Recital
WIIEREAS, the Town of Southold (herein called "Town"),
in the County of Suffolk, New York, has heretofore duly authorized, sold
and issued its $23,000 Bond Anticipation Note For Land Acquisition-1967,
and it is now desirable to redeelr, said Note to the extent of $7,000 from
a source other than the proceeds of the bonds in anticipation of which
said Note has been is~'~ued;
now, therefore, be it
RESOLVED BY THE TOWN BOARD OF THE TOWN OF
SOUTHOLD, IN TIIE COUNTY OF SUFFOLK, NEW YORK, AS FOLLOWS:
Section 1. The $23,000 Bond .\nticipationNote For
Land Acquisition-1967 of the Town, hcreinabove referred to in the Recital
of this resolution, is hereby authorized to be redeen~ed on or before
March 1, 1968, to the extent of $7,000 from funds of the Town now avail-
able to said purpose, said funds being a source other than the proceeds of
the bonds in anticipation of which said Note was issued, and the said
amount of $7,000 is hereby appropriated therefor.
Section 2. This resolution shall take effect immediately.

Acquisition-1967 of the Town dated March 1, 1967, r~aturing March 1,
1968, subject to prior redemption, numbered 2R--1, heretofore duly
authorized, sold and issued pursuant to the bond anticipation note resolution
duly adopt edbythe Town Board of said Town on March 7, 1967, is
hereby at~thorized to be renewed, in part, by the issuance of a new Note
in the principal amount of $16,000, said Note dated March 1, '1967, having
been heretofore duly authorized to be redeen-.ed from a source other than
the proceeds of the bonds in anticipation of Which said Note has been
issued, to the extent of $7,000, all as hereinabove referred to in the Recital
hereof, pursuant to the provisions of the Local Finance Law, constituting
Chapter 33-a of the Consolidated Laws of thc State of New York (herein
called "Law"'). The maturity of said renewal Note herein authorized
shall not be later th'an one year from its date, and said Note tray be further

NATIONAL BANK OF LONG ISLAND, Southold Office, Sou]hold, New
York, at thc pr]cc of $]6,000, to ])ear interest at the rate of three
and one-quarter per centum (3-.1/4%) per annum, payable at maturity,
and the Supervisor is hereby authorized to deliver said Note to said
purchaser upon receipt of the purchase price, plus accrued interest,
if any, from the date of said 1Note to the date of delivery.
Section 4. Said Note shall contain the recital of validity
prescribed by ~52.00 o] the Law and shall be a general obligation of the
Town, payable as to both principal and interest by a general tax upon all
the taxable real property within the Town, without limitation of rate or
amount. The faith and credit of the Town are hereby irrevocably pledged
to the punctual payment of the principal of and interest on said Note and
provision shall be made in the budget of the Town by appropriation for
the redemption of the Note to mature in such year and for the payment
of interest to be due in such year.
Section 5. Said Note shall be executed in the name of the
Town by its Supervisor and the corporate seal of said Town shall be
affixed thereto and attested by its Town Clerk,

said Note dated March 1, 1965, having been heretofore duly authorized
to be redeemed from a source other than the proceeds of the bonds in
anticipation of which said Note has been issued, to the extent of
$10,197.44, all as hereinabove referred to in the Recital hereof,

WHEREAS, by resolution adopted by this Board on December 8,
1964, this Board authorized the issuance of serial bonds in the amount of
$44,000.00 for the acquisition of a bathing beach at New Suffolk in said
Town, and further authorized bond anticipation notes robe issued in
anticipation of said bond, and
WHEREAS, pursuant to said resolution, a bond anticipation note in
the amount of $43,000.00, dated March 1, 1965, was sold to The North
Fork Bank and Trust Company, which said note matured one year from the
date thereof, and
WHEREAS, this Board now desires to appropriate the sum of
$10,000.00 to be applied against the principal balance due on said note and
to renew said note for the sum of $33,000.00, bearing interest at the rate
of 2.55%,
NOW, THEREFORE, BE IT RESOLVED, that there is hereby
appropriated the sum of $10,000.00 for the purpose of paying the principal
due on said note to the extent of $10,000.00, and it is further
RESOLVED, that the Supervisor be and he hereby is authorized to
re new said bond anticipation note for a further per~od of one year in the
principal amount of $33,000.00, to bear interest at the rate of 2. 55%,
payable at maturity, and that said note be sold to The North Fork Bank and
Trust Company, Mattituck, New York, and it is further

