Meeting held on Wednesday, May 17, 2006:
RESOLVED, that the Southold Town Board of Trustees APPROVE the Amendment to
Permit #6205 to expand the width of a boat ramp from 8' to 10' and add 8' angled extension to
return as per plans prepared by En-Consultants, Inc. amended 4/27/06.

Dear Mr. Herrmann:
The Board of Town Trustees took the following action during its regular meeting held on
Wed., September 21, 2005 regarding the above matter:
WHEREAS, En~Consultants, Inc. on behalf of JAMES MURRAY & SUSAN SEGUR
applied to the Southold Town Trustees for a permit under the provisions of Chapter 97
of the Southold Town Code, the Wetland Ordinance of the Town of Southold,
application dated January 27, 2005 and,
WHEREAS, said application was referred to the Southold Town Conservation Advisory
Council for their findings and recommendations, and,
WHEREAS, a Public Hearing was held by the Town Trustees with respect to said
application on September 21, 2005, at which time ail interested persons were given an
opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are familiar with the
premises in question and the surrounding area, and,
WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application, and,
WHEREAS, the structure complies with the standards set forth in Chapter 97 of the
Southold Town Code,
WHEREAS, the Board has determined that the project as proposed will not affect the
health, safety and general welfare of the people of the town,
NOW THEREFORE BE IT,
RESOLVED, that the Board of Trustees approve the application of JAMES MURRAY &
SUSAN SEGUR to remove the existing 8', 16', 67', 17', 14', and 38' sections of timber
bulkhead and construct (up to 2' farther landward and 18" higher) +/-6', +/-83', +/-30',
and +/-38' sections of vinyl bulkhead; remove and replace (inkind/inplace) existing 8'X
22' timber boat ramp; remove 3'X 9' wood walk; remove and replace (and raise 18")
existing 3'X 14' wood walk and 10'X 17' fixed dock; remove existing 3' walkway along
bulkhead and construct (up to 2' farther landward and 5" higher) 4' walkway along new
bulkhead; and dredge approx. 335 cy. of sand spoil from area up to 32' seaward of new
bulkhead to a maximum depth of-3'ALW, approx. 40 cy. of which will be used on-site
as backfill and 295 cy. of which will be trucked off-site to an approved upland source,
with the condition a turbidity screen is installed before any activity begins, and all as
depicted on the plan prepared by En-Consultants, Inc. last dated September 6, 2005.
Permit to construct and complete project will expire two years from the date the permit
is signed. Fees must be paid, if applicable, and permit issued within six months of the
date of this notification.
Inspections are required at a fee of $50.00 per inspection. (See attached schedule.)

At the meeting of the Southold Town Conservation Advisory Council held Mon.,
.February 14, 2005, the following recommendation was made:
Moved by Don Wilder, seconded by William Cook, it was
RESOLVED to recommend to the $outhold Town Board of Trustees APPROVAL WITH
A CONDITION of the Wetland Permit application of JAMES MURRAY & SUSAN
SEGUR to remove and replace (in-place) approx. 160 linear ft. of existing timber
bulkhead (including 8' northerly return) with vinyl bulkhead (to be raised 18" higher than
existing); remove and replace (in-kind/in-place) existing 8'X 22' timber boat ramp;
remove and replace (and raise 18") existing 3'X 9' wood walk, 3'X 14' wood walk, and
10'X 17' fixed dock; and dredge approx. 300 cy. of sp~fil from area up to 30'off bulkhead
to a maximum depth of-3' ALW, approx. 70 cy. of which will be used as backfill and
approx. 230 cy. of which will be trucked off-site to an approved upland source.

The CAC recommends Approval of the application with the Condition no treated lumber
is used.

Remove existing 8', 16', 67', 17', 14', and 38' sections of existing timber bulkhead and
construct (up to 2 feet farther landward and 18" higher) +6', +83', +30', and +38' sections of
vinyl bulkhead; remove and replace (in-kind/in-place) existing 8' x 22' timber boat ramp;
remove 3' x 9' wood walk; remove and replace (and raise 18") existing 3' x 14' wood walk and
10' x 17' fixed dock; remove existing 3' walkway along bulkhead and construct (up to 2 feet
father landward and 5" higher) 4' walkway along new bulkhead; and dredge approximately 335
cubic yards sand spoil from area up to 32 feet seaward of new bulkhead to a maximum depth of-
3'ALW, approximately 40 cubic yards of which will be used on-site as backfill and 295 cubic
yards of which will be tracked off-site to an approved upland source, all as depicted on the
project plan prepared by En-Consultants, Inc., last dated 9/6/05.

En-Consultants, Inc. on behalf of JAMES MURRAY & SUSAN SEGUR requests a Wetland
Permit to remove and replace (in-place) approx. 160 linear ft. of existing timber bulkhead
(including 8' northerly return) with vinyl bulkhead (to be raised 18" higher than existing);
remove and replace (in-kind/in-place) existing 8'X 22' timber boat ramp; remove and replace
(and raise 18") existing 3'X 9' wood walk, 3'X 14' wood walk, and 10'X 17' fixed dock; and

The reconstruction of the bulkhead, in-kind, is an exempt Minor Action and not subject to
LWRP review pursuant to Chapter 95 of the Town of Southold Town Code. This review will
address the dredging of 300 c. y. of"spoil". The proposed action is within a listed NYSDEC
Critical Environmental Area.
The proposed action has been reviewed to Chapter 95, Waterfront Consistency Review of the
Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy
Standards. Based upon the information provided on the LWRP Consistency Assessment Form
submitted to this department, as well as the records available to me, it is my recommendation
that the proposed action is generally CONSISTENT with the Policy Standards and
therefore is CONSISTENT with the LWRP provided the following best management
practice is applied;
1. If feasible, durinu re-construction of the structure, encircle the entire oroiect area
with a floatinu turbidity screen to minimize turbidity in the water colomn~
Pursuant to Chapter 95, the Board of Trustees shall consider this recommendation in preparing
its written determination regarding the consistency of the proposed action.

All applicants for permits* including Town of Southold agencies, shall complete this CCAF for
proposed actions that are subject to the Town of Southold Waterfront Consistency Review Law. This
assessment is intended to supplement other information used by a Town of Southold agency in
makin4 a determination of consistency. *Except minor exempt actions including Building Permits
and other minister~al permits not located within the Coastal Erosion Hazard Area.
Before answering the questions in Section C, the preparer of this form should review the exempt
minor action list, policies and explanations of each policy contained in the Town of Southold Local
Waterfront Revitalization Program. A proposed action will be evaluated as to its si~ificant

Dear Mr. Kmpski:
In accordance with our discussions during our on-site meeting at the captioned property in
March, please' find enclosed (3) copies of a project plan revised to depict the relocation of the
new marina bulkhead up to 2 feet farther landward of the location of the existing bulkhead to be
removed and the replacement of the three-foot walkway along the bulkhead with a four-foot
walkway adjacent to the new bulkhead. As discussed, this redesign also eliminates two of the
"jogs" that are currently present at and to the south of the fixed dock to be replaced. Finally,
please note that the landward relocation of the bulkhead will creme approximately 35 more cubic
yards of spoil to be dredged and approximately 30 fewer cubic yards that will be needed as
backfill.
I have enclosed a project description revised accordingly, along with a completed LWRP
Consistency Assessment Form. Would you kindly schedule this public heating to be reopened at
your upcoming September meeting.
