Please rise and join with me in the Pledge of Allegiance to the Flag. Again, welcome and thank you for joining us. Over the course of the evening or the afternoon, which may become the evening, we afford the opportunity for the public to address the Town Board over the course of several portions of the meeting, the first time the public is invited to address the Board is prior to voting on the resolutions that are on our agenda this evening. After that, I don’t believe we have any public hearings tonight, so the next time the public will be invited to address the Board is after the conclusion of voting on the resolutions to address the Town Board on other town related items. We do have reports, public notices and various communications available for the public’s review at the Town Clerk’s office, which is open Monday to Friday, 8:00 AM to 4:00 PM. With those items concluded, we do ask also remind people that in addressing the Board, we use one of the two podiums located in the front of the room and that you state your name and place of residence so we can incorporate that into our record. Moving forward with an approval, please. SUPERVISOR HORTON: If I may just explain what the Special Town Board meeting is being set for. The Town Board is moving forward with the serious consideration of a narrowly focused moratorium designed to give the Town Board and the Planning Department the time it needs to address the protection of the downtown business districts in the Town. For example, there is a pending application before the Planning Board by a CVS, the Town Board is moving forward to address that type of situation and we have coordinated with the Planning Department, the Planning Board on this direction. So Monday’s meeting will be to review the suggested content of that moratorium, as well as possibly set a public hearing for it. And we can move with the next Town Board meeting setting. SUPERVISOR HORTON: We now open the floor to the public to address the Board on resolutions on this evening’s agenda. Mrs. Egan. JOAN EGAN: Good evening, my friends. Mr. Horton, Mr. Romanelli, Mr. Edwards, Mr. Ross, Mrs. Evans, Mr. Wickham, Mrs. Neville and the lady who doesn’t answer the phone. That is Page 2 September 13, 2005 Town of Southold Board Meeting Mrs. Finnegan. Shame, shame on a lot of you up there. Shame, shame. Before I address anything, it is extremely important, I spoke to this gentleman who takes the tapes up to the Cablevision and the one that was missing in July that they said they did not receive, guess what? They gave it back to him. He has the tape of the July meeting. The tape of the meeting two weeks ago when you weren’t there, Mrs. Evans wasn’t there, Mrs. Neville wasn’t there and Mrs. Finnegan wasn’t there, has yet to be found. They will probably give it back to him the next time he goes up there. So I don’t know. Maybe you didn’t want it shown, who knows? But they had it and they did not show it. Now, this has got to be corrected. This is ridiculous. If he can’t take it up, I will take it up with a witness. He should have a witness. They claim they have a camera there where he puts it in the box. Mr. Cummins, Bob Cummins, I believe is his name, said that he didn’t have time to review the tape. So let’s get with it. You are absolutely wrong and as I said to you this morning, Mr. Horton, when I interrupted your meeting and was chased out by Joanne or whatever her name is, the problem was that the air-conditioning is blasting away and all the doors are open and it was either you, Mr. Edwards or you Mr. Ross, two or four weeks ago, said that you would see that when I came into Town Hall in the morning that the doors out there weren’t covered with water from the condensation and wasting, wasting electricity. This is a god awful shame on you Mr. Edwards and you, Mr. Ross. Now, on your front page here you have the Justice reports… SUPERVISOR HORTON: Mrs. Egan, this is the opportunity to address the resolutions that…. MS. EGAN: ….and you only address the money situation. Well, come to court on a, if you come up here once in a while, Mr. Horton…. SUPERVISOR HORTON: Mrs. Egan, I am here every Friday. MS. EGAN: ….on Friday mornings. Shame, shame. Now, there are a number of items regarding the Police Department budget. Now to the best of my knowledge, Mr. Horton and I hope I am wrong, your little grandstanding out there, which you were told was wrong by this lovely lady who had worked for the Suffolk Police, I don’t think you are going to get any money from Homeland Security to pay all the policemen, Lieutenants and Sergeants and whatever… SUPERVISOR HORTON: Mrs. Egan, are there specific resolutions that you are here to address? MS. EGAN: Yeah. 533, 34, all of these Police Department. Employment and