SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions,without an adverse effect on the environment if the project is implemented as planned. PROPERTY FACTS/DESCRIPTION: The applicants' .94+- acre parcel has 110 feet along a private right-of-way, known as Private Road #8,which extends from the Main Road, and 184.7 feet along Dam Pond, as shown on Diagram SP-01 prepared by Nemschick Silverman Architects, P.C. The property is improved with a 1-1/2 story dwelling with garage, and is shown on the 1980 Subdivision "Map of R. Gillispie" as Lot 1, BASIS OF APPLICATION: Building Department's March 21, 2005 Notice of Disapproval, citing Section 100-32 in its denial of an application for a building permit concerning partial reconstruction of the existing upper level (proposed addition/alterations). The reason stated in the disapproval is that the height will be an increase in height, from 2.5 stories to three stories. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on May 4, 2005 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant: AREA VARIANCE RELIEF REQUESTED: The applicant is requesting new construction to alter the existing Observatory (Greenhouse) by replacing the existing Plexiglas around the western and southern exposures with a new wooden roof sloped on an 8:12 pitch, covered in standing seam copper, new window banding. This area covers the existing 13'5" by 13'5" floor area at an elevation 19'2" above the finished first floor, an existing egress stair, all of which will remain unchanged. The existing overall height of the building with the observatory is 33+- feet above the existing finished grade of the land, and will remain unaltered. Page 2—May 12, 2005 • • ZB Ref. 5697—R.and J. Rubin CTM ID: 23-1-1 REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and personal inspections, the Board makes the following findings: 1. Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The applicants request new roof replacement for the existing observatory area that is enclosed, heated, and constructed with a comprehensive fire-suppression system (ref. certificate of occupancy and building permit issued about 1983). The new construction areas will replace the existing roof and window banding, and related materials, without changing the size of the existing floor area or egress stairway, and the areas will continue to be maintained for safe exiting and comprehensive fire-suppression system. 2. The benefit sought cannot be achieved by some method, feasible for the applicants to pursue, other than relief from the level above the second floor area, while maintaining the existing 33+- height to the top of the roof. This is the maximum that this Board will allow. 3. The variance is not self-created. The existing observatory room is in need of repair. 4. No evidence has been submitted to suggest that the grant of the relief requested will have an adverse effect or Impact on the physical or environmental conditions in the neighborhood or district. 5. Grant of the requested relief is the minimum action necessary and adequate to enable applicant to enjoy the benefit for repairs of the existing observatory, while preserving and protecting the character of the neighborhood and the health, safety, and welfare of the community. BOARD RESOLUTION: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Chairwoman Oliva, seconded by Member Simon, and duly carried, to GRANT the variance as applied for and described in 1/24/04 construction diagrams prepared by Nemschick Silverman Architects, P.C., SUBJECT TO THE FOLLOWING CONDITIONS: 1. The area above the second floor with the existing observatory may not contain livable space. 2. Screening shall be provided by the applicants/owners on the westerly side of their property. The screening shall begin approximately 20 to 30 feet before the garage on the west side of the property continuously, and either further continued or ending at the home on the northwest side. The screening should be of mature evergreen type trees, at a minimum of 8 ft. high, continuously maintained by a drip irrigation system, and spaced approximately 8 to 10 ft. apart to allow for growth. 3. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on May 4, 2005 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property, and other 'evidence, the Zoning Board finds the following facts to be true and relevant: AREA VARIANCE RELIEF REQUESTED: The applicant is requesting new construction to alter the existing Observatory (Greenhouse) by replacing the existing Plexiglas around the western and southern exposures with a new wooden roof sloped on an 8:12 pitch, covered in standing seam copper, new window banding. This area covers the existing 13'5" by 13'5" floor area at an elevation 19'2" above the finished first floor, an existing egress stair, all of which will remain unchanged. Rubin CTM ID: 23-1-1 REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and personal inspections, the Board makes the following findings: 1. Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The applicants request new roof. replacement for the existing observatory area that is enclosed, heated, and constructed with a comprehensive fire-suppression system (ref. certificate of occupancy and building permit issued about 1983). The new construction areas will replace the existing roof and window banding, and related materials, without changing the size of the existing floor area or egress stairway, and the areas will continue to be maintained for safe exiting and comprehensive fire-suppression system. 2. The benefit sought cannot be achieved by some method, feasible for the applicants to pursue, other than relief from the level above the second floor area, while maintaining the existing 33+- height to the top of the roof. This is the maximum that this Board will allow. 3. The variance is not self-created. The existing observatory room is in need of repair. 4. No evidence has been submitted to suggest that the grant of the relief requested will have an adverse effect or impact on the physical or environmental conditions in the neighborhood or district. 5. Grant of the requested relief is the minimum action necessary.and adequate to enable applicant to enjoy'the benefit for repairs of the existing observatory, while preserving and protecting the character of the neighborhood and the health, safety, and welfare of the community. BOARD RESOLUTION: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Chairwoman Oliva, seconded by Member Simon, and duly carried, to GRANT the variance as applied for and described in 1/24/04 construction diagrams prepared by Nemschick Silverman Architects, P.C., SUBJECT TO THE FOLLOWING CONDITIONS: 1. The area above the second floor with the existing observatory may not contain livable space. 2. Screening shall be provided by the applicants/owners on the westerly side of their property. The screening shall begin approximately 20 to 30 feet before the garage on the west side of the property continuously, and either further continued or ending at the home on the northwest side. The screening Should be of mature evergreen type trees, at a minimum of 8 ft. high, continuously maintained by a drip irrigation system, and spaced approximately 8 to 10 ft. apart to allow for growth. 3.