Recital
WHEREAS, the Town of Southold (herein called "Town"), in
the County of Suffolk, New York, has hereofore duly authorized, sold
and issued its $8,500 Bond Anticipation Note For Purchase of a
payloader-1968, and it is now desirable to redeem said Note to the
extent of $4, 250 from a source other than the proceeds of the bonds
in anticipation of which said Note has been issued;
now, therefore, be it
RESOLVED BY THE TOWN BOARD OF THE TOWN OF SOUTHOLD,
IN THE COUNTY OF SUFFOLK, NEW YORK, AS FOLLOWS:
Section 1. The amount of $4, 250 is hereby appropriated from
funds now available to said purpose to redeem, in part, on or before
August 8, 1969, the outstanding $8,500 Bond Anticipation Note For Purchase
of a Payloader-1968 of the Town hereinabove referred to in the Recital of
this resolution,- said funds bcing a source other than the proceeds of
the bonds in anticipation of which said Note has been issued.
Section 2. This resolution shall take effect immediately.

Recital
WHEREAS, the Town of Southold (herein called "Town"), in
the County of Suffolk, New York, has duly authorized, sold and issued
its $8,500 Bond Anticipation Note For Purchase of a Payloader-1968 and
has duly appropriated $4, 250 for the redemption, in part, of said Note
and it is now necessary and desirable to provide for the renewal, in
part, of said Note by the issuance or a new Note in the principal
amount of $4, 250;
now, therefore, be it

Section 1. The $8,500 Bond Anticipation Note For Purchase of a
Payloader-1968 of the Village, dated August 9, 1968, maturing August 8,
1969, subject to prior redemption, numbered 3R-l, heretofore duly
authorized, sold and issued pursuant to the bond anticipation note resolution
duly adopted by the Town Board on August 13 ', 1968, is hereby authorized
to be renewed, in part, by the issuance of a new Note in the principal
amount of $4, 250; the amount of $4, 250 having been heretofore duly appro-
priated from a source other than the proceeds of the bonds in anticipation
of which said Note has been issued, to redeem, in part, said Note dated
August 9, 1968, all as hereinabove referred to in the Recital hereof,
pursuant to the provisions of the Local Finance Law, constituting
Chapter 33-a of the Consolidated Laws of the State of New York (herein
called "Law"). The maturity of said renewal Note herein authorized
shall not be later than one year from its date and said Note may be
further renewed pursuant to the provisions of the Law.

]3ANK OF LONG ISLAND, Southold Office, Southold, New York, at the
purchase price of $4, 250, to bear interest at the rate of three and ninety
hundredths per centum (3.90%) per annum, payable at maturity, and the
Supervisor is hereby authorized to deliver said Note to said purchaser upon
receipt of the purchase price, plus accrued interest, ifany, from the date
of said Note to the date of delivery.
Section 4. Said Note shall contain the recital of validity pre-
scribed by §52.00 of the Law and shall be a general obligation of the Town,
payable as to both principal and interest by a general tax upon all the
taxable real property within the Town, without limitation of rate or
amount. The faith and credit cf the Town are hereby irrevocably pledged
to the punctual payment of the principal of and interest on said Note and
provision shall be made in the budget of the Town by appropriation for
the redemptio~ of the Note to mature in such year and for the paymcnt
of interest to be due in such year.
Section 5. Said Note shall be executed in the name of the Town
by its Superxdsor and the corporate seal of the Town shall be affixed
thereto and attested by its Town Clerk.

