Southampton, NY 11968 RE: JAMES MURRAY & SUSAN SEGUR 1900 PECONIC BAY BLVD., LAUREL SCTM#145-4-3 Dear Mr. Herrmann: The Board of Town Trustees took the following action during its regular meeting held on Wed., September 21, 2005 regarding the above matter: WHEREAS, En~Consultants, Inc. on behalf of JAMES MURRAY & SUSAN SEGUR applied to the Southold Town Trustees for a permit under the provisions of Chapter 97 of the Southold Town Code, the Wetland Ordinance of the Town of Southold, application dated January 27, 2005 and, WHEREAS, said application was referred to the Southold Town Conservation Advisory Council for their findings and recommendations, and, WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on September 21, 2005, at which time ail interested persons were given an opportunity to be heard, and, WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area, and, WHEREAS, the Board has considered all the testimony and documentation submitted concerning this application, and, WHEREAS, the structure complies with the standards set forth in Chapter 97 of the Southold Town Code, WHEREAS, the Board has determined that the project as proposed will not affect the health, safety and general welfare of the people of the town, NOW THEREFORE BE IT, RESOLVED, that the Board of Trustees approve the application of JAMES MURRAY & SUSAN SEGUR to remove the existing 8', 16', 67', 17', 14', and 38' sections of timber bulkhead and construct (up to 2' farther landward and 18" higher) +/-6', +/-83', +/-30', and +/-38' sections of vinyl bulkhead; remove and replace (inkind/inplace) existing 8'X 22' timber boat ramp; remove 3'X 9' wood walk; remove and replace (and raise 18") existing 3'X 14' wood walk and 10'X 17' fixed dock; remove existing 3' walkway along bulkhead and construct (up to 2' farther landward and 5" higher) 4' walkway along new bulkhead; and dredge approx. 335 cy. of sand spoil from area up to 32' seaward of new bulkhead to a maximum depth of-3'ALW, approx. 40 cy. of which will be used on-site as backfill and 295 cy. of which will be trucked off-site to an approved upland source, with the condition a turbidity screen is installed before any activity begins, and all as depicted on the plan prepared by En-Consultants, Inc. last dated September 6, 2005. Permit to construct and complete project will expire two years from the date the permit is signed. Fees must be paid, if applicable, and permit issued within six months of the date of this notification. Inspections are required at a fee of $50.00 per inspection. (See attached schedule.) The proposed action has been reviewed to Chapter 95, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposed action is generally CONSISTENT with the Policy Standards and therefore is CONSISTENT with the LWRP provided the following best management practice is applied; 1. As discussed, this redesign also eliminates two of the "jogs" that are currently present at and to the south of the fixed dock to be replaced. Finally, please note that the landward relocation of the bulkhead will creme approximately 35 more cubic yards of spoil to be dredged and approximately 30 fewer cubic yards that will be needed as backfill. I have enclosed a project description revised accordingly, along with a completed LWRP Consistency Assessment Form.