budget modification. Where is the money going to come from? SUPERVISOR HORTON: Within the Police Department budget. MS. EGAN: Uh, to the best of my knowledge the budget has been shot. The Chief decided, which I brought up several weeks ago, to take what funds they had to replace the motor for the Bay Constable when they ruined that motor, a year ago last March. And someone up there was going to look into it. But I doubt they did. Page 3 September 13, 2005 Town of Southold Board Meeting SUPERVISOR HORTON: We received a grant for a new boat and a new motor from the federal government. MS. EGAN: Oh, yeah because they ruined that boat’s motor. You will remember that, Mr. Horton unless your Alzheimer’s is kicking in early. Now, now, this 2005, I have the one from, I am looking for the….the Building Department people. They are going on a seminar? Oh and incidentally, I did check…. SUPERVISOR HORTON: This is 535 you are referring to? MS. EGAN: 535? I did check in your building, your annex over there, that the certificate of approval by an elevator company for the, that it had been approved. And last week it wasn’t there. Mr. Verity said he would check it. So, shame, shame on all of you. Now, we have another resignation. Oh, that is student intern. I think most of the student’s this time were pretty good. Now, we have any number of Human Resource centers. We have 537 and I think several others for the Human Resource center, which incidentally I went up to see. And it is quite nice. There is very little security there. And there is much too much mismanagement, as I keep telling you. Too many change of personnel. Any time any building…. SUPERVISOR HORTON: Mrs. Egan, there are no change of personnel on the agenda tonight. MS. EGAN: Oh, well, no but there are changes. Always changes there. Now, the, you have the budget modification, 537, more money there. I don’t think it is being spent properly. Now you have 538, the Accounting Department. I certainly hope somebody, the head of the Accounting Department did speak to Ms. Rudder, she was to go away and I brought up at that meeting that her rudeness to other people, including myself, but I hope she didn’t do that when she went out of town. So let’s get that going. Now, you need an employment, somebody on 540. You need a part-time senior citizen aide for the Human Resource center. Why? Is that a paid position? SUPERVISOR HORTON: I am looking for your resolution. JUSTICE EVANS: 540. SUPERVISOR HORTON: Ah, yes. 540, will be advertising for a part-time senior citizen aide for the Human Resource center. It is a position… MS. EGAN: Is that a new position? SUPERVISOR HORTON: …of 17 ½ hours per week. It is not a new position, what we are doing is having a part-time position actually replace a full-time position, at the request of the Director. MS. EGAN: You need, it is a new position or it was full-time and now it will be a part-time position. Is that what you are saying? SUPERVISOR HORTON: There are a couple of different part-time positions that have been Page 4 September 13, 2005 Town of Southold Board Meeting created out of the full-time position, yes. MS. EGAN: Well, it is not being managed right. Now, it says Accounting, 541, part-time food service worker. That is the Human Resource center, isn’t it? SUPERVISOR HORTON: Yes, where it says department that is the department that submitted the resolution. MS. EGAN: You know, people who are in charge of departments very often, like a great deal of personnel…. SUPERVISOR HORTON: What about this resolution? MS. EGAN: …because it makes their job look bigger. Yeah, 543, you have again the Police Department budget and I don’t think you have that kind of money. We need more policemen but they make too much money and too much overtime. I think it was great that we had the, what do you call them, the auxiliary police, during the, from Memorial Day till Labor Day. That was good. You really need a lot more. SUPERVISOR HORTON: Okay. Are there other resolutions? MS. EGAN: Yeah. Don’t rush me. Just because you are here for a change doesn’t mean you have to get out as fast as you want. SUPERVISOR HORTON: I am just expressing interest, Mrs. Egan. MS. EGAN: Fishers Island I don’t know enough about. SUPERVISOR HORTON: We can get you over there. MS. EGAN: Huh? SUPERVISOR HORTON: I said we can get you over there. MS. EGAN: Well, we can get you over there. Maybe you should move over there. Maybe you will do better there than here. Don’t try to up up me, dear, you never get away with it. SUPERVISOR HORTON: Don’t I know. MS. EGAN: Oh, the dump. What do we need more money… SUPERVISOR HORTON: What resolution? MS. EGAN: Why are we, that is number 548. SUPERVISOR HORTON: Let me catch up with you here. Page 5 September 13, 2005 Town of Southold Board