WHEREAS,En-Consultants, Inc. on behalf of Kurt Freudenberg & Janet Latham applied to the Southold Town Trustees for a permit under the provisions of the Wetland Ordinance of the Town of Southold, application dated September 4, , 2002 WHEREAS, said application was referred to the Southold Town Conservation Advisory Council for their findings and recommendations, and WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on September 25, 2002 at which time all interested persons were given an opportunity to be heard, and, WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area, and, WHEREAS, the Board has considered all the testimony and documentation submitted concerning this application, and, WHEREAS, the structure complies with the standard set forth in Chapter 97-18 of the Southold . 2 • Town Code. WHEREAS, the Board has determined that the project as proposed will not affect the health, safety and general welfare of the people of the town, NOW THEREFORE BE IT, RESOLVED, that the Board of Trustees approved the application of KURT FREUDENBERG & JANET LATHAM for a Wetland Permit to construct a fixed timber dock, consisting of a inclined ramp 4'x61' fixed catwalk elevated a minimum of 4' above grade of marsh 3'x14' timber ramp and 6'x20' float secured by(2) 8" diameter pilings. Clear and maintain a 4' wide path to access dock. . BE IT FURTHER RESOLVED that this determination should not be considered a determination made for any other Department or Agency, which may also have an application pending for the same or similar project. Fee must be paid, if applicable and permit issued within six months of the date of this notification. If inspections are required, at a fee of$5.00 per inspection (See attached schedule). That the work involved will be subject to the inspection and approval of the Board of its agents, and non-compliance with.the provisions of the originating application, may be curse for revocation of this Permit by resolution of the said Board. 5. That there will be no unreasonable interference with navigation as a result of the work herein authorized. 6. That there shall be no interference with the right of the public to pass and repass along the beach between high and low water marks. 7. That if future operations of the Town of Southold require the removal and/or alterations in the location of the work herein authorized, or if, in the opinion of the Board of Ttustees, the, work shall cause unreasonable obstruction to free navigation, the said Perms ee will be required, upon due notice, to remove or alter this work or project herein stated without expenses to the Town of Southold 8. During a local public hearing held on the application by the Town of Southold Trustees, however, the Board required the length of the ramp to be increased by four feet and the length of the fixed catwalk to in turn be reduced by four feet. Therefore, as the overall extent of the dock would remain unchanged, would you kindly issue a permit modification to construct a 4' x 57' catwalk; 3' x 18' ramp; and 6' x 20' float, as depicted on the revised project plan, (4) copies of which are attached hereto. CENAN-OP-RE PUBLIC NOTICE NO. 2002-01228-L2 Our preliminary determination is that the activity for which authorization is sought herein is not likely to affect any Federally endangered or threatened species or their critical habitat. However, pursuant to Section 7 of the Endangered Species Act (16 U.S.C. 1531), the District Engineer is consulting with the appropriate Federal agency to determine the presence of and potential impacts to listed species in the project area or their critical habitat. The Magnuson-Stevens Fishery Conservation and Management Act, as amended by the Sustainable Fisheries Act of 1996 (Public Law 104-267), requires all federal agencies to consult with the National Marine Fisheries Service (NMFS) on all actions, or proposed actions, permitted, funded, or undertaken by the agency, that may adversely affect Essential Fish Habitat (EFH). A complete description of the project is given in the attached Work Description. The District Engineer has made the preliminary determination that the site-specific adverse effects are not likely to not be substantial. Further consultation with NMFS regarding EFH impacts and conservation recommendations is being conducted and will be concluded prior to the final decision. Based upon a review of the latest published version of the National Register of Historic Places, there are no known sites eligible for, or included in, the Register within the permit area. The work would involve construction of a pier assembly consisting of an inclined ramp, a 61 foot by 4 foot fixed pier to be elevated a minimum of 4 feet of the grade of vegetated wetlands, a 14 foot by 3 foot hinged ramp, and a 20 foot by 6 foot float secured by two (2) guide pilings. The proposed work could have a minor adverse impact on Essential Fish Habitat (EFH) and EFH-managed species as a result of a temporary increase in turbidity during construction. Although this may adversely affect the feeding success of some EFH- managed species or their prey, it is expected that fish populations would avoid the area of disturbance. It is also expected that the turbidity would rapidly dissipate because of the high settling velocity of the sandy substrate. In addition, the proposed structure would provide attachment surfaces for encrusting organisms, which could increase the forage base for EFH-managed species or their prey and provide additional ecological functions.
