For our first order of business, we will set the next meeting for Monday, August 8, 2005 at 6:00 p.m. at the Southold Town Hall, Main Road, Southold, as the time and place for the next regular Planning Board Meeting. Before we begin with the first public hearing, I want to publicly announce that we have a new staff person who is here for the first time, Denise Heyse, for those of you who have not met her and are coming into our department. And I also want to say that this is the last meeting of our Planning Board that we will have Valerie Scopaz as our Town Planner here with us. She has served the town well and long for 18 years and Friday is her last day, so I publicly thank you for all you've done on behalf of them. PUBLIC HEARINGS Chairperson Woodhouse: 6:00 p.m. Burt's Reliable: This amended site plan is for new construction of a 4,362 sq.ft, storage building on a 38,459 sq.ft, parcel in the LI Zone located approximately 90' n/o Traveler Street on the w/s/o Youngs Avenue in Southold. SCTM #1000-60-1-6 Is there anyone here who would like to speak on behalf of this application? Pat Romanelli: I'm representing my son. I submitted the plans. I don't see any problems with it, but whatever the questions are for me. Chairperson Woodhouse: Does the Board have any questions for Mr. Romanellli? (no response) Thank you. Is there anyone else? Ken Edwards: I would like to offer the following: WHEREAS, the proposed amended site plan is for the new construction of a 4362 sq. ft. storage building on a 38,459 sq. ft. parcel in the LI Zone; and WHEREAS, Romanelli Realty is the owner of the property known as 1515 Young's Avenue, located on the w/s/o Young's Avenue, approximately 90' n/o Traveler Street, in Southold, SCTM # 1000-60-1-6; and Southold Town Planninc~ Board Paqe Three July 11,2005 WHEREAS, on February 8, 2005, a formal site plan application was submitted for approval; and WHEREAS, on April 14, 2005, the Southold Town Zoning Board of Appeals reviewed an application for a side yard variance and granted approval under appeal number 5679 with one condition and the Planning Board incorporates this in this approval; and WHEREAS, on May 12, 2005, the Southold Fire District recommended that fire protection is adequate and the Planning Board accepted this recommendation; and WHEREAS, on May 16, 2005, the Southold Town Building Inspector reviewed and certified the site plan for "Storage Building" use; and WHEREAS, on May 18, 2005,the Southold Town Engineering Inspector reviewed and approved the proposed drainage with conditions and the Planning Board has accepted his recommendations; and WHEREAS, on June 14, 2005, the Southold Town Planning Board started the lead agency coordination process on this Unlisted Action; and WHEREAS, on June 23, 2005, the Architectural Review Committee reviewed and granted approval of the architectural drawings and assdciated site plan materials, and the Planning Board accepted this approval and determined it to be satisfactory; and WHEREAS, the following four items are incorporated and included in the site plan: All outdoor lighting shall be shielded so that the light source is not visible from adjacent properties and roadways. Lighting fixtures shall focus and direct the light in such a manner as to contain the light and glare within property boundaries. The lighting must meet Town Code requirements. 2. All signs shall meet Southold Town Codes and shall be subject to the approval of the Southold Town Building inspector. The applicant must provide to the Planning Department an as-built site plan/survey to verify the exact locations of the proposed drainage wells during the construction phase of the project file records. If the infrastructure allows, up to three small cherry trees will be planted by the Tree Committee in the Town right of way along Young's Avenue to enhance the landscaping in front or the site; and WHEREAS, all the requirements of the Site Plan Regulations of the Town of Southold have been met, be it therefore Southold Town Plannin(~ Board Pa(~e Four July 11,2005 RESOLVED, on July 11, 2005, the Southold Town Planning Board, acting under the State Environmental Quality Review Act, pursuant to 6 NYCRR Part 617, Section 617.7, performed a coordinated review of this unlisted Action. The Planning Board establishes itself as lead agency, and as lead agency, makes a determination of non- significance and grants a Negative Declaration; Bill Cremers: Second the motion. Ken Edwards: AND BE IT FURTHER RESOLVED, that the Southold Town Planning Board grant final approval of the site plan prepared by Penny Lumber and certified by James Deerkoski Professional Engineer, dated May 10, 2005 and last revised July 1, 2005, and authorize the Chairperson to endorse the final site plans subject to a one- year review from the date of issuance of the building permit. Bruno Semon: Madame Chairwoman, I just want to indicate that, in addition, the Board needs to authorize the Chairperson to endorse the site plans when they are stamped and approved. Lloyd - This proposal is to subdivide a 25.449-acre parcel into two lots where Lot 1 equals 2.93 acres and Lot 2 equals 