Meeting COUNCILMAN ROMANELLI: It is not more money, it is just moving money in the budget. SUPERVISOR HORTON: 548. COUNCILMAN ROMANELLI: It is just a budget mod. MS. EGAN: They don’t have enough money? SUPERVISOR HORTON: They do. These are monies that are within the budget. MS. EGAN: Well, from Peter to Paul. COUNCILMAN ROMANELLI: Moving from one line to another. MS. EGAN: Now the office, 549, that is again the Human Resource Center, isn’t it? We just have it under different captions. SUPERVISOR HORTON: That is correct. That is executing an agreement with the County. MS. EGAN: Hmmm? SUPERVISOR HORTON: That is executing an agreement with the County. MS. EGAN: And that is 550, right? SUPERVISOR HORTON: Yes. COUNCILMAN ROMANELLI: Yup. MS. EGAN: And 551? SUPERVISOR HORTON: Correct. COUNCILMAN ROMANELLI: Yup. SUPERVISOR HORTON: There will be a number of these. TOWN ATTORNEY FINNEGAN: They are all grants. MS. EGAN: I would keep a good, stiff look at that Human Resource Center. SUPERVISOR HORTON: Those three resolutions… MS. EGAN: Now, 552… Page 6 September 13, 2005 Town of Southold Board Meeting SUPERVISOR HORTON: …we were recipients of grants, grant monies for that program. MS. EGAN: Good. 552? Mrs. Finnegan, huh? SUPERVISOR HORTON: This is…. MS. EGAN: Kieran Corcoran. They are going up there? SUPERVISOR HORTON: The attorneys, town attorneys are required to complete continuing education classes and this is part of that. This is a class they are required to take. MS. EGAN: One wonders whether they finished their first one. SUPERVISOR HORTON: Are there others? MS. EGAN: Cleary Consultant, that is…what is that all about, 554? SUPERVISOR HORTON: 554? Cleary Consulting conducting a review pursuant to SEQRA, a proposed local law entitled “A Local Law related to amendments to uses within the hamlet density residential district”. There is proposed, there are proposed changes to this zoning district and as part of the legislative process the State Environmental Quality Review Act is required. MS. EGAN: Now, 555… SUPERVISOR HORTON: Yes. This is another grant that we are receiving, I believe this is, this grant is for the Marine Unit of the Police Department, the Bay Constables, a vessel that is being purchased with Homeland Security grant money. MS. EGAN: And they are going to come up with $50,000 plus? SUPERVISOR HORTON: Yes. MS. EGAN: That would be nice. And storm-water management, that is for run-off water? That is 556? SUPERVISOR HORTON: Yes. MS. EGAN: Good. I think it would be great, 557, if CAST did get that computer equipment… SUPERVISOR HORTON: Agreed. MS. EGAN: I wish them well. Is anybody here from CAST? I wish them good luck and god bless in their new facility. Now what is 559? SUPERVISOR HORTON: This is in relation to the transfer station project, the re-fit or renovation, reconstruction of the transfer station requires the oversight of an engineering firm. Page 7 September 13, 2005 Town of Southold Board Meeting This is formalizing that agreement. MS. EGAN: You mean the dump? SUPERVISOR HORTON: The dump. MS. EGAN: They need an engineering services for that? SUPERVISOR HORTON: To oversee… MS. EGAN: To oversee it. SUPERVISOR HORTON: To oversee the project. Yes. MS. EGAN: Another phony expense. Please. SUPERVISOR HORTON: Are there other ones, Mrs. Egan? MS. EGAN: 560. Refund, solid waste management. What do we have to give them money for? SUPERVISOR HORTON: This is fairly straight forward. There was a charge that should not have been charged to this account. MS. EGAN: Well, my goodness. I hope you give them interest on the money, like you should have given interest money to the union people. Now, how is this going to change the parking, 561? Where the police brought in on that? SUPERVISOR HORTON: Yes, this is setting a public hearing, so at that point, specific points and concerns about that can be raised. But yes, all these receive the recommendation of the Chief of Police. MS. EGAN: I will bring it up now but I am sure other people will address it better than I do, 562. The Cross Sound ferry. SUPERVISOR HORTON: I am looking for 562. Yes, this, there are a couple of items at play here. In fact, I will let Councilman Wickham articulate it because he is much more articulate on this process than I am. COUNCILMAN WICKHAM: At the last Town Board meeting we arranged for Frank Isler to be our attorney. In this particular resolution, we are directing him in the particular action that the Board agreed that he should carry out for us. MS. EGAN: And what has he done so far? COUNCILMAN WICKHAM: He has prepared this action, he has prepared the paperwork and Page 8 September 13, 2005 Town of Southold Board Meeting today we gave him direction about that. MS. EGAN: And so we have been paying him for two weeks and