Box 1330 Riverhead, NY 11901 Re: File Review#5146 (North Fork Storage/Tide Group, Inc 96-1-1) Dear Mr. Tohill: In reply to your recent correspondence, this will confirm that in reviewing the above submission, the maps that are part of the application include both a proposed subdivision map of 29 1 acres dated January 20, 1994, amended March 14, 1996, and a December 2001 preliminary site map prepared by Kenneth H. Beckman, L.S. for an area of 133,000 sq. ft. (proposed Lot No. 4), instead of a site map for the entire existing 29.1-acre lot. Based on the fact that the PB has not recognized proposed "Lot #4" or "Commerce Drive" under a subdivision or site plan approval, the parcel which does exist at this time of 29.1+- acres needs to be shown on either a preliminary site plan or a clean survey map. Please also show a proposed egress and ingress from the Town Street to the proposed facilities, which will also be considered for safe and sufficient access by fire and emergency vehicles under Town Law, Section 280-A. The present map does not show egress and ingress from the Town Street. Once the map prints are received, the Board will continue with reviews, inspections, and calendar the application for a public hearing. I will be out of the office for a few weeks in order to attend to some health problems . I have asked my client to send seven (7) copies of the map for the entire subdivision. The notion that Lot 4 is "a non-existent lot" which is first expressed in paragraph 1 of the July 22, 2002 Scott Hughes memo to the Chairman of the Zoning Board of Appeals is as far as I know a misleading statement and the misleading nature of that statement is what is now causing the confusion that I see at hand. A property owner or contract vendee has a right to apply to the Zoning Board of Appeals for the relief requested by Martin Kosmynka whether or not the Planning Board has issued final approval for a subdivision map. When Mr. Hughes said that Lot 4 was "a non-existent lot" on July 22, 2002, I think he meant to say that the subdivision hasn't received final subdivision approval from the Planning Board. Whether or not final subdivision approval has been granted, however, is not a bar to a Zoning Board of Appeals acting on this application. The Notice will be published in the next issue of the Suffolk Times. Pursuant to Chapter 58 of the Southold Town Code (copy enclosed), formal notice of your application and hearing must be now mailed with a map or sketch showing the construction area or variance being considered. Send the enclosed Notice CERTIFIED MAIL, RETURN RECEIPT REQUESTED, with the above sketch or survey showing the new construction area, or details of your request, by Saturday, July 13th to all owners of land (vacant or improved) surrounding yours, including land across any street or right-of-way that borders your property. Use the current addresses shown on the assessment rolls maintained by the Town Assessors' Office (765-1937) or the County Real Property Office in Riverhead., If you know of another address for a neighbor, you may want to send the notice to that address as well. When picking up the sign, a $15 check will be requested for each poster (or metal stand if needed) as a deposit. Please post the Town's official poster/sign no later than Thursday, July 18th.
