Dear Mr. Cavanagh:
The Board of Town Trustees took the following action during its regular meeting held on
Wednesday, February 25, 2004 regarding the above matter:
WHEREAS, THOMAS CAVANAGH applied to the Southold Town Trustees for a permit
under the provisions of Chapter 97 of the Southold Town Code, the Wetland Ordinance
of the Town of Southold, application dated February 4, 2004 and,
WHEREAS, said application was referred to the Southold Town Conservation Advisory
Council for their findings and recommendations, and,
WHEREAS, a Public Hearing was held by the Town Trustees with respect to said
application on February 25, 2004, at which time all interested persons were given an
opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are familiar with the
premises in question and the surrounding area, and,
WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application, and,
WHEREAS, the structure complies with the standards set forth in Chapter 97 of the
Southold Town Code,

WHEREAS, the Board has determined that the project as proposed will not affect the
health, safety and general welfare of the people of the town,
NOW THEREFORE BE IT,
RESOLVED, that the Board of Trustees approve