nothing has been done. He needed your authority today to get it going… SUPERVISOR HORTON: Mrs. Egan, this is a town… COUNCILMAN WICKHAM: He needed our authority to file the case. Yes. And that is what he has. He will have it, after… MS. EGAN: Excuse me. When will they be served? COUNCILMAN WICKHAM: I don’t know the answer to that but I do believe… MS. EGAN: You can’t answer that? COUNCILMAN WICKHAM: I believe shortly. That is up to him. MS. EGAN: Yeah. Well, myself for a change, Mr. Horton and I agree. That you should re-zone that property for parking and let them do what they do over in Connecticut and charge them and when there is no parking place left, bye-bye. That is the only way you are going to resolve it and I don’t always agree with Mr. Gustaveson from Suffolk Times, even though he uses my phraseology and not my letters, that is fine, that is his problem, it is not plagiarism but it is pretty close to it, I take it as a compliment; that you give a surcharge and that would be good. And get them, you are never going to stop that ferry… SUPERVISOR HORTON: Thank you, Mrs. Egan. MS. EGAN: ….Connecticut is making all the money and we are not. Well, 563 is all part of Mr. Isler, I guess. Now, Mark Terry, 564, that is a new one. What is this Planning Department now? SUPERVISOR HORTON: Mr. Terry, upon the adoption of this resolution would serve as the acting head, the interim head of the Planning Department. We are completing the interview process within the next two weeks. MS. EGAN: Well, I will be back, after you have chatted. SUPERVISOR HORTON: Thank you. Would anybody else care to address the Board on specific resolutions? The lovely Ms. Cathy Tole. CATHY TOLE: Cathy Tole from Greenport. Good evening. I have a question about 557, please. SUPERVISOR HORTON: Let me get to it. Page 9 September 13, 2005 Town of Southold Board Meeting MS. TOLE: And that has to do with the used computer equipment, donating the balance to CAST or something. Two things I would just like to say, number one, the staff and truck and services provided to CAST on their moving day was exceptional. The job couldn’t have been done without it. I am sure you have gotten a written thank-you but I would like the world to know that those employees were phenomenal. They were really wonderful. We were down there trying to help in any way that we could but boy, without those backs and trucks, never would have gotten done. So, please, tell each one of them they were phenomenal. SUPERVISOR HORTON: Will do. Thanks. MS. TOLE: Back to this specific thing on CAST, on used computer equipment; if it is good, decent equipment, rather than just auctioning it off, I would ask that you first CAST to pick and choose and kind of tag what they can and find a way to excess this material to them that they can use. SUPERVISOR HORTON: That is what, that is what this will allow. MS. TOLE: Oh, okay, it is not to accept bids for other people to buy this…. JUSTICE EVANS: I think it already went to bid and there were three bids but there was quite a bit of equipment left. MS. TOLE: Great. Thank you. SUPERVISOR HORTON: So they can pick and choose what will work for them. MS. TOLE: Terrific. On 555, on the buffer zone protection. Does any of that have to do with enforcement of buffer zones? SUPERVISOR HORTON: Hang on a second. Let me get to it. 555. MS. TOLE: The grant? SUPERVISOR HORTON: No, actually I don’t know why that is, I believe I am talking about the right, this is the correct… TOWN ATTORNEY FINNEGAN: I haven’t reviewed it yet. SUPERVISOR HORTON: …this is the Homeland Security. There are a couple of different grants that are outstanding here and this one, I believe, in fact I know, I don’t know why it is called a buffer zone protection program other than I think they are referring to maritime buffers. This is a Homeland Security grant that we have been awarded for the purchase of a new Bay Constable vessel. Page 10 September 13, 2005 Town of Southold Board Meeting MS. TOLE: Oh, good. 563, please. On the retain Cleary Consulting for the study on Cross Sound ferry. There was comment just made about shutting down the ferry. I just want to make sure that we are all on the same page, the desire of the Town and of the people who are not in support of the current functioning. It is not that we are out to shut down the ferry. SUPERVISOR HORTON: Right. MS. TOLE: Okay. We are at, do something else but it is certainly not to shut down the ferry service. SUPERVISOR HORTON: Your position and the position of many that have been here before the Town Board over recent months and also many people who were out at Orient Point on th September 5, Monday, the protest. The rally, the position, at least from this person’s point of view has always been very clear, which is rein it in, gain control, gain accountability but not shut down service. So, I, we, at least, I have never misinterpreted your position. I don’t think. MS. TOLE: Okay. Thank you. SUPERVISOR HORTON: Would anybody else care to address the Town Board on specific resolutions? Yes, Mr. Nickles. JOHN NICKLES, JR.: Good afternoon, John Nickles, Junior, Southold. I didn’t hear what your answer was on 556. As far as, excuse me, not 556. 