Review with Me LkAA' From: (-P004i l84®~M'1YWF Date: '6 - !5-- 0,5- 1000-17-5-3.2 Application for Permits Dear Sir or Madam: Enclosed is our application for a permit to construct an alteration to our home, the referenced property, which we understand is within the Trustees jurisdiction, since it is seaward of the Coastal Erosion Hazard (CEH) line, as discussed below. We believe that two permits are required from the Board - a Coastal Erosion Permit, and a Wetland Permit. The reasons for our application are discussed below. Board of Trustees Jurisdiction Our property is immediately to the east of Orient-East Marion (O-EM) Park property (Truman Beach). According to NYSDEC Coastal Erosion maps (Sheet #17 for the Town of Southold), the Coastal Erosion Hazard (CEH) line appears to run through the southern portion of our property, and is most likely routed along the seawall (see Exhibits Al, NYSDEC CEH map, and A2, aerial maps depicting seawall). The attached tax map (Exhibit B) shows a sketch approximating the CEH line with respect to our property boundaries, and Dwg. No. 1 presents a Site Plan (Exhibit Q. Please note that the Coastal Erosion Hazard line is approximated on these drawings; an exact transposition from the NYSDEC/Town map (Sheet #17) is not possible because there appears to be an error on the map in delineating Truman Beach, our western neighbor. The dimensions of the O- EM property on the NYSDEC map do not match the dimensions of this same property shown on the Town of Southold tax map (Exhibit B); thus, the CEH line cannot be correctly transposed onto the Site Plan, since the only point of reference (the eastern property line of the OEM beach) for such transposition is incorrect. However, close inspection of the NYSDEC leads us to believe that the CEH line runs along the seawall that traverses our property, from which we can conclude that our entire property is seaward of the CEH line. Scope of Work The proposed work consists of the following scope: Southold Board of Trustees October 5, 2005 Page 2 of 3 Activity No. 1: Enclosure of an existing alcove in the outdoor rear deck of the residence, for use as a dining room, den, and bathroom. This work includes: ¦ Construction of a mezzanine area within the above enclosure; and ¦ Modification to the roof to accommodate the new enclosed area. Activity No. 2: Modification of front entry/relocation of front door and expansion of decking, using existing supports. The enclosed Dwg. No. 2 (Exhibit D) depicts the scope of the above work. As the drawing shows, no change to the current footprint of the existing residence will result from either activity. No new bearing points are proposed. No soil will be disturbed, and no environmental impacts of any kind will result. The work will have no effect on coastal erosion. Required Board of Trustee Permits The Site Plan (Exhibit C) indicates the distances of the proposed work from the salt marsh wetland area in the front of our house. As shown on the plan, enclosure of the alcove in the rear of the house (Activity 1) will not take place within 100 feet of a tidal wetlands - both the salt marsh in the front of the house and the high water mark of the Long Island Sound in the rear are more than 100 feet away. For this reason, we are annlying only for a Coastal Erosion Permit for Activity No. 1. However, the work proposed for the front of the house (Activity 2) appears to be within 100 feet of the edge of the tidal salt marsh in the front of the house. We are therefore applying for both a Coastal Erosion and a Wetland Permit for Activity No. 2. We believe that the environmentally-benign nature of the work, in which all the proposed work falls within the existing house footprint and foundations, and for which the surrounding land will remain untouched, with no effect on coastal erosion or the environment, qualifies us to request an Administrative Permit for each activity, and that public hearings will thus not be necessary. In addition, since the proposed work is restricted to the existing structure and will not impact the land itself, we trust that the enclosed Site Plan, which I have signed and sealed as a New York State-licensed Professional Engineer, will be acceptable to the Board, in lieu of an updated survey, which would be very costly and which we believe would not provide the Board with any additional information relevant to our application. We are providing the original survey (Exhibit E) that was prepared by Mr. Colin Van Tuyl, L.S. prior to our ownership, for reference purposes. Site topography is depicted on this survey. Some pictures of the existing property and residence are included as Exhibit F. Other Permits and Project Schedule It should be noted that, while the premises is located within an Adjacent Area to tidal wetlands in both the front and rear of the house, no permits are needed from the New York State Department of Environmental Conservation (NYSDEC), since the work represents solely "...modification or expansion of existing functional residential structures which are and will continue to be located 75 feet or more from the most Southold Board of Trustees October 5, 2005 Page 3 of 3 landward edge of any tidal wetland " According to 6 NYCRR Part 661 (Tidal Wetlands Use Regulations), the NYSDEC regards such work as "NPN," or "uses not requiring a permit." According to NYSDEC representatives, no application or waiver from that agency is required for the proposed work. We will apply for a Town of Southold Building Department Permit following approval of the wetlands and coastal hazard permits from the Board of Trustees. No permits from the Suffolk County Health Department are needed. The work will be scheduled as soon as possible upon receipt of the Southold Building Department permit. We hope that we can commence work in late November/early December, 2005, and we anticipate that the work will take about five to six weeks to complete. Permit Applications and Fees Please process our application for the two permits described above. All of the required forms are enclosed, along with two checks, each in the amount of $250 (total of $500), as the required application fees. The aforementioned Exhibits A through F are also enclosed.
