RESOLVED, that the Southold Town Board of Trustees APPROVE the Amendment to
Permit #5829 to reconfigure and relocate approved, upgraded sanitary system from 68'
to 80' from wetlands. Remove and replace (in-place) approx. 87 linear ft. of existing
timber bulkhead with vinyl bulkhead; remove and replace and raise by 18" (in-place)
existing 8'X 17' step-down platform; backfill with approx. 15 cy. of clean sand fill to be
trucked in from an upland source; and re-vegetate disturbed buffer area with native
grasses and shrubs, and all as depicted on the plan prepared by En-Consultants, Inc.
dated February 14, 2006.

TOWN OF SOUTHOLD
At the meeting of the Southold Town Conservation Advisory Council held Wed., March
15, 2006, the following recommendation was made:
ROSEMARY & SEBASTIAN AVOLESE to Amend Permit #5829 to reconfigure and
relocate approved, upgraded sanitary system from 68' to 80' from wetlands. Remove
and replace (in-place) approx., 87 linear ft. of existing timber bulkhead with vinyl
bulkhead; remove and replace and raise by 18" (in-place) existing 8'X 17' step-down
platform; backfill with approx. 15 cy. of clean sand fill to be trucked in from an upland
source; and re-vegetate disturbed buffer area with native grasses and shrubs.

The CAC did not make an inspection, therefore no recommendation was made.

ROSEMARY & SEBASTIAN AVOLESE requests an Amendment to Permit//5829 to
reconfigure and relocate approved, upgraded sanitary system from 68' to 80' from wetlands.
Remove and replace (in-place) approx. 87 linear ft. of existing timber bulkhead with vinyl
bulkhead; remove and replace and raise by 18" (in-place) existing 8'X 17' step-down platform;
backfill with approx. 15 cy. of clean sand fill to be trucked in from an upland source; and re-
vegetate disturbed buffer area with native grasses and shrubs. Located: 4150 Wunneweta Rd.,

The reconstruction of the bulkhead, in-kind, is an exempt Minor Action and not subject to
LWRP review pursuant to Chapter 95 of the Town of Southold Town Code. This review will
address the backfilling of the bulkhead with 15 c. y. fill and relocation of existing sanitary
system.
The proposed action has been reviewed to Chapter 95, Waterfront Consistency Review of the
Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy
Standards. Based upon the information provided on the LWRP Consistency Assessment Form
submitted to this department, as well as the records available to me, it is my recommendation
that the proposed action is generally CONSISTENT with the Policy Standards and
therefore is CONSISTENT with the LWRP provided the following best management
practice is applied;
To further the intent of the LWRP and the policies~ assess the proiect area for the
use of a floating turbidity screen silt/boom during re-construction activities of the
structure to minimize turbidity in the water column.
Pursuant to Chapter 95, the Board of Trustees shall consider this recommendation in preparing
its written determination regarding the consistency of the proposed action.
Correspondingly, the potential impact of any Unlisted Action on the environmental
characteristics of the Coastal Environmental Area is a relevant area of environmental
concern and must be evaluated in the determination of significance prepared pursuant to
Section 617.7 of SEQR.

and relocate farther from wetlands the upgraded sanitary system approved by that permit and to
remove and replace an existing timber bulkhead with a vinyl bulkhead.
Because pursuant to Town Code §95-5(A) and the corresponding definitions of "action" and
"minor action" by §95-3, the submission of a LWRP Consistency Assessment Form is not
required for the bulkhead replacement (i.e., a "maintenance or repair involving no substantial
changes in an existing structure or facility"), our LWRP application references only the proposed

proposed actions that are subject to the Town of Southold Waterfront Consistency Review Law. Tliis