554. Does it have something to do with the HALO zone? SUPERVISOR HORTON: No, this has to do with the hamlet, hamlet density zoning district. th There is a public hearing, I believe on September 27, to address a change requested by the Planning Board in that zoning district. It wouldn’t affect density in any way, it would affect the ability of the Planning Board to plan within that zoning district, so this is doing the SEQRA on th that requested change. So the public hearing will be on September 27 on that. MR. NICKLES, JR.: Does that have something to do with the cluster requirement or the attached dwellings or something like that. Is that what it is? SUPERVISOR HORTON: If I recall, yes. I think it would enable the Planning Board to view the HD as a site plan avocation, not just a subdivision application. MR. NICKLES, JR.: 256. The agreement with New York Department of State is what? It is in regard to how we get grant money from them? Or…. SUPERVISOR HORTON: Let me read the resolution before I answer…. MR. NICKLES, JR.: Are they giving us money? SUPERVISOR HORTON: Yes. We are receiving a grant for storm-water management planning Page 11 September 13, 2005 Town of Southold Board Meeting that is underway. MR. NICKLES, JR: That is what? An annual grant that the Town Board gets? SUPERVISOR HORTON: No, it is not an annual grant, it is a grant that we have applied for and received. MR. NICKLES, JR.: Is it for a specific project or… SUPERVISOR HORTON: Yeah, storm-water runoff management plan. MR. NICKLES, JR.: A specific location or just… SUPERVISOR HORTON: Town wide storm-water runoff. We have engaged the Trustees over the past year to do a non-point source identification throughout the Town. We worked with Cornell on developing, getting physical knowledge of, or a knowledge of all the physical points where road run-off enters the creeks and the estuaries, the Sound, related to Town roads that we can have some control over to mitigate. MR. NICKLES, JR.: That is good. And that is the purpose of it and how much is the grant? SUPERVISOR HORTON: It is a $50,000 grant, if I am not mistaken. And it was matched with in-kind services. MR. NICKLES, JR.: 562. SUPERVISOR HORTON: Yes, 562. MR. NICKLES, JR.: Are we, the question, I guess the question is…no question on 562. 563, the traffic study. This is a traffic study that Cleary Consulting is going to arrange… SUPERVISOR HORTON: One of the, there are a couple of different directions, actually one unified direction, a couple of different components to the Town Board addressing outstanding issues surrounding the lack of a site plan for Cross Sound ferry, the traffic issues surrounding ferry bound traffic, as well as the parking issues surrounding the ferry property. And the one direction, one platform that the Town is working from is litigation, which is dealing with the company in court. The second is a legislative initiative that the Town Board will work with Cleary Consulting on in developing legislation that will facilitate the regulation and oversight, better regulations, better oversight of the ferry terminal and traffic and parking related to the ferry. And to work with the Town Board in putting together a sustainable and effective legislative measure, the Town is going to engage Cleary Consulting to work with it on gaining traffic count information, comparing it to the data supplied to us by the DOT and then producing legislative measures that will address the issue. MR. NICKLES, JR.: Is the purpose to find out how many vehicles are heading to Orient to go Page 12 September 13, 2005 Town of Southold Board Meeting to Cross Sound ferry and to further find out how many vehicles are going to the car ferry portion and the Sea Jet portion…. SUPERVISOR HORTON: Those will be components of that, yes. MR. NICKLES, JR.: Is the purpose to do a complete traffic study that will tell us and account for every car that is on the road between a stretch from Greenport to Orient Point? SUPERVISOR HORTON: It is going to, actually, once we engage Mr. Cleary, the Board will work to better define you know, better define all those, the components to it. But yes, essentially yes, those will all be questions within that. MR. NICKLES, JR.: Is the Town Board considered or Planning to get help from the New York State DOT, since they own the road financially? SUPERVISOR