22.511 acres. The property is located at the terminus of Strathmors Road and the west side of Rocky Point Road, approximately 300' south of Aquaview Avenue in East Marion. SCTM #1000-21-1-30.1 This public hearing will be held open and renoticed. We will rescheduie this hearing so that everyone has proper notice to attend. If there is anyone in the audience who cannot attend the meeting that will be scheduled for next month, and would like to speak tonight, you will be able to do so. If not, we invite you to come back next month. Is there anyone who would like to address the Board on this application? Peter Nicolelis, Rocky Point Road: Can we get a description of where this 2.94-acre parcel fits within the 25 acres? Chairperson Woodhouse: The map is outside. If you would just put it on the table. Peter Nicolelis: (inaudible) And that would be the only access to the site? Anthony Trezza: Access to that lot being created is from the existing driveway. Chairperson Woodhouse: Correct. There is no other road being proposed at this time. Peter Nicolelis: Is it known at this point what the plan is for the remainder of the property. Chairperson Woodhouse: We have no application for the rest of the property. Peter Nicolelis: Are there any restrictions on that property? Southold Town Plannin(~ Board PaRe Six Julv 11,2005 Chairperson Woodhouse: None. And the applicant is not here so that you could ask him directly. Oh, yes? (inaudible from audience) OK. Is there someone else.., would you like to address the Board? Please. Marillvn LoPresti: I say good evening to the Board. I am Vice President/Secretary of the Marion Southold Homeowners Association, located on and off of Rocky Point Road. I would like to make a comment. I understand where the application is, and where the read is, and that there are no plans posted at this time, but we would like to go on record as opposing any further development on Rocky Point Road. It is a very heavily populated read, it's very well treversed. People trevel at high speed; there are children playing on the read. It took us a year or more to get the speed limit down from 40 to 30 mph. There has recently been lots of construction going on down near the water. We are proud of being in charge of what was once open space and is now part of our covenant as private preperty that we are preserving for generations to come. So, we would like to see this remaining pamel of treed preperty stay the way it is, and we would like to go on record saying we are opposed to any kind of development in this area. Thank you. Chairperson Woodhouse: Thank you. Is there anyone else who would like to address the Board? Catherine Mesiano: I'm appearing on behalf of Gail Wickham who is the attorney for Mr. Kanev. She couldn't be here this evening. In response to Ms. LoPresti, I just want to point out that this action will result in the creation of a lot that will contain the existing imprevements. This application does not contemplate further development. That type of action would be considered, if at all, at some future date, and on some future application. This is an action to create a lot that will contain the existing developments. on the site. For all intents and purposes, there's a zere effect on the community because what's there will be there. This is not creating any new density units, no new clearing, nothing will change except that there will be a smaller lot containing a dwelling and a larger lot in its present state. That's the intent of the present application. Chairperson Woodhouse: Thank you very much. Is there anyone else? Southold Town Plannina Board Paae Seven July 11, 2005 Hearings Held Over From Previous Meetings: Chairperson VVoodhouse: Charnews - This proposal is to subdivide a 23.4004-acre parcel into two lots where Lot I equals 3 acres and Lot 2 equals 20.4004 acres. The property is located on the w/s/o Youngs Avenue and the e/s/o Horton Lane, approximately 375' s/o CR 48 in Southold. SCTM# 1000-63-1-25 At our last meeting, this Board ruled that we could not take any action on this application and that we would be keeping this hearing open. Is there anyone who would like to address the Board on this application at this time? Yes? Donald Waaner: I live in Founder's Village, just south of the proposed development. Exactly what is planned to go in there? We have heard two stories: one of multiple apartments and one of something like 17 homes on a 20-acre piece of property. Bill Cremers: There is only going to be one lot right now for the application that is submitted. Two lots actually. Chairperson Woodhouse: Right now the only proposal that we have had before us is to take a large parcel and divide it into two lots: a three-acre piece and a 20.4004-acre piece. Donald Waaner: The threee-acre piece is obviously for the existing house that's there. Has the applicant given any indication what the plans are for this roughly 20-acre piece of property? Anthony Trezza: Currently, there is an application before the Town Board for a change of zone on that 20-acre piece. I do not believe that the Town Board has taken any action on that particular application