SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without an adverse effect on the environment if the project is implemented as planned. PROPERTY FACTS/DESCRIPTION: The applicants' 27,529 sq. ft. parcel has 100 feet along the north side of North Parish Drive, and is improved with a one-story dwelling, as shown on the November 25, 2002 survey prepared by Barrett,Bonacci& VanWeele,P.C. BASIS OF APPLICATION: Building Department's September 24, 2004 Notice of Disapproval, amended December 23, 2004, citing Sections 100-242A and 100-244, concerning the applicants' request to locate additions/alterations. The reasons stated in the disapproval are that: (1) the new construction will increase the degree of nonconformance when located at less than 40 feet from the front property line and (2) the new construction will create a new nonconformance when located with combined side yard setbacks totaling less than 35 feet. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on March 31,2005 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence,the Zoning Board finds the following facts to be true and relevant: AREA VARIANCE RELIEF REOUESTED: The applicants wish to construct an 18'.5' x 21.5' one- story addition at the west side of the dwelling at 11.8' from the westerly side lot line, and one-story portico addition 35.6' from the front southerly lot line. REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and personal inspections,the Board makes the following findings: 1. Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The parcel is a pre-existing and nonconforming lot created prior to Page 2—April 14,2005 • ZB Ref.5672—D. and B. Dash • CTM ID: 71-1-6 the enactment of the R40 zoning and consists of 27,529 square feet, consistent in size with the majority of the surrounding lots. The existing single-family dwelling and the proposed improvements will also be consistent in both size and design with neighboring improvements. 2. The benefit sought cannot be achieved by some method feasible for the applicants to pursue, other than an area variance. The property is pre-existing and nonconforming with respect to Code Section 100-244 (non-conforming lots) and the requirements regarding the R40 Zoning District. The applicant seeks to construct an 18.5 ft. by 21.5 ft. one-story addition in line with the existing setback located 11.8 feet from the westerly side yard, as shown on the November 25,2002 survey,amended January 12, 2005 by William J. Barrett. With respect to the code requirement of 40 feet for a front yard setback, the requirement cannot be complied with,without relocating the entire structure. Given the small addition proposed on the seaward side of the residence, relocation of the existing residence is not practicable. With respect to the side yard variance, the benefit sought cannot be achieved by some method other than an area variance as the location of the existing dwelling and its interior layout preclude the applicant from achieving the intended goal of improving this portion of the dwelling. The property contains a shed, to be removed, that is shown at six (6) feet from the westerly side lot line. Further, in order to construct within required zoning setbacks, significantly more work would have to be performed on the residence in terms of demolition and reconstruction,which places an undue burden on the applicants. 3. The amount of relief requested is not substantial. 4. The variance will not have an adverse effect or impact on the physical or environmental conditions in the neighborhood or district. The proposed one-story additions are typical of the surrounding properties, which have been shown to have no negative impacts to the physical and/or environmental well-being of the area. In addition, the existing single-family dwelling and the proposed improvements are consistent in both size and design with the neighboring improvements. Further, the proposed addition is in line with the existing residence and maintains the existing side yard setback, which has had no demonstrative impact on either the physical or environmental conditions in the neighborhood. 5. The variance is not self-created. The Town's zoning restrictions, as implemented, has made it difficult for preexisting improved lots to be conform in a reasonable manner. 6. Grant of the variance is the minimum action necessary and adequate to enable the applicants to enjoy the benefit of the proposed additions, while preserving and protecting the character of the neighborhood and the health,safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Dinizio, seconded by Member Orlando,and duly carried,to GRANT the variance as applied for, as shown on the November 25, 2002 survey updated January 12, 2005 by Barrett, Bonacci & VanWeele, P.C. and diagram Pages No. 1 and 2 dated 11/23/04, and diagram Page 5 dated 8/16/04, prepared by Penny Lumber. The applicant requires only 22.67%relief from the single side yard setback requirement of 15' and 15.71%of the total side yard setback. The relief requested from§100- 242.A(front yard setback)is 11%. (4) The variance will NOT have an adverse effect or Impact on the physical or environmental conditions in the neighborhood or district because: The granting of the variance will have no adverse effect or impact on the physical or environmental conditions in the affected areas of the neighborhood considering that the proposed additions are typical of the surrounding properties which have been shown to have no negative impacts to the physical and/or environmental well-being of the area. In addition,the existing single family dwelling and the proposed improvements are consistent in both size and design with the neighboring improvements. Further,the proposed addition is in line with the existing residence and maintains the existing side yard setback which has had no demonstrative impact on either the physical or environmental conditions in the neighborhood. ( )Yes,or(X)No. The hardship is not self-created,but rather created by the Town through the implementation zoning restrictions which are difficult for pre-existing improved lots to comply with in a reasonable manner. During construction,concrete or leachate shall not escape or be discharged,nor shall washings from transit mix trucks, mixers or other devices enter tidal wetlands and/or protected buffer areas. 2. Any debris or excess material from construction of this project shall be completely removed from the adjacent area(upland)and removed to an approved upland area for disposal. No debris is permitted in tidal wetlands and/or protected buffer areas. 3 3. All areas of soil disturbance resulting.from this project shall be stabilized immediately following project completion or prior to permit expiration,whichever comes first. The approved methodology is stabilization of the entire disturbed area with appropriate vegetation, such as grasses, etc. 4. The storage of construction equipment and materials shall be confined to within the project work site and or upland areas greater than 100 linear feet from the tidal wetland boundary. 5. Disturbance to the natural vegetation or topography greater than 25 feet seaward of the approved structure , is prohibited. 6. Necessary erosion control measures i.e., haybales,silt fencing, etc.are to be placed on the downslope edge of any disturbed area. This sediment barrier is to be put in place before any disturbance of the ground occurs and is to be maintained in good condition until thick vegetative cover is established. 7. Roof runoff shall be directed to drywells a minimum of 100 feet landward of the tidal wetland boundary for immediate on-site recharge. 8. Parish Drive, Southold To the Board of Appeals: I live directly across the street from the Dash property. I have received written notice of the application for variance to increase the degree of non-conformance in the front yard of the above property and for a variance to extend into the side yard. After reviewing the file at the Town Hall concerning this matter, I wish to place the following comments into the record. First: I most sincerely welcome the Dash's to beautiful Southold and wish them full enjoyment of their scenic property. Second: I take no position on the proposed variance for one-story additions to the existing property. I will rely upon the expertise of the Board of Appeals in carrying out their assigned responsibilities. Third: I am quite concerned about the Topographic Survey in the Board of Appeals file that proposes a two-story addition. (See attached) It appears that this addition is no longer being pursued. However, it is my opinion that if the existing application for variance is granted, a future addition of a second story would create a very large two story house that would overwhelm the property by being too close to the road and to the side property line. To address this very real possibility, I am requesting that if the Board approves the existing variance application, the approval contain clear and unambiguous language that any second story additions would be a non-conforming use of the variance, thus requiring another application to the Board of Appeals.