HORTON: We can, I believe, my recommendation to the Board is under the guise of the Scenic Byways and LWRP, to seek funding from the State, which would come by way of reimbursement because of the time frame associated with commencing this action. So, yes, we will seek reimbursement through LWRP and Scenic By-Way grants for this. I will say that thus far, any help that we have requested from the State DOT specifically, LWRP and Scenic By-Ways is before the Department of State, any help that we requested through the DOT is fallen on deaf ears, so I wouldn’t expect money back from the DOT but I do believe we will qualify for LWRP and Scenic By-Ways funding for this specific measure. MR. NICKLES, JR.: And therefore you think the Department of State will be friendly to the Town of Southold? SUPERVISOR HORTON: Absolutely. Yeah, the Department of State is actually phenomenal to work with. They are big, the DOS actually is very supportive of Town planning initiatives and has been very helpful to us in the past and I believe that will continue. MR. NICKLES, JR.: Okay. Thank you. SUPERVISOR HORTON: Thank you, Mr. Nickles. Are there other questions from the floor? Yes, Ms. Norden. MELANIE NORDEN: Hi, Good evening. Melanie Norden, Greenport. 562 with respect to injunctive relief, does that have a dollar sign attached to it? DAVID CORWIN: My name is David Corwin, I live in Greenport. This is the third time I have come here to address you on the same subject, motorcycles with straight pipes. The tourist season is over but the motorcycle season is just beginning. If you go in the streets of Greenport, maybe 1 in 10 of the motorcycles you see there has a muffler. The rest have the straight pipes. They are parked on the streets, they are riding up and down the streets in packs, they are all over the place, they are riding singly. It is easy pickings if a police officer wanted to give out a ticket for straight pipes. I have explained to you before, straight pipes are illegal in the State of New York; there is no question about that. There was one check point that I know of this spring and then nothing else that I can see happened for these motorcycles. It is a blight on the community of Greenport, it is a blight on all Southold Town, every time I mention it people get annoyed by it and I have to say to you, what do I have to do to get some satisfaction, what about having the Police Department pursue this and give out tickets for straight pipes? SUPERVISOR HORTON: Mr. Corwin, the issue you talk about is one that I struggle with with the Police Department, the Town Board does regularly, there has been more than one checkpoint Page 34 September 13, 2005 Town of Southold Board Meeting this summer, there will be a number scheduled throughout the fall as well because we recognize that particularly on the weekends through September and October it is very busy time for motorcyclists in general, the Department also has made tremendous efforts on foot and on bicycle and in, particularly in the downtown areas of Greenport, but also other hamlets of Southold to mitigate the issue as well and I guess the best that I can tell you is, we will keep on doing more and if we are not doing enough, we will keep on trying to do more. Your points are accurate and I for one, am somebody who, you know, agrees with you 100 percent. And we will have to do a better job than what we are currently doing. MR. CORWIN: Well, I ask you to please do that. I don’t want to keep coming up here and I realize it is not easy…. SUPERVISOR HORTON: I have a feeling that this is going to be an issue that we are dealing with year after year after year after year. And it is just one that we have to keep chipping away at and keep working on. But please do know that the Police Department is, you know recognizes as a summer time front burner issue among many front burner issues, and is dealing with it head on and if we need to do more, we will continue to do more. MR. CORWIN: Thank you. SUPERVISOR HORTON: Thank you, Mr. Corwin. Yes, Ms. Tole. MS. TOLE: Still Cathy Tole from Greenport. Regarding the issue of straight pipes, as you know, it can be addressed. I know from personal experience when a Police Department gets repeated complaints from a community and they attack the issue that is underlying the complaints, it gets dealt with. SUPERVISOR HORTON: Right. MS. TOLE: Greenport in particular or the Town of Southold or the entire north fork can be deemed as unfriendly to straight pipes in the matter of one season through proper enforcement. And since we are very heavily tapped with demands on our Police Department during the peak season, it is a simple matter to write traffic safety grants and that that has, for enforcement of just this issue and if that