Dear President King and Members of the Board:
I am the President of the Paradise Point Association. This letter is in reference to the
amendment request to Permit #6214 from Mary Zupa.
The Association has three basic concerns regarding the proposed amendment and the
Plan View presented to the Trustees:
Our primary concern is that the proposed dock may significantly interfere with the
ability of Association members to safely use, without undue interference, the slips
on the west side of the Association dock and allow safe, unimpeded ingress and
egress to the channel between the Basin and the Bay.
It is difficult to fully understand the impact the proposed T formation will have on
the existing permitted Association dock and the impact on ingress and egress to
the Bay as the plan does not appear to be an official survey and does not show
dimensions, particularly with respect to the distances between the proposed dock
and the existing Association dock. In addition, it does not appear that the location
of the proposed dock has been staked. Nevertheless, using the plan's scale, the
proposed dock would seem to come quite close to the slips on the west side of the
Association dock particularly when you take into account the need to back boats
in or out of these slips directly into the path of the proposed dock.
While the Zupa's proposed dock is 20 feet in length and six feet wide, because of
its proposed location, the impact of any boat that is longer than 20 feet on the
dock must be addressed. In this case the Zupas have a 45 foot boat which may
also have the effect of unduly interfering with the Association members' use of
their dock and all basin owners' ingress and egress to the Bay. Both the length
and the beam of this very large boat should be considered as it will have the effect
of creating a very significant increase in the space taken up by the use of this
dock.
We are advised that the DEC has not granted the Zupa's a right to have any dock and that
the DEC is reviewing the Zupa application.

Finally, as you may also recall the Association has a deeded easement around the Zupa's
property and the dock as proposed would require Association permission. While we have
not granted such permission we are actively pursuing settlement negotiations, which
would include addressing the Zupa's desire to have a dock for their boats. Unless and
until a settlement is reached, however, the Association will not grant consent to block its
deeded easement.

PROJECT DESCRIPTION and LOCATION:
The applicant, Mary Zupa, has applied to the New York State Department of Environmental
Conservation (DEC or Department) for a modification to an existing permit to install 1,000 to
1,500 pound rock armor along 112 linear feet of an existing bulkhead; construct 332 linear feet of
timber retaining wall 12 feet landward of the existing bulkhead; place pervious stone between the
bulkhead and the upper retaining wall; and reconstruct in-place a combined 30 linear feet of
bulkhead and return. The applicant also requests that the permit be extended for five years. In
addition, the applicant proposes to construct a 4 foot by 20 foot fiberglass grid ("Flo Thru") dock,
3 foot by 14 foot seasonal ramp, and 6 foot by 20 foot seasonal float. The proposed project is to
be located at 580 Basin Road, Town of Southold, Suffolk County, SCTM # 1000-81-1-16.7.
On November 14, 2002, the Department issued the applicant a Tidal Wetland permit and a Water
Quality Certification to construct a single family dwelling, garage, sanitary system, swimming.
pool, deck, gravel driveway, public water service, 4-foot wide access path and 4 foot by 4 foot
steps to the beach. This permit also included permission to install 52 linear feet of a new low-sill
bulkhead to replace an existing bulkhead in the same location, and plantings.
SEQRA STATUS: Department staff has determined that this is a Type 1I action and thus,
is not subject to the State Environmental Quality Review Act.
STAFF'S POSITION: By letter dated November 2, 2007, DEC Chief Permit Administrator
William R. Adriance informed Ms. Catherine Mesiano, the applicant's consultant, that the
requested permit modification is not compatible with the preservation and protection of tidal
wetlands with the public health and welfare, and is not reasonable and necessary. By letter dated
February 26, 2008, Mr. Adriance wrote to Victor J. Zupa, Esq., the applicant's husband, denying
the dock application based upon staff's determination that it did not meet the standards for permit
issuance in Part 661 of Title 6 of the New York Compilation of Codes, Rules and Regulations (6
NYCRR).
PUBLIC LEGISLATIVE HEARING
In accordance with the provisions of Parts 621,624 and 661 of 6 NYCRR, a legislative heating
will be held before Administrative Law Judge (ALJ) Helene G. Goldberger to receive unsworn
statements from the public on the permit application on March 3, 2009 at the Cutchogue Free
Library located at 27550 Main Road, Cutchogue, New York at 10:00 a.m.
All pemons, organizations, corporations or government agencies that may be affected by the
project are invited to attend the hearing session to submit oral or written comments. Written
comments may be sent to Helene G. Goldberger, Administrative Law Judge, at the New York '
State Department of Environmental Conservation, Office of Hearings and Mediation Services,
625 Broadvfay, Albany, New York 12233-1550 until February 27, 2009. It is not necessary to
file a written request in advance to speak at the legislative heating.
The heating location is reasonably accessible to persons with a mobility impairment. Interpreter
services shall be made available to deaf persons, at no charge, upon written request to the ALJ at
least 10 business days before the hearing.
ISSUES CONFERENCE: A pre-adjudicatory hearing issues conference will be held
immediately following the legislative heating on March 3, 2009 at the same location. The
purpose of the issues conference will be to define, narrow and resolve, if possible, the issues
concerning the permit application. Participation at the issues conference shall be limited to
Department staff, the applicant, and those persons and organizations requesting party status.
FILING FOR PARTY STATUS AND PROPOSED ISSUES: Persons and organizations
seeking party status to participate at any adjudicatory hearing must file a written petition meeting
the requirement of 6 NYCRR 624.5(b). Mere opposition to the project is not a sufficient basis to
be granted party status. A petition must fully identify the proposed party and itl representative,
the petitioner's environmental interest in the proceeding, any interest related to the statutes
administered by the Department that are relevant to the project, whether the petition is for full
party or amicus status, and the precise grounds for opposition or support. Petitioners for full
party status must identify the witnesses that they would present and the nature of their evidence.
If a petitioner intends to rely upon expert testimony, the petitioner must identify the name of the
expert, that person's qualifications, a summary of the subject matter on which the expert is
offered, and a summary of the expert's opinions as well as the facts upon which those opinions
are based.