RESOLVED BY THE TOWN BOARD OF THE TOWN OF
SOUTHOLD, IN THE COUNTY OF SUFFOLK, NEW YORK, AS FOLLOWS:
Section 1. Bond Anticipation Notes of the Town of Southold,
in the County of Suffolk, New York, in the principal amount of $63,000 are
hereby authorized to be issued at one time or from time to time, as funds
are required, pursuant to the provisions of the Local Finance Law, constitu-
ting Chapter 33-a of the Consolidated Laws of the State of New York, for
the specific object or purpose as more fully described in the resolution
entitled:
"Bond Resolution of the Town of Southold, New York, adopted
May 10, 1965, authorizing the acquisition of certain land at Cutchogue, in
said Town, as the site for a refuse disposal area to be designed as the site
of a sanitary land fill installation, stating the estimated maximum cost
thereof is $63,000, appropriating said amount therefor and authorizing the
issuance of $63,000 serial bonds of said Town to finance said appropriation,"
duly adopted by the Town Board of said Town on the date therein referred
to° Said Notes are to be issued in anticipation of the sale of serial bonds
of said Town. No bond anticipation notes have been previously issued or
are presently outstanding in anticipation of the sale of said bonds and the
Notes herein authorized are not renewal Notes. The period of maturity of
the Notes herein authorized shall not exceed one year from the date of said
Notes and said Notes may be renewed pursuant to the provisions of said
Local FL~ance Law. Said Notes herein authorized are not to be issued for
an assessable improvement,
Section 2. Subject to the provisions of this resolution and of
the Local Finance Law, and pursuant to 550.00 and $§5G. 00 to 60.00 of said
Law, the power to prescriJ)e the tern~s, [orn~ ,and contents and as to the
sale and issuance of the bond anticipation notes authorized by this resolution
al~e hereby delegated to the Supervisor, the chief fiscal officer of the Town.
Section 3, Said Notes shall be executed in the name of the
Town by its Supervisor and the corporate seal of said Town shall be affixed