hasn’t been done by this Board or hasn’t been initiated by this Board after years of hearing about these complaints, there is something wrong somewhere in the process. SUPERVISOR HORTON: We have, on these points, we have received traffic funding grants from State and County resources. The issue isn’t new to this summer, when it was brought to our attention last summer, we did exactly just that and became embroiled in a controversy with motorcycle organizations on Long Island as an unfriendly police force to motorcycles. We did not waver, we did not say, ‘well, we are not unfriendly’ but we said you are breaking the law, you are making it uncomfortable for our residents and that is going to have to be addressed and we are going to address it. Over the course of this summer, albeit there are still complaints, but I will tell you and I am not saying this issue is completely resolved, the complaints have been greatly reduced and actually, Dave, you and I have discussed that in the past but it is not completely mitigated. And we will continue a checkpoint, straight pipe, illegal helmets, you Page 35 September 13, 2005 Town of Southold Board Meeting know, the whole nine yards; as far as that is concerned have been the focus of several checkpoints and that, we will continue on that vein. And we don’t just do them, start them in Greenport, they are at, you know, coming into town and going out of town in the western portions of town. We actually have set them up in Orient as well, for them coming off of the ferry, the whole nine yards. So you, actually, Mr. Corwin, live in a very difficult, particularly difficult, you are right around the corner from my mother and that, particularly that junction of Broad, Main, First, Main, that whole area is like a…. MS. TOLE: Nightmare? SUPERVISOR HORTON: Well, it is like a canyon…. UNIDENTIFIED: (Inaudible comments from audience) SUPERVISOR HORTON: And I lived on the corner of Front and Main for 2 years or 3 years and I would, my windows would rattle, my bed would shake at 8:00 in the morning when they roll into town. So this is something that is being worked on forcefully. And, forthrightly, and as I said, I think it is going to continue to be an issue. We are, not that you seek to have this label as the unfriendly to motorcycle town… MS. TOLE: Oh, whoa, whoa, no, no. I said the straight pipes. I was very specific. And not to motorcycles. SUPERVISOR HORTON: Straight pipes, okay, yeah, right. That is what I mean. We have gained that recognition… MS. TOLE: There should be a difference there. SUPERVISOR HORTON: And well, you know, you are right, I agree with what you said. We will continue working on it. There are, we do have a number of checkpoints scheduled throughout the fall and that is, you know, the enforcement route, I believe, is the most effective way. We have seen tremendous progress from last summer to this summer. In fact, the only thing that I have noticed, well, I shouldn’t say the only thing I have noticed, one thing I have noticed is that if you stand on the corner of Ninth and Main Street, when those motorcycles get underneath the banner, do you know what they do? They whale it. It is like, hey, hey welcome to Greenport, here we are. You know, I have seen that banner actually have an adverse effect. So we have had to step it up even more so in those, in our efforts. MS. TOLE: You mention that there were grants. Where they traffic enforcement grants written specifically for the straight pipe and motorcycle safety enforcement… SUPERVISOR HORTON: No, not specifically. MS. TOLE: Because there is money out there because the accidents that we can certainly note on the North Fork that we can use motorcycle enforcement… Page 36 September 13, 2005 Town of Southold Board Meeting SUPERVISOR HORTON: Its been for traffic safety enforcement. MS. TOLE: I hate to rob Peter to pay Paul so, maybe you should ask about having a set aside grant for just this enforcement written… SUPERVISOR HORTON: That is a good suggestion. MS. TOLE: ….I could almost guarantee that you will get money that will allow you to do even more enforcement. SUPERVISOR HORTON: That is a good suggestion. And we will do that. We haven’t been strapped for the ability to do enforcement. We have allocated the resource. If we can get reimbursed through another line of funding for dedicating those resources, it is a great idea. MS. TOLE: Just means more resources. SUPERVISOR HORTON: There you go. Thanks. Yes, Mr. Wills. FRANK WILLS: Frank Wills, Mattituck. On that subject, let’s assume one bicycler has no pipes at all, he gets stopped. What then happens? Does he get a ticket? Does the bicycle get confiscated or is he tapped on the wrist, you shouldn’t do this bad boy, and go home. SUPERVISOR HORTON: Tickets are