Army Corps of Engineers. However, the permits are in the name of Robert Patchell, a former owner of the property. On visiting the Trustees' office, I was advised to submit a letter to you requesting that the permit(s) be transferred in my name. We purchased the property, built our home, and have resided here since 1996. Your cooperation would be most appreciated so that we may proceed to repair/replace the bulkhead as needed. Thank you. Formica 2422 Westphalia Road P. O. Box 1734 Mattituck, NY 11952 Januat~y 7, 1999 Reasons for the Re~luest. The over-riding reason for the request is to improve environmental quality: 1. by eliminating the stagnant pool created by the floats and including debris, flotsam, boat discharges, and odors which collect against the sides of the floats, and 2. by keeping the creek-bottom free from materials settling on the bottom and so enhance the growth of marine life. In addition, the fixed pier would be in compliance with the approved plans which a previous owner apparently modified unilaterally. It would also provide a stable platform to the boat dock.
