Dear Mr. Ivans:
The Board of Town Trustees took the following action during its regular meeting held on
Wedneeday November 17, 2004, regarding the above matter:
WHEREAS, Matt Ivans of Suffolk Environmental Consulting as agent for MARK TE$$ER
applied to the Southold Town Trustees for a permit under the provisions of Chapter 97 of the
Soathold Town Code, the Wetland Ordinance of the Town of Southold, application dated
October 5, 2004, and,
WHEREAS, said application was referred to the Southold Town Conservation Advisory council
for their findings and recommendations, and,
WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on
November 17, 2004, at which time all interested persons were given an opportunity to be heard,
and,
WHEREAS, the Board members have personally viewed and are familiar with the premises in
question and the surrounding area, and,
WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application, and,

WHEREAS, the structure complies with the standards set forth in Chapter 97 of the Southold
Town Code,
WHEREAS, the Board has determined that the project as proposed will not affect the health,
safety and general welfare of the people of the town,
RESOLVED, that the Board of Trustees approve the application of Matt Ivans as agent for
MARK TESSER for a 4'x 22' fixed elevated catwalk, construct a fixed elevated catwalk
extension 4' x 8', construct a fixed elevated walkway (including hinged ramp) 4' x 32' (elevated
walkway is 4' x 18' and hinged ramp is 3' x 15'), and construct a floating dock 6' 20' secured by
four pilings, and all as per plans submitted by Suffolk Environmental Consulting and dated
November 17, 2004.
Permit to construct and complete project will expire two years from the date the permit is signed.
Fees must be paid, if applicable, and permit issued within six months of the date of this
notification.
Inspections are required at a fee of $50.00 per inspection. (See attached ,schedule.)
This is not a determination from any other agency.

CONSERVATION ADVISORY COUNCIL
TOWN OF SOUTHOLD
At the meeting of the Southold Town Conservation Advisory Council held Tues.,
November 9, 2004, the following recommendation was made:
Moved by Don Wilder, seconded by Jack McGreevy, it was
RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL WITH
A CONDITION of the Wetland Permit application of MARK TESSER for the existing 5'X
22' fixed elevated catwalk, construct a fixed elevated catwalk extension 5'X 8', construct
a fixed elevated walkway (including hinged ramp) 5'X 32', and construct a floating dock
6'X 20' secured by four (4) pilings.
Located: 455 Lesters Rd,, Mattituck. SCTM#114-7-1
The CAC recommends Approval of the applicaQon with the Condition that the docking
facility and boat do not exceed 1/3 across the width of the creek, and no treated lumber
is used.

Applicant wishes to construct a dock assembly reflecting the
Town of Southold Board of Trustees Dock Permit (No. 746),
issued September 11, 1972, authorizing for the following:
Place a floating dock 8 fL 6 in. by 18 fL, and
walkway 5 f~ by 32ft. (315 sq. ft.) with 2pilings
25 f~ from the ordinary high water mark in front
of his properO~...
Applicant wishes to modify the approved-for design to
construct the following overall design:
· Legalize the existing Fixed Elevated Catwalk measuring 5.0' W
x 22.0' L supported by three (3) sets pilings;
· Construct a Fixed Elevated Catwalk Extension measuring 5.0' W
x 8.0' L supported by one (1) set of three (3) pilings ("3~pile bents");
Construct the previously Town of Southold Board of Trustees
approved Fixed Elevated Walkway (including Hinged Ramp)
measuring 5.0' W x 32.0' L supported by three (3) sets of three
(3) pilings ("3-pile bents"); and
Construct a Floating Dock measuring 6.0' W x 20.0' L and secured
