Property Location: 700 and 800 Gardiner's Lane, Southold CTM 70-8-8 SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without an adverse effect on the environment if the project is implemented as planned. BASIS OF APPLICATION: Article II, Section 100-26, based on the Building Inspector's November 23, 2004 Notice of Disapproval stating that CTM 1000-70-8-8 has been merged with improved land referred to as CTM 70-8-9 under Article II, Section 100-25A. PROPERTY FACTS/DESCRIPTION: The applicant's merged lands include CTM 1000-70-8-8 ('8') and 1000-78-8-9 ('9'), consisting of a total area of 40,592 sq. ft. The portion of land which is the subject of the lot waiver contains 20,836 sq. ft. with 100 feet along the north/west side of Gardiner's Lane. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on May 4, 2005 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant: APPLICANT'S REQUEST: The applicant is requesting a Waiver under Section 100-26 to unmerge Suffolk County Tax Map Lot 8, vacant land, from Lot 9, improved with a dwelling. REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and personal inspections, the Board makes the following findings: 1. Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The Commonwealth Land Title Insurance Company January 28, 2005 Search of owners shows that the applicant's parents, Helen J. Schriefer and Clifford Schriefer, acquired lot '9' on September 26, 1967 by deed recorded at Liber 6230 cp 439. On November 3, 1969, Helen Schriefer acquired lot '8' individually by deed recorded at Liber 6656 page 302. 'Page 2—May 12,2005 S S ZB Ref. 5689—C.Schriefer,Jr." CTM ID: 70-8-8 2. The properties were merged by passing of both parents, although the properties were kept as separate lots since prior to 1969 and it was the intention of the parents to keep the lots separate. 3. The waiver of merger will recognize the original lot lines shown on the 1967 and 1969 deeds of record. This land, when separated, will be equivalent in size to the neighboring lots. 4. The waiver of merger will allow for the ultimate construction of one additional single-family residence in the neighborhood, which will not result in a significant increase in the density. 5. The applicant stated that they had no indication from the Town that the lots were merged after this transaction. They continued to receive two separate tax bills. RESOLUTION: On motion by Chairwoman Oliva, seconded by Member Orlando, it was RESOLVED, to GRANT the lot waiver, as applied for. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. No. 5229— ESTATE OF MARIE HILLER Street and Location: 125 and 165 Bungalow Lane, Mattituck 1000-123-3-2 PROPERTY FACTS/DESCRIPTION: Applicants' property is located on the north side of Bungalow Lane in Mattituck. The property contains a total area of 49,479.27 feet, identified on the Suffolk County Tax Maps as 1000-123-3-4.1 and 1000-123-3-2. Existing is a one-story frame dwelling 62.2 feet from the front property line facing Bungalow Lane and an accessory garage situated in the front yard at 17.3 feet from the front property line, all as shown on the August 27, 2002 survey, revised January 15, 2003, prepared by Stanley J. Isaksen, Jr., L.S. BASIS OF APPLICATION: Applicant's July 19, 2002 request for a merger determination, by way of a building permit application to locate a new dwelling, was denied by the Building Department on July 19, 2002, for the reason that the CTM Lot 2 has merged with an adjacent lot to the east (1000- 123-3-4.1) pursuant to Section 100-25, and the lots have been held in common ownership during a period of time after July 1, 1983. APPLICANT'S REQUEST: Applicant requests a Waiver of Merger, pursuant to Article II, Section 100-26, to unmerge CTM #2 of 18,447.59 sq. ft. and 75.05 ft. road frontage, from CTM #4.1 of 31,031.68 sq. ft. and 125 ft. road frontage. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this matter on December 12, 2002 and January 16, 2003, at which tie written and oral evidence were presented. Based on all testimony, documentation, personal observations of members of the board, and other evidence, the Zoning Board finds the following facts to be true and relevant: 1. The title search prepared by Fidelity National Insurance Company July 11, 2002, indicates that Raymond A. Miller and Marie T. Hiller, as Tenants by the Entirety, purchased the house lot in a deed recorded at Liber 3679 page 421 and on 11/9/1962 purchased a 50' x 300' section from William and June Barker. Subsequently in 1970, Marie Hiller separately purchased CTM 2 as recorded in Llber 6770 page 397. 2. Raymond A. Hiller predeceased his wife Marie which, due to common ownership, resulted in a merger of tax lot 4.1, improved with a single-family dwelling, with vacant tax lot 2, to form a lot of at least 40,000 sq. ft. 3. Grant of a waiver of merger will not result in a significant increase in the density of the neighborhood or district containing single-family dwellings. The neighborhood and district is well-developed with single-family residences, and consists almost exclusively of older lots that do not conform to the R-40 (40,000) minimum for this zone district. The 18,447.59 sq. ft. size of the vacant lot in question is equal to some, and smaller than others, but it is clearly consistent with the average size of lots in the neighborhood and district. 5. The waiver will avoid an economic hardship for Marie Hiller Estate. 6. Waiver of merger will allow for construction of one single-family dwelling on original deeded lot, which will not result in a significant increase in the density of the neighborhood. There will be no need for significant change in its contours or slopes, and no evidence was presented to suggest that the lot would require filling affecting nearby environmental or flood areas, or to suggest that its natural details, character, contours or slope would be significantly altered in any manner. 7.
