Dear Mr. Herrmann
The following action was taken by the Board of Town Trustees during a Regular Meeting, held
on September 25, 2002, regarding the above matter.
WHEREAS,En-Consultants, Inc. on behalf of Kurt Freudenberg & Janet Latham applied to
the Southold Town Trustees for a permit under the provisions of the Wetland Ordinance of the
Town of Southold, application dated September 4, , 2002
WHEREAS, said application was referred to the Southold Town Conservation Advisory
Council for their findings and recommendations, and
WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on
September 25, 2002 at which time all interested persons were given an opportunity to be heard,
and,
WHEREAS, the Board members have personally viewed and are familiar with the premises in
question and the surrounding area, and,
WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application, and,
WHEREAS, the structure complies with the standard set forth in Chapter 97-18 of the Southold
. 2 •
Town Code.
WHEREAS, the Board has determined that the project as proposed will not affect the health,
safety and general welfare of the people of the town,
NOW THEREFORE BE IT,
RESOLVED, that the Board of Trustees approved the application of KURT FREUDENBERG
& JANET LATHAM for a Wetland Permit to construct a fixed timber dock, consisting of a
inclined ramp 4'x61' fixed catwalk elevated a minimum of 4' above grade of marsh 3'x14'
timber ramp and 6'x20' float secured by(2) 8" diameter pilings. Clear and maintain a 4' wide
path to access dock. .
BE IT FURTHER RESOLVED that this determination should not be considered a determination
made for any other Department or Agency, which may also have an application pending for the
same or similar project.
Fee must be paid, if applicable and permit issued within six months of the date of this
notification.
If inspections are required, at a fee of$5.00 per inspection (See attached schedule).
FEES: $1,031.00

part of the consideration for the issuance of the Permit does understand and prescribe to the fol-
lowing:
1. That the said Board of Trustees and the Town of Southold aft released from may and
all damages, or daims for damages, of snits arising directly or indirectly as a result of say oper-
ation performed pursuant to this permit, mad the said Permiteee will, at his or het own expense,
defend any and all such suits initiated by third parties, and the said Permittee asanmsa full liability
with respect thereto, to the complete exclusion of the Board of Trustees of the Town of Southoid
2. That this Permit is valid for a period of 24 mos, which is considered to be the
estimated time required to complete the work involved, but shoald dram stances warrant, request
for an extension may be made to the Board at a later date.

3. That this Permit should be retained indefinitely, or as long as the said Permittee wishes
to maintain the structure or project involved, to provide evidence to anyone concerned that math-
orization was originally obtained.
4. That the work involved will be subject to the inspection and approval of the Board of
its agents, and non-compliance with.the provisions of the originating application, may be curse for
revocation of this Permit by resolution of the said Board.
5. That there will be no unreasonable interference with navigation as a result of the work
herein authorized.
6. That there shall be no interference with the right of the public to pass and repass along
the beach between high and low water marks.
7. That if future operations of the Town of Southold require the removal and/or alterations
in the location of the work herein authorized, or if, in the opinion of the Board of Ttustees, the,
work shall cause unreasonable obstruction to free navigation, the said Perms ee will be required,
upon due notice, to remove or alter this work or project herein stated without expenses to the Town
of Southold
8. That the said Board will be notified by the Permittee of the completion of the work auth-
orized
9. That the Permittee will obtain all other permits and consents that may be required sup-
plemental to this permit which may be subject to revoke upon failure to obtain same.

Dear Ms. Felice:
The captioned permit was issued 17 October 2002 and authorizes the construction of a fixed dock, consisting
of a 4' x 61' catwalk; 3' x 14' ramp; and 6' x 20' float. During a local public hearing held on the application
by the Town of Southold Trustees, however, the Board required the length of the ramp to be increased by
four feet and the length of the fixed catwalk to in turn be reduced by four feet.
Therefore, as the overall extent of the dock would remain unchanged, would you kindly issue a permit
modification to construct a 4' x 57' catwalk; 3' x 18' ramp; and 6' x 20' float, as depicted on the revised
project plan, (4) copies of which are attached hereto.
By copy of this letter and revised plans, I am making a final submission to the Town of Southold Trustees
and notifying the U.S. Army Corps of Engineers of this change.

a fixed timber dock, consisting of an inclined ramp; 4'X 61' fixed catwalk (elevated a

