No. 5639 -Alan and Teresa Sucher Property Location: 60 Fisherman's Beach Road, Cutchogue; CTM 111-01-06. BASIS OF APPLICATION: Building Department's November 5, 2004 Notice of Disapproval,under Section 100-242A,concerning proposed remodeling with reconstruction or enlargement of a non-conforming building, provided the action does not create any new non-conformance or increase the degree of non-conformance. Section 100-244,requires a front yard setback at a minimum of 35 feet, a rear yard setback at a minimum of 35 feet, a single side yard setback at a minimum of 10 feet. Section 100-239.4B requires a minimum setback of buildings of 75 feet from a bulkhead or similar structure wall which is adjacent to tidal water bodies. PROPERTY FACTS/DESCRIPTION: The applicant's 10,760 sq. ft. parcel has frontage along Haywaters Road and is improved with a 1-1/2 story frame,single-family dwelling with wood decks and garage,and accessory frame shed,as shown on the May 24,2004 survey prepared by Martin D. Hand, L.S. Findings of Fact The Zoning Board of Appeals held public hearings on this application on January 20,2005, at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property,and other evidence,the Zoning Board finds the following facts to be true and relevant: RELIEF REQUESTED: Applicants propose alterations and renovations to their existing home which increase the degree of nonconformance regarding setbacks and lot coverage. In this application,area variances are requested for the existing front setback at 13.9+-feet, rear yard at 12.9 feet at its closest point to the as-built garage,and lot coverage total at 31.7 percent. The areas of construction include a 47 sq.ft. front deck, 257 sq.ft. rear deck,as- built garage addition, and proposed dormers on second floor areas and alterations for a reverse-gable roof,with setbacks as shown on the May 24,2004 survey prepared by Martin D. Hand, L.S. and on the elevation diagrams prepared by Mark Kevin Schwartz 1-3-2005, confirming a proposed height of the new construction areas at 21'4"(+-)to the top of ridge. REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and personal inspections, the Board makes the following findings: , , . • Page 2—February 3, 2005 ZBA Ref.5639-Alan and Teresa Sucher CTM 111-1-6 1. Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The new dormers and alterations will be constructed within the footprint of the house over the existing first and second floor areas. The front deck is existing and the extension involves 47 square feet of new deck area,open to the sky. The rear deck is existing and the new 257 sq. ft. deck extension is behind the dwelling, at the same building line of the existing dwelling. The garage was built according to the applicants by a prior owner in the 1960s-70s for which no building permit was obtained. 2.The benefit sought by the applicant cannot be achieved by some method,feasible for the applicant to pursue, other than an area variance. 3. The amount of relief requested is not substantial, in that the house and existing structures and setbacks predate the zoning ordinance. 4. The difficulty was not self-created. The difficulty was the result of application of new regulations to an existing nonconforming property. 5. No evidence has been submitted to suggest that a variance will have an adverse impact on the physical or environmental conditions in the neighborhood. 6. Grant of this variance relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of an addition, while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. Therefore, the proposed construction is not permitted pursuant to Article XXIV, Section 100-244 which states that non-conforming lots,measuring less than 20,000 square feet in total size, require a front yard setback 35 feet, a rear yard setback of 35 feet and a single side yard setback of 10 feet. In performing this balancing test, the Zoning Board is charged with the responsibility to consider the five factors enumerated in Town Law Section 267b-3 (b) . The variance should be granted for the following reasons : 1 . No undesirable change will be produced in the character of the neighborhood or a detriment to nearby properties, if the variance is granted. The existing residence was constructed in 1969 by Herbert Tighe . Sometime after 1969 the owner applied for an attached shed but built an attached garage. Mr and Mrs . Sucher purchased the property in 2004 and started plans for renovation of the existing house. Additional work which does not require a variance is planned: the windows and shingles replaced. The dormers on the existing second floor (% story) are to be added to provide head room on the second floor and are constructed within the footprint of the house and 257 square feet of deck is proposed to be added to the existing rear deck. In addition, the applicant wishes to extend a front deck by 47 square feet . The proposed 47 sq. ft . wood deck addition to the existing front stoop is a minimal encroachment . The proposed improvements will add to the value of the property and no undesirable change will be produced to the character of the neighborhood. In researching the need for variances the applicant discovered that the existing garage built some time in the late 1960 ' s had not obtained a building permit or certificate of occupancy. The owner at the time had applied for an attached shed but built a garage . (See attached survey) . The existing garage will not be changed (other than reshingling) and has been located on the property since it was constructed in substantially the same condition as it appears today. At the time it was constructed, on a lot which was less than 12, 500 sq. ft . the side yard setbacks were 5 ' and 10 ' , the garage would have been conforming, and there were no restrictions with regard to the setback from a bulkhead. Lf 4111 411/ 2 . The benefit sought by the applicant can not be achieved by some method, feasible for the applicant to pursue, other than an area variance . The additions are proportionate to the size of the existing house. The roof line is maintained and dormers provide the code compliance head room for making the 34 story habitable. Denial of the garage variance would result in greater disturbance to the property adjacent to the bulkhead and, practically, leave no storage space for the family. 3 . The area variance is not substantial in that the house and existing structures predate the zoning ordinance. The application of the balancing test weighs in favor of the grant of the variance . 4 . The variance will have no adverse effect or impact on the physical or environmental conditions in the neighborhood or district . The Town Trustees reviewed the improvements to the property and found no adverse environmental impacts . 5 . The alleged difficulty was not self-created. The existing conditions of the property, topography and application of new regulations to an existing nonconforming property create the difficulty. 6 . The variance requested is the minimum variance practicable given the personal benefits anticipated by the applicant .