written. They are traffic violations, moving violations, I believe would be the proper term. You might be better qualified to answer that, if somebody is pulled over with a moving violation that is a non-speed infraction, an equipment infraction. Is that something that actually shows up on one’s license? MS. TOLE: Some equipment infractions are points, I don’t know about this particular one. SUPERVISOR HORTON: Yeah, I don’t know if that is a point or not. MS. TOLE: But how many tickets perhaps, the issue is how many tickets were written and at some point it becomes a financial liability and also, if there is helmet, not having helmets and things like that is far more, has far more impact on their insurance rates. MR. WILLS: Well, like New York State used to have a rule that if somebody got caught driving a car while under the influence, the car would be confiscated and auctioned off. Maybe the same might apply to bicycles. SUPERVISOR HORTON: Thank you. Are there other comments from the floor? Mr. McCarthy. MR. MCCARTHY: Just had a quick question. On something that was up for discussion, I am assuming it was up for discussion this morning. The Goose Creek Lane South purchase of road from Suffolk County, I am just looking to find out what the result of that was? Page 37 September 13, 2005 Town of Southold Board Meeting SUPERVISOR HORTON: The result of that is I suggested that Councilman Wickham and Councilman Ross have a meeting with the neighborhood as a whole to get the concerns and the voices on the table to see what kind of resolution can be sought through a meeting of that nature. COUNCILMAN WICKHAM: That meeting has tentatively been set for the Goose Creek Property Owners Association meeting on Sunday… SUPERVISOR HORTON: And all interested parties, such as yourself, I am assuming. th COUNCILMAN WICKHAM: ….the 25 at 1:00 P.M. and you are a member of that association, are you not? MR. MCCARTHY: There is no association yet, it is still in formation. I have a lot of concerns if the Town does take the road, I would be the one most immediately affected. This is a private, quarter mile long, dirt road… SUPERVISOR HORTON: There is going to be a community meeting… COUNCILMAN WICKHAM: And we would be sure you were there. MR. MCCARTHY: Well, I will try to be there but I have concerns if the town gets involved in something that might be a private property matter because those properties come up through the proper channels at the county, for the county auction and the county direct sale, which I have been involved in that process and submitted a bid on that and if the Town is involved, it may be interfering with some of that, to serve some people’s needs versus others and that is something that I think ought to be out in the public forum and if the Town is going to get involved in this public road or in this piece of property which is used as a road and a right-of-way, at what point are you not going to get involved in every other right-of-way that is in Town that may have an issue. And I would like to see what the policy of the Town Board is going to be on that and anything else that comes up that is excess County property and how the Town deals with it. If the Town is going to be involved in a purchase, how about some street lights, some paving, some curbs? You know, what is the Town’s intention? SUPERVISOR HORTON: The Town, well, I think the point here, Mr. McCarthy, is that the Town doesn’t have an intention one way or another at this point, the Town wants to hear not from one side individually and then another side individually but to have a bunch of grown-ups sit around a table and say, ‘these are the issues that are before us, how can we best address them’? I have been warning you for a year and a half to do something and I offered to write some of it and even I think the Suffolk Times and the Traveler would say that I am rather well-equipped to do it and it hasn’t been done. So, you are sitting up there, you are not doing anything, the Town is, people are thoroughly and completely disgusted with about 99 percent of you up there. And if you can go to bed at night thinking that’s not the truth, you are in dream world. I guess they were probably adopted? COUNCILMAN WICKHAM: Results of what? COUNCILMAN ROMANELLI: Hamlet studies. MR. NICKLES, JR.: The hamlet studies. They have been adopted, right? SUPERVISOR HORTON: The reports were adopted. Now is it going to be a lengthy and very involved implementation phase? Yes. MR. NICKLES, JR.: Okay. I just sort of like to remind the Board that as they are looking at what goes on inside the hamlet districts, where the main businesses are going on, I know that there are going to be probably some suggestions about what to do with this property, with that property.
