Dear Mr. Pirkh
The Board of Town Trustees took the following action during its regular meeting held on
November 17, 2004 regarding the above matter:
WHEREAS, Design Development LLC on behalf of ANTHONY & BARBARA
BONAGURA applied to the Southold Town Trustees for a permit under the provisions
of Chapter 97 of the Southold Town Code, the Wetland Ordinance of the Town of
Southold, application dated October 26, 2004, and,
WHEREAS, said application was referred to the Southold Town Conservation Advisory
Council for their findings and recommendations, and,
WHEREAS, a Public Hearing was held by the Town Trustees with respect to said
application on November 17, 2004, at which time all interested persons were given an
opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are familiar with the
premises in question and the surrounding area, and,
WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application, and,
WHEREAS, the structure complies with the standards set forth in Chapter 97 of the
Southold Town Code, ' '
WHEREAS, the Board has determined that the project as proposed will not affect the
health, safety and general welfare of the people of the town,
NOW THEREFORE BE IT,
RESOLVED, that the Board of Trustees approve the application of ANTHONY &
BARBARA BONAGURA to construct first and second floor additions to the existing
dwelling, cut back existing porch, construct new covered porch, new second-floor
covered deck, new frame and brick garage, new covered carport, all with the condition
drywells and gutters are installed to contain the roof run-off, and as depicted on the plan
prepared by Thomas J. Pirkl last dated October 25, 2004. The seaward half of the
existing rear yard deck must be removed, or remove the entire deck.
Permit to construct and complete project will expire two years from the date the permit
is signed. Fees must be paid, if applicable, and permit issued within six months of the
date of this notification.
Inspections are required at a fee of $50.00 per inspection. (See attached schedule,)

At the meeting of the Southold Town Conservation Advisory Council held Tues.,
November 9, 2004, the following recommendation was made:
Moved by Jack McGreevy, seconded by Don Wilder, it was
RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL WITH
A CONDITION of the Wetland Permit application of ANTHONY & BARBARA
BONAGURA to construct first and second floor additions to the existing dwelling, cut
back existing porch, construct new covered pomh, new second-floor covered deck, new
frame and brick garage, new covered carport, and to legalize the existing rear yard deck
on grade.

The CAC recommends Approval of the application with the Condition drywells are
installed to contain the roof run-off and the installation of a storm-water run-off control
system.

Further to our correspondence dated August 27, 2004, we are writing as the architects for Mr. and
Mrs. Anthony Bonagura to request either a non-jurisdictional letter with respect to their proposed
additions to the existing home at the above location, which fronts on Mattituck Creek, or in the
alternative, a wetlands permit to proceed with the project. In support of our request, enclosed
herewith please find original and two copies of the following:
Board of Trustees Application;
Short Environmental Assessment Form;
Proposed Notice to Adjacent Property Owners;
Owners' Authorization;
Transactional Disclosure Form;
Topographical Survey dated to August 19, 2004; and
Plot Plan and Sanitary Profile dated to October 22, 2004.
Om application with the Suffolk County Depai;ment of Health is pending. We have also submitted
an application to the NYS DEC, since a portion of the construction on the south side of the home
is at a grade slighdy below ten feet. The finished elevation of the first floor, however, is just over
thirteen feet. A new sanitary system will be located on the north side of the house where the grade

Department standards. The DEC has assigned an analyst and a field inspection of the site is
expected shortly.