because there is an apparent contract dispute between Mr. Charnews and Richard Israel, who is the contract vendee. So there is a change of zone proposal for that 20-acre piece from the current zoning, R-80, to Hamlet Density. We do not have any residential site plan application before the Planning Board, but Mr. Israel did indicate that he was contemplating an apartment complex there. But we haven't looked at any designs, we haven't considered any yield, and we haven't considered an application because we don't have one before us. Right now, he just has a change of zone application before the Town Board. Donald Wac~ner: I see, thank you. If I might take a moment with the Board here, as you well know, particularly since Memorial Day, the traffic conditions here are going from bad to worse. We already know that not only our town, but also the ferry people are suing the Town of Easthampton to try and get some traffic relief here. If we condone a massive apartment complex or whatever as this one indication you might say, all of these additional people in here, the traffic conditions are going to become prohibitive. In your planning down the read, I would urge that you consider this and, if the land is to be developed, I think the way to develop it would be as the other suggestion we have heard, the 17 homes on the 20-acre property. We would have less people and less traffic. That's about it. Thank you very much. Southold Town Plannin(~ Board Pa(~e Ei(~ht July 11,2005 Chaii'person Woodhouse: Thank you. Yes, ma'am. Jane Welz: I'm on Horton Lane. I don't abut the property, and I spoke last month about the issue of the Charnews property, and I don't have a problem with Mr. Charnews wanting three acres of property. But I think by SEQRA law, everything has to be adjoined. I know that there are legal issues right now, but I really implore you not to let an apartment house go in there. I came from Brooklyn; Brooklyn's a great place. I don't want to see it out here now. Thank you. Anthony Abruzzo: I'm an adjoinant to that. I spoke to an attorney last week, Linda Margolin, who said that Mr. Charnews withdrew the application. I was just wondering why it's still open if he has withdrawn the application. Anthony Trezza: There was no application withdrawn from this department. Again, there is a contract dispute. Even if Mr. Charnews (and I spoke to Legal about this) does submit a withdrawal, he authorized, (and whether or not the authorization is valid is for the court to decide), Richard Israel to submit an application and authorized Pat Moore to act on Richard Israel's behalf. So, the withdrawal would have to come from those who submitted the application. He cannot actually withdraw the application that he authorized someone else to submit. Anthony Abruzzo: Regarding the simultaneous application for change of zone, the Board acts on an application to change a zone without a site plan? What if they wanted to do something crazy on it? How would you handle that? Anthony Trezza: I think they would rely on the Planning Board and the Planning Department to review the application, its design for compliance with the zoning. Anthony Abruzzo: Prior to its change of zone? Chairperson Woodhouse: We would be asked to comment on the change of zone application. Yes, it would come before this Board, without a site plan. Anthony Abruzzo: Is there something before the Board right now? Chairperson Woodhouse: No. Not at this time. Anthony Abruzzo: It just seems like dividing it this way makes it easier to get through Health (Suffolk County Department of Health Services). Because then Health is then dealing with one big tax lot. Now, Health also has to approve this two-lot subdivision, correct? Anthony Trezza: Yes. Anthony Abruzzo: And how does the Board handle the approval of this two-lot subdivision now that it's going into litigation; do they just do it? Southold Town Plannina Board Paae Nine July 11, 2005 Anthony Trezza: The Planning Board won't take any action. Chairperson Woodhouse: Cannot take any action. That's why we're holding it open. Anthony Abruzzo: OK. And it's going to continue to be held open? That's just how it goes? It stays open? Chairperson Woodhouse: Until this contract dispute is resolved, yes. Silbernagel is the owner of the property known and designated as n/s/o NY State Route 25, located approximately 3,612' e/o Peconic Lane in Southold, SCTM #'s 1000-75-2-15.1 & 15.2; and WHEREAS, on April 15, 2003, a formal application for approval of this site plan was submitted; and WHEREAS, on July 15, 2003, the Southold Town Planning Board, acting under the State Environmental Quality Review Act (6 NYCRR), Part 617.5, performed a review of this unlisted action, and as lead agency, made a determination of non-significance and granted a Negative Declaration; and WHEREAS, on July 7, 2003, the Southold Fire District responded, after review of the site plan, and found that there is adequate fire protection; and WHEREAS, on October 7, 2003, the NYS DOT approved the application under Case Number 03-138P pending a bond amount of $15,000.00; and WHEREAS, a formal application, known as Reference Number