Project Description: To install four (4) bluff catch walls in two (2) existing

Findings: The project meets all the requirements for issuance of an Emergency
Wetlands Permit as determined by the Board of Trustees. The issuance of the
Emergency Wetlands Permit allows for the operations as indicated on the
erosion control plan prepared by Suffolk Environmental Consulting, Inc. dated
November 14, 2005.
Special Conditions: Final inspection.
This is not a determination from any other agency.

Dear Mr. Anderson:
Thank you for spending time talking to me about different options that may be available for the
mstoration/remediation of our bluff. As a result of 10 consecutive days of rain and the 14 inches total
rainfall in October, a section of our bluffblew out and there was a mudslide onto our beach below. We
think this occurred on or about October 15, 2005. There were similar mudslides up and down the beach and
particularly to the East of our property.
Please find enclosed a copy of our survey and a copy of the picture in the Suffolk Times, which
will give you a sense of what we are dealing with. I met with the Southold Trustees on Wednesday,
October 19, 2005 to request an emergency permit. My request was denied. Upon their recommendation for
immediate actions I could take on my property, which would be outside of their jurisdiction, I have placed
hay bales along the top of fl~e bluff to slow down ami deflect any runoff over the top of the bluff. I have
also cordoned offthe top and bottom of the gully with hazard tape in the hope that no-une will trespass on
our property.
I undid that the Southold Trustees and the New York State Deparlment of Cunservation both
have jurisdiction over the coastline along the Long Island Sound. 1 also understand that the steps prior to
the issuance of a permit may take months. I was hoping for an immediate solution to stabilize the bluffto
better endure the upcoming winter storms, but it does not seem likely that I will be allowed to take any
actions until the Spring of 2006.
1 have an appointment on Wednesday November 9, 2005 in 6~e morning for the Southold T~
to come and make a site visit. When I am advised of the exact time I will notify you., perhaps you will be
able to attend. Allen Connell fi'om USDA Natural Resources Conservation Services also visited our
property and will be mailing me a report containing his observations. If you would like to talk to him, he
can be reached at (631) 727~2315. I will forward a copy of his report to you upon its receipt.

This proposal is to remediate the erosion resulting from the recent heavy rains of
October, which created two (2) substantial gullies within the face of the bluff within
the northern section of subject property. The implementation and maintenance of this
proposal will create much less impact, if any, to the surrounding environment, than
allowing for the erosion to continue, which could potentially adversely effect the
contiguous surface waters of Long Island Sound if left unchecked. All mitigation
measures will be included during this project to minimize any effect to the
surrounding environment, including, but not limited to, staked haybales and siltation
fencing.

INSTRUCTIONS

proposed actions that are subject to the Town of Southold Waterfront Consistency Review Law. This
assessment is intended to supplement other information used by a Town of Southold agency in
making a determination of consistency. *Except minor exempt actions including Building Permits
and other ministerial permits not located within the Coastal Erosion Hazard Area.
Before answering the questions in Section C, the preparer of this form should review the exempt
minor action list, policies and explanations of each policy contained in the Town of Southold Local
Waterfront Revitalization Program. A proposed action will be evaluated as to its significant
beneficial and adverse effects upon the coastal area (which includes all of Southold Town).
If any question in Section C on this form is answered "yes", then the proposed action may affect the
achievement of the LWRP policy standards and conditions contained in the consistency review law.
Thus, the action should be analyzed in more detail and, if necessary, modified prior to making a
determination that it is consistent to the maximum extent practicable with the LWRP policy

Nature and extent of action:
The applicant's property fronts on Long Island Sound, and contains a coastal bluff. Record-breaking
rainfall during the month of October, 2005 caused two large gullies to form on the bluff face of the
applicant's property, de-stabilizing the bluff. The applicant is request an emergency permit from the Town
Trustee's to restore the bluffto the pre-existing conditions by filling in the gullies with clean fill of
compatible grain size. The fill will be stabilized by four (4) catch walls installed within the gullies,
perpendicular to the direction of flow, and proposed native shrubs and grasses.
