HomeMy WebLinkAboutBurns, Margery D-Dickinson BldgLEASE AGREEMENT THIS AGREEMENT, made this /~'~day of ,~/¢r,,~, 2005, between MARGERY D. BURNS, with an address at P.O. Box 566, Southold, New York 11971, hereinafter designated as "Landlord" and the TOWN OF SOUTHOLD, a municipal corporation with offices at 53095 Main Road, P.O. Box 1179, Southold, New York 11971-0959, hereinafter designated as the "Tenant". WITNESSETH: WHEREAS, Landlord has agreed to LET, and hereby does LET, to the Tenant and the Tenant has agreed to TAKE, and hereby does TAKE from Landlord the t;ollowing premises: ALL that certain piece, plot or pamel of land situate, lying and being at Southold, Town of Southold, Suffolk County, New Yo. rk, bounded and described as follows: BEGINNING at a point on the division line between land of Burns and land of the Town which point is 45 feet southerly along said division line from the southerly line of Main Road; running thence along said division line South 29 degrees 23 minutes 30 seconds East, 55 feet to the southeasterly corner of land of Burns; running thence South 60 degrees 00 minutes West, 15.00 feet to a right of way; running thence in a northerly direction along said right of way North 29 degrees 23 minutes 20 seconds West, 55 feet; running thence in a northeasterly direction a distance of 15 feet, more or less, to the point or place of beginning. Being and intended to be the southerly 55 feet of the premises of Burns. WHEREAS, the privileges and appurtenances for and during the term of one (1) year from the 23rd day of August, 2005, hich term will run continuously. It is understood and agreed that the leased premises shall be used by the Tenant for public parking purposes. WHEREAS, the Tenant covenants that it will pay to Landlord for the use of said premises, the annual rent of One and 00/100 Dollar ($1.00), to be paid upon the execution of this Agreement. WHEREAS, the Tenant covenants and agrees that it will include the demised premises under its blanket liability insurance policy. WHEREAS, the term of this Lease shall be automatically extended for successive one year terms, upon the same terms and conditions as herein provided, unless either party hereto gives written notice to the other party no less than sixty (60) days prior to the expiration of the then existing term that the term of this Lease shall not be so extended. WHEREAS, Landlord agrees to pay all taxes to be assessed on said premises during said term. WHEREAS, the Lease is binding upon all parties who lawfully succeed to the rights or take the place of the Landlord or Tenant. WHEREAS, the Tenant covenants that at the termination of said term it will surrender up said premises to Landlord in as good condition as now, necessary wear and damage by the elements excepted.
