KOFINAS Property Location: 552 (Private Right-of-Way) East Road, Cutchogue CTM 110-7-18.2. SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without an adverse effect on the environment if the project is implemented as planned. PROPERTY FACTS/DESCRIPTION: The applicant's 44,299 sq. ft. parcel is located 156.08 feet south from East Road. The lot has 50 feet along a 20 ft. wide right-of-way, and extends 240.88 feet along the northerly lot line, 187.94 feet along the easterly lot line, 276 feet along a tie line along the high water. BASIS OF APPLICATION: Building Department's February 16, 2005 Notice of Disapproval, citing Section 100-30A.3, in its denial of an application for a building permit to construct additions with alterations located less than 15 feet for a minimum side yard. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on May 4, 2005 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant: AREA VARIANCE RELIEF REQUESTED: The applicant wishes to construct a new two-story addition at the north side of the existing dwelling, at 10.3 feet from its closest setback measurement. REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and personal inspections, the Board makes the following findings: 1. Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The angle of the existing home on this conforming lot is not parallel to the road. The northerly yard has a chainlink fencing that extends the full length. All of the addition meets the code's setback requirement, with the exception of a 38 sq. ft. footprint area within the restricted 15 ft. northerly (side) yard. The neighborhood consists of many variable lot sizes, with different dimensions. These lots improved with older homes have nonconforming side yards. . Page 2—May 12,2005 • • ZB Ref. 5693—George Kofinas CTM ID: 110-7-18.2 2. The benefit sought for this 38 sq. ft. additional area can be achieved only by an area variance. 3. The variance granted herein is not substantial, representing 38 sq. ft. of footprint building area that is 10.3 feet from the property line at its closest point, instead of the code required 15 feet. This relief is the maximum that the board will approve in this side yard. 4. No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The addition is on the northerly side of the site, which is landward of the seaward edge located further south of the existing dwelling location. 5. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of an addition, while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Chairwoman Oliva, seconded by Member Dinizio, and duly carried, to GRANT the variance as applied for, as shown on the October 25, 2004 survey, amended February 16, 2005 by Joseph A. Ingegno, and dimensions shown on the floor diagrams with ZB date stamped received May 4, 2005. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. Cre i,u S Reason for Appeal Continued Zoning Board of Appeals re: Kofinas Pursuant to Town Law section 267b-3 the Southold Town Zoning Board of Appeals is to analyze and assess the personal benefits anticipated by the applicant against the potentially deleterious effects that a grant of the relief requested would have on the health, safety and welfare of the effected neighborhood or community. In performing this balancing test, the Zoning Board is charged with the responsibility to consider the five factors enumerated in Town Law Section 267b-3 (b) . The variance should be granted for the following reasons : 1 . No undesirable change will be produced in the character of the neighborhood or a detriment to nearby properties, if the variance is granted. The house is to be renovated and addition proposed. The house is located at the end of a private road, on the water, with only one neighbor to the north. This neighbor has been shown the plan and supports the application. The only suitable location for the addition is on the north side of the property. The existing residence is located adjacent to the Bay and north of a bulkhead and retaining walls . The house will be maintained in its present location along the water. The addition, however, can not comply with a 15 foot setback and a 10 . 3 foot setback from the side yard is proposed. This is a well established community which has been developed with 10 foot side yards . Nevertheless, the current zoning code requires 15 feet . The actual land that is developable is limited by slopes and wetlands . 2 . The benefit sought by the applicant can not be achieved by some method, feasible for the applicant to pursue, other than an area variance . A family room and three bedrooms are proposed. The design would be compromised in order to meet the 15 foot side yard setback. The common property line is vegetated and existing screening will be maintained. The only area which does not conform is 38 square feet first floor and 38 square feet on second floor. The house sits on an angle and only the corner of the addition encroaches on the required setback. However, a redesign meeting the setback would eliminate a significantly larger living area because of the angle of the house. 3 . The area variance is not substantial The application of the balancing test weighs in favor of the grant of the variance . The encroachment is only 38 square feet, with a setback of 10 ' 3 " , however the natural contours of the property and angle of the house increases the setback to almost 30 feet . 