C10-03-0007, was submitted to the Suffolk County Health Department for review and is still pending approval as applied; and WHEREAS, on January 28, 2004, the Town Engineer reviewed and approved the site plan and the Planning Board has accepted his recommendation for approval; and WHEREAS, on January 29, 2004, the Architectural Review Committee reviewed and approved the proposed site plan application as submitted; and WHEREAS, on February 4, 2004, the Southold Town Building Inspector reviewed and certified the site plan; and WHEREAS, the Southold Town Planning Board, pursuant to Chapter 58, Notice of Public Hearing, has received affidavits that the applicant has complied with the notification provisions; and WHEREAS, the following three items are incorporated and included in the site plan: Southold Town Plannina Board Paae Eleven July 11, 2005 All outdoor lighting shall be shielded so that the light source is not visible from adjacent properties and roadways. Martin Sidor: WHEREAS, the site plan is for a new 1,840 sq. ft. building with 790.1 sq. ft. of retail floor display, 864.6 sq. ft. for food preparation, including a utility/bathroom and 185.3 sq. ft. of storage with no public access on a 0.22 acre parcel in the B Zone located on the n/e corner of NYS Road 25 and Legion Avenue, known as 11155 Main Road, in Mattituck. SCTM#1000-142-2-22; and WHEREAS, the applicant and agent, Henry Bremer, proposes the site plan; and WHEREAS, the Bremer's Market & Deli, Inc. is the owner of the respective property; and WHEREAS, on June 16, 2004, a formal site plan application was submitted for approval; and WHEREAS, on August 11, 2004, the Mattituck Fire District recommended that no additional fire well is needed and the Planning Board has accepted this recommendation; and WHEREAS, on September 7, 2004 the Southold Town Zoning Board of Appeals granted the variance as described under Appeal Number 5531; and WHEREAS, on October 5, 2004, the Southold Town Planning Board, acting under the State Environmental Quality Review Act (6 NYCRR), Part 617.5 c (7), made a determination that the proposed action is a Type II and not subject to review; and WHEREAS, on October 19, 2004, the Southold Town Engineering Inspector reviewed and approved the proposed drainage with conditions and the Planning Board has accepted his recommendation; and WHEREAS, on November 1,2004 the Suffolk County Department of Health Services reviewed and approved the site plan under reference number C10-04-0009; and Southold Town PlanninQ Board Pa(~e Thirteen July 11, 2005 WHEREAS, on February 16, 2005, the New York State Department of Transportation reviewed the site plan and assigned the case number 04-0681 and issued a highway work permit; and WHEREAS, on March 7, 2005, the Southold Town Building Inspector reviewed and certified the site plan for "Retail Store" use; and WHEREAS, on April 11,2005, the Southold Town Planning Board was informed that a well in operation on the adjoining property east was not shown in the approved site plan from the Suffolk County Department of Health Services and the Planning Board held open the public hearing; and WHEREAS, on June 23, 2005, the Architectural Review Committee reviewed the Architectural drawings, associated site plan materials and accepted the materials as indicated at the March 3, 2005 with the condition that lattice screening will be required to shield the air conditioning unit, the Planning Board has accepted this recommendation; and WHEREAS, the Southold Town Planning Board, pursuant to Chapter 58, Notice of Public Hearing, has received affidavits that the applicant has complied with the notification provisions; and WHEREAS, the following four items are incorporated and included in the site plan: All outdoor lighting shall be shielded so that the light source is not visible from adjacent properties and roadways. Lighting fixtures shall focus and direct the light in such a manner as to contain the light and glare within property boundaries. The lighting must meet the Town Code requirements. 2. All signs shall meet Southold Town Zoning Codes and shall be subject to approval of the Southold Town Building Inspector. The underground tanks be removed and disposed of at the time of construction. All necessary environmental control permits be applied for and obtained by the applicant and agent. The site plan approval does not include any site disturbance, including excavations or re-grading of this site other than the items that are shown on the grading and drainage plan; and WHEREAS, all the requirements of the Site Plan Regulations of the Town of Southold have been met; be it therefore RESOLVED, that the Southold Town Planning Board grant conditional final approval of the site plan prepared by Condon Engineering, P.C. and certified by John J. Condon, Professional Engineer, dated February 17, 2005, subject to fulfillment of the following requirement: Southold Town Plannincl Board Paae Fourteen July 11,2005 The applicant must receive approval from Suffolk County Department of Health Services for the proposed site plan and submit a copy of such approval to the Planning Department.