A detailed description and plans of the applicant's activity are enclosed to assist in your review.
The decision whether to issue a permit will be based on an evaluation of the probable impact, including cumulative
impacts, of the proposed activity on the public interest. That decision will reflect the national concern for both
protection and utilization of important resources. The benefits which reasonably may be expected to accrue from
the proposal must be balanced against its reasonably foreseeable detriments. All factors which may be relevant
to the proposal will be considered including the cumulative effects thereof; among those are conservation,
economics, aesthetics, general environmental concerns, wetlands, historical properties, fish and wildlife values,
floodplain values, land use, navigation, shoreline erosion and accretion, recreation, water supply and conservation,
water quality, energy needs, safety, food and fiber production, mineral needs, consideration of property ownership
and,in general the needs and welfare of the people.
The Corps of Engineers is soliciting comments from the public; Federal, state, and local agencies and officials;
Indian Tribes; and other interested parties in order to consider and evaluate the impacts of this proposed activity.
Any comments received will be considered by the Corps of Engineers to determine whether to issue, modify,
condition or deny a permit for this proposal. To make this decision, comments are used to assess impacts on
endangered species, historic properties, water quality, general environmental effects, and the other public interest
factors listed above. Comments are used in preparation of an Environmental Assessment and/or an Environmental
Impact Statement pursuant to the National Environmental Policy Act. Comments are also used to determine the
need for a public hearing and to determine the overall public interest of the proposed activity.
ALL COMMENTS REGARDING THE PERMIT APPLICATION MUST BE PREPARED IN WRITING AND
MAILED TO REACH THIS OFFICE BEFORE THE EXPIRATION DATE OF THIS NOTICE, otherwise, it will
be presumed that there are no objections to the activity.
Any person may request, in writing, before this public notice expires, that a public hearing be held to collect
information necessary to consider this application. Requests for public hearings shall state, with particularity, the
reasons why a public hearing should be held. It should be noted that information submitted by mail is considered
just as carefully in the permit decision process and bears the same weight as that furnished at a public hearing.

Our preliminary determination is that the activity for which authorization is sought herein is not likely to affect any
Federally endangered or threatened species or their critical habitat. However, pursuant to Section 7 of the
Endangered Species Act (16 U.S.C. 1531), the District Engineer is consulting with the appropriate Federal agency
to determine the presence of and potential impacts to listed species in the project area or their critical habitat.
The Magnuson-Stevens Fishery Conservation and Management Act, as amended by the Sustainable Fisheries Act
of 1996 (Public Law 104-267), requires all federal agencies to consult with the National Marine Fisheries Service
(NMFS) on all actions, or proposed actions, permitted, funded, or undertaken by the agency, that may adversely
affect Essential Fish Habitat (EFH). A complete description of the project is given in the attached Work
Description. The District Engineer has made the preliminary determination that the site-specific adverse effects
are not likely to not be substantial. Further consultation with NMFS regarding EFH impacts and conservation
recommendations is being conducted and will be concluded prior to the final decision.
Based upon a review of the latest published version of the National Register of Historic Places, there are no known
sites eligible for, or included in, the Register within the permit area. Presently unknown archeological, scientific,
prehistorical, or historical data may be lost by work accomplished under the required permit.
Pursuant to Section 307 (c) of the Coastal Zone Management Act of 1972 as amended [16 U.S.C. 1456 (c)], for
activities under consideration that are located within the coastal zone of a state which has a federally approved
coastal zone management program, the applicant has certified in the permit application that the activity complies
with, and will be conducted in a manner that is consistent with, the approved state coastal zone management
program. By this public notice, we are requesting the state's concurrence with, objection to, or waiver of the
applicant's certification. No permit decision will be made until one of these actions occur. For activities within
the coastal zone of New York State, the applicant's certification and accompanying information is available from
the Consistency Coordinator, New York State Department of State, Division of Coastal Resources and Waterfront
Revitalization, Coastal Zone Management Program, 41 State Street, Albany, New York 12231, Telephone (518)
474-6000. Comments regarding the applicant's certification, and copies of any letters to this office commenting
upon this proposal, should be so addressed.
In addition to any required water quality certificate and coastal zone management program concurrence, the
applicant has obtained or requested the following governmental authorization for the activity under consideration:

WORK DESCRIPTION
The applicants, Kurt Freudenberg and Janet Latham, have requested Department of the
Army authorization for construct a pier-assembly in Darby's Branch, Mattituck Creek at
the Town of Southold, Suffolk County, New York.
The work would involve construction of a pier assembly consisting of an inclined ramp,
a 61 foot by 4 foot fixed pier to be elevated a minimum of 4 feet of the grade of vegetated
wetlands, a 14 foot by 3 foot hinged ramp, and a 20 foot by 6 foot float secured by two
(2) guide pilings.
The proposed work could have a minor adverse impact on Essential Fish Habitat (EFH)
and EFH-managed species as a result of a temporary increase in turbidity during
construction. Although this may adversely affect the feeding success of some EFH-
managed species or their prey, it is expected that fish populations would avoid the area of
disturbance. It is also expected that the turbidity would rapidly dissipate because of the
high settling velocity of the sandy substrate. In addition, the proposed structure would
provide attachment surfaces for encrusting organisms, which could increase the forage base
for EFH-managed species or their prey and provide additional ecological functions.
The stated purpose of this project is to provide access to the waterway for recreational
purposes and to provide a safe mooring facility for the applicants' vessel(s).
