Mattituck, NY 11952 Re: CLEARING VIOLATION 155 BREAKWATER ROAD, MATTITUCK SCTM# 113-3-4 Dear Mr. Sherlock: As per the Board of Trustees site visit on May 11, 2005 the following are the agreed upon terms of remediation of the clearing violation in the buffer area of the above referenced property: 1. Place a line of staked haybales along the required buffer area, 10' from the existing deck/house, towards the wetland area, as indicated on the attached plan. 2. Plant the area between the haybale line and the wetland with native, indigenous trees, shrubs, and ground cover, with no turf, fertilizers, or chemicals used in this area. 3. Complete the enclosed amendment to your existing Trustee house permit, with a planting plan for the cleared area. This must be complete by June 1, 2005, in order to be filed for the June 22, 2005 Trustee hearing. 4. There will be 2 inspections; one to check the location of the haybale line, and the second one at the completion of the plantings. 5. There is a $100 fee for the amendment application and an additional $50 fee for each inspection. Enclosed is a list of approved plants for a buffer area to a fresh water wetland. These plants are available at Talmage in Riverhead. Also check the New York State Department of Environmental Conservation's website, under Nursery. They sell many of these plants. Please contact this office if you have any questions regarding the plantings or the completion of the amendment application. Sincerely, Heather Tetrault Environmental Technician Cc: E.