4 . The variance will have no adverse effect or impact on the physical or environmental conditions in the neighborhood or district . The construction is occurring landward of existing • • structures . Moreover, the property is stable with existing, mature vegetation. 5 . The alleged difficulty was not self-created. The existing house is on an angle and the addition encroaches on the 15 foot side yard setback. The conditions of the property, topography and limited building area create the difficulty. Limiting development on the waterfront side requires construction to take place on the landward side of the existing house. 6 . The variance requested is the minimum variance practicable given the personal benefits anticipated by the applicant . SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without an adverse effect on the environment if the project is implemented as planned. PROPERTY FACTS/DESCRIPTION: The applicant's 44,299 sq. ft. parcel is located 156.08 feet south from East Road. The tot has 50 feet along a 20 ft. wide right-of-way, and extends 240.88 feet along the northerly lot line, 187.94 feet along the easterly lot line, 276 feet along a tie line along the high water. BASIS OF APPLICATION: Building Department's February 16, 2005 Notice of Disapproval, citing Section 100-30A.3, in its denial of an application for a building permit to construct additions with alterations located less than 15 feet for a minimum side yard. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on May 4, 2005 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant: AREA VARIANCE RELIEF REQUESTED: The applicant wishes to construct a new two-story addition at the north side of the existing dwelling, at 10.3 feet from its closest setback measurement. REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and personal inspections, the Board makes the following findings: 1. Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The angle of the existing home on this conforming lot is not parallel to the road. The northerly yard has a chainlink fencing that extends the full length. All of the addition meets the code's setback requirement, with the exception of a 38 sq. ft. footprint area within the restricted 15 ft. northerly (side) yard. The neighborhood consists of many variable lot sizes, with different dimensions. These lots improved with older homes have nonconforming side yards. This relief is the maximum that the board will approve in this side yard. 4. No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The addition is on the northerly side of the site, which is landward of the seaward edge located further south of the existing dwelling location. 5. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of an addition, while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. WHEREAS, after due notice, a public hearing was held on October 18, 1993, and at said hearing all those who desired to be heard were heard and their testimony recorded; and WHEREAS, the, Board has carefully considered all testimony and documentation submitted concerning this application; and • WHEREAS, Board Members have personally viewed and are familiar with the premises in question, its present zoning, and the surrounding areas; and WHEREAS, the Board made the following findings of fact: 1. By this application, appellant requests approval of the placement of a fence located within and along the front yard areas at a total height of six feet. The length of the fence is approximately 155-160 feet in the front yard, and approximately the entire length of the northerly, easterly, and southerly property lines. All of the fencing is six feet in height, . however, a variance is not required for those yard areas other than the front yard. This fence enclosure is intended to fully enclose the- entire parcel. 2. A copy of a survey prepared by Roderick VanTuyl, P.C. has been submitted with this application which shows the following improvements: (a) preexisting two-story, single-family stucco dwelling; (b) 20' by 40 ' inground pool constructed under Building Permit No. 20329 issued 12/12/91; • (c) accessory storage building near the beach, (d) bulkhead along Great Peconic Bay. Article XXIII, Section 100-231 of the Zoning Code provides that a fence to be situated along the' front property line be erected and maintained at a height not exceeding four feet. (Fences along the side and rear yard areas are permitted at a height up to 6-1/2 feet. ) • 4. It is the position of the Board in considering this application that: (a) the property is uniquely situated at the end of a private right-of-way located off the south side of East Road, which is screened on both sides by hedges at a height of approximately eight feet; - (b) the circumstances are not personal to the • landowner; (c) the relief requested is not substantial; (d) the application does not involve a request for an increase of unit density; • (e) the relief requested will not cause a substantial effect on available governmental facilities since the structure is a fence for security, screening and privacy purposes; (e) the relief requested is not unreasonable due to the uniqueness of the property and the surrounding areas; (f) there is no other alternative available; (g) the 'variance will not in turn be adverse to the safety, health, welfare, comfort, convenience, or order of the town, be adverse to neighboring properties, or alter the essential character of the neighborhood since there is other (natural) screening at heights above four feet near the area of this fence.