WHEREAS, said application was referred to the Southold Town Conservation Advisory
Council for their findings and recommendations, and,
WHEREAS, a Public Hearing was held by the Town Trustees with respect to said
application on August 24, 2005 at which time all interested persons were given an

WHEREAS, the Board members have personally viewed and are familiar with the
premises in question and the surrounding area, and,

WHEREAS, the Board has determined that the project as proposed will not affect the
health, safety and general welfare of the people of the town,
RESOLVED, that the Board of Trustees approve the application of MARY ZUPA to
install a 4' x 30' fiberglass grid walk @ 2.5' above grade, 3'x 6' ramp, and 6'x 20' float
and two 8" piles, parallel to the Paradise Point dock, and all as depicted on the plans
prepared by Robert H. Fox last dated October 4, 2006 with the condition that no boats
to be docked at the seaward end of proposed float, and to be consistent with the LWRP
see attached Best Management Practices.
Permit to construct and complete project will expire two years from the date the permit
is signed. Fees must be paid, if applicable, and permit issued within six months of the
date of this notification.
Inspections are required at a fee of $50.00 per inspection. (See attached schedule.)
This is not a determination from any other agency.

The proposed action has been reviewed to Chapter 95, Waterfront Consistency Review of the
Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy
Standards. Based upon the information provided on the LWRP Consistency Assessment Form
submitted to this department, as well as the records available to me, it is my recommendation
that the proposed action is generally CONSISTENT with the following Policy Standards
and therefore is CONSISTENT with the LWRP provided that the Board require any
necessary amendments to the application and implement appropriate best management
practices to further the LWRP Policy Standards. Recommended Best Management
Practices include:
To further the intent of LWRP Policies 5, 6, and 8; protect water quality and the
health of marine organisms; require that no CCA treated wood~ oil based
preservatives containing creosote (CRT) or pentachlorophenol (PCPh applied to the
surface of wood materials shall be permitted in the construction materials of the
structure. The applicant shall use a decay resistant alternative.
2. Require floating turbidity screens to minimize turbidity in the water column during
construction.
Pursuant to Chapter 95, the Board of Trustees shall consider this recommendation in preparing
its written determination regarding the consistency of the proposed action.