The estimated maximun~ cost of said specific object or purpose, including
preliminary costs of surveys, maps, plans, es[i~'nates and hearings and
costs incidental thereto and the financing tl~ereof, is $ 17 ~ 500 and
the sai~ amount is hereby appropriated therefor. The plan of
financing includes the issuance of $ 17 , 500 serial bonds to finance
said appropriation~ and the levy and collection of taxes on all the taxable
real property in the Town to pay ~be principal of said bonds and the
interest thereon as the same shall become due and payable.
Section 2. Serial bonds in the principal amoun~ of $ 17 ,500
to finance said appropriation are hereby authorized to be issued pursuant
to the provisions of the Local Finance Law, constituting Chapter 33-a of
the Consolidated Laws of the State of New York (herein called "La~v").
Section 3. The following additional matters are hereby deter-
mined and declared:
(a) The period of probable usefnlness of acquiring said land,
being the specific object or purpose for which said $ 17, g:O0 serial
bonds authorized pursuant to this resolution are to be issued~ within the
limitations of Section 11.00 a. 21 of the Law, is thirty (30) years, but
the maturity of said bonds shall not exceed fi£teen (1~) years.
(b) Current funds are not required to be provided prior to
the issuance o£ the serial bonds authorized by this resolution, or any
bond anticipation notes in anticipation of the sale of such bonds., pur'suant
to the provisions of Section 107.00 d. 4. of the Law.
(c) The matt~ri[y of the bonds authorized pursuant to this
resolution will excee¢] five (5) years.
Section 4. Each of the bonds authorized pursuant to this
resolution and any bond anticipation notes issued in anticipation of said
bonds, shall contain thc recital of validity prescribed by §52. 00 of the
Law and said bcr~ ds and any notes issued in anticipation of said bonds,
shall be general obligations of the Town, payable as to both principal
and interest by a general ilk upon all the taxable real property within the
Town without limitation of rate or amount. The faith and credit of the
Town are hereby irrevocably pledged to the punctual payment of the principal
of and interest on said bonds and provision shall be made annually in the
budget of the Town by appropriation for (a) the amortization and redemption
of the bonds to mature in such year and (b) the payment of interest to be
due and payable in such year.
Section 5. Subject to the provisions of this resolution and of the
Law, and pursuant to the provisions of ~30.00 relative to the authorizat ion
of the 'issuance of bond anticipation notes and of ~50.00 and §~56.00 to 60.00
of the Law, the powers and duties of the Town ]Board relative to prescribing
the terms, for'm and contents and as to the sale and issuance of said
bonds and any notes issued in anticipation of said bonds, or the renewals
thereof, are hereby delegated to the Supervisor, the chief fiscal officer of
the Town.
Section 6.. The validity of the bonds authorized by this resolution
and of any notes issued in anticipation of said bonds, may be contested only
if:
such obligations are authorized for an object
or purpose for which the T~)wn is not authorized
to expend money, or
(b)
the provisions of law which 'should be complied
with at the date of publication of such resolution,
are not substantially complied with,
and an action, suit or proceeding contesting snch validity, is commenced
within twenty days after the date of such ImhJicalion, or
Section 7. The bond resolution of the Town, duly adopted
December 26, 1967, entitled:
"Bond Rcsolution of the Town of Southold, New York, adopted
December 26, 1967, authorizing (1) (A) acquisition of certain land
situate on the northerly side of Main Road, at Feconic, in said Town,
as the site of a po]ice headquarters building, at an estimated maximum
cost of $6,000 (IF,) appropriation of said amount therefor, and (C)
issuance of $6,000 serial bonds to finance said appropriation, (2) (A)
acquisition of the existing building on said site for use as such police
headquarters, at an estimated maximum cost of$18,000, (B)
appropriating said amount therefor, and (C) issuance of $18,000 serial
bonds to finance said appropriation, and, (3) (A) reconstruction, in
part~ of said building, at an estimated maximum cost of $6,000,
appropriation of said amount therefor, includinf $300 current funds to
provide the down payment and (C) issuance of $5,700 serial bonds to
finance the balance of said appropriation, and stating the estimated total
cost of acquiring said land and building and reconstructing said building
is $30,000,"
is hereby repealed, rescinded and revoked.
Section 8. This resolution shall take effect thirty (30) days
after its adoption, unless within thirty (30) days after its adoption there
shall be filed with the Town Clerk~ in accordance with Article 7 of the
Town Law, a petition signed and acknowledged by electors of the Town of
the number required by law, qualified to vote upon a proposition to raise
and expend money, protesting against this resolution and requesting that
it be submitted to the electors of the Town for their approval or disapproval,
in which case this resolution shall take effect when approved by the affirms-
rive vote of a majority of the qnalified electors of the Town, voting upon a
proposition for its approval at a referendnm held in accordance with the
Town Law.

Dear Sirs:
We have examined a record of proceedings relating
to the issuance of a $3,500 Bond Anticipation Note For Land
Acquisition-1972 of the Town of Southold, in the County of Suffolk,
a municipal corporation of the State of New York. Said Bond
Anticipation Note is dated June 30, 1972, matures June 29, 1973,
subject to prior redemption, bears interest at the rate of two
and seventy-eight hundredths per centum (2.78%) per annum,
payable at maturity, is numbered I, is of the denomination of
$3,500, is payable to bearer without coupons and registerable
as to both principal and interest, and is issued pursuant to the
provisions of the Local Finance Law, constituting Chapter
of the Consolidated Laws of the State of New York, the bond
resolution duly adopted by the Town Board on March 12, 1958
authorizing acquisision of certain land on the northerly side of
M~n Bond, in Peconic, in said Town, at an estimated maximum
cost of $17, 500, appropriating said amount therefor and authorizing
$17, 500 serial bonds to finance said appropriation and the Certificate
of Determination executed by the Supervisor on June 30, 1972.
Said Bond Anticipation Note is a temporary obligation,
issued in anticipation of the issuance of permanent serial bonds.
In our opinion, said Bond Anticipation Note is a valid
and legally binding general obligation of said Town of Southold,
all the taxable real property within which is subject to the levy
of ad valorem taxes to pay said Note and interest thereon, without
{imitation as to rate or amount.
The form of said Note is prescribed by t he Certificate
of Determination executed by the Supervisor on June 30, 1972,
but we have not examined the executed Note.
