DUBOIS Property Location: 55 Bay Avenue, Greenport; Parcel 43-4-45 SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type 11 category of the State's List of Actions, without an adverse effect on the environment if the project is implemented as planned. PROPERTY FACTS/DESCRIPTION: The applicant's 7,680.43 sq. ft. lot has frontage along two sides along Sandy Beach Road and 102.99 feet along the west side of Bay Road, in Greenport. The property is improved with a 1-1/2 story frame house, shed, outdoor shower, with nonconforming setbacks as shown on the December 17, 2002 survey prepared by Joseph A. Ingegno, L.S. BASIS OF APPLICATION: Building Department's October 2, 2003 Notice of Disapproval, citing Section 100-244B, in its denial of a building permit application concerning a proposed new dwelling at less than 35 feet from the front lot line and less than 35 feet from the rear lot line, after removal of the existing dwelling, shed and outdoor shower. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on December 18, 2003, at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant: AREA'VARIANCE RELIEF REQUESTED: Applicant wishes to construct a new dwelling in the existing footprint, after removal of the existing building. The setbacks requested are 27'5" from the westerly (front) lot line, 201" and 227 variable setbacks from the southwest (front) lot line, +-6.1 feet from the north lot line, variable setbacks to the east (front) lot line at 321" from the covered entry porch, and 38' 9 W for the dwelling. The proposed construction is shown on the detailed site plan prepared by Thomas C. Samuels, R.A. dated 9/30/03. ADDITIONAL INFORMATION: during the December 18, 2003, the Board requesting the square footage of the residence and setback from the face of the existing residence to the face of the proposed dormer. By letter dated December 18, 2003 from Thomas Samuels, Architect, the total square footage of the residence, including an enclosed unheated porch, is 2,208 sq, ft., and a maximum height from the midpoint of the roof to grade at 248". REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and personal inspections, the Board makes the following findings: Pa4e 2—January 8,2004 Api. ,No. 5448—P.Jeselsohn,F, Dubois 43.4at Greenport 1. Grant of the relief requested will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The applicant is proposing demolition of the existing 1-112 story home and replacement with a new two-story dwelling, in the original footprint. The Board asked the architect during the December 18, 2003 why a different location was not chosen to create a greater yard setback to the north. The Board was advised that a different placement of the new home was difficult because of the nonconforming size of the lot, the existence of three front yards, and the position of the new sanitary system with shallow pools. The applicant's agent agreed to screen the north side of the home with evergreens, and continuous maintenance. 2. The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The lot is nonconforming with 7,680 sq. ft. in size and with the new location of the expanded sanitary system, the available building area is restricted to the existing footprint. 3. The difficulty was self-created in that the home has been in existence in the requested footprint for many years, and the variance was created when the existing home was planned to be demolished and reconstructed without conforming to the current Town Code requirements. 5. No evidence has been submitted to suggest that a variance using the existing footprint will have an adverse impact on the physical or environmental conditions in the neighborhood. The house has existed for many years in the present nonconforming footprint. 6. Grant of the relief requested is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a new dwelling, while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: in considering all of the above factors and applying the balancing test and@r New York Town Law 267-B, motion was offered by Member Goehringer, seconded by Member Orlando, and duVearried, to GRANT the variance as applied for, as shown on the site plan prepared by Thomas C. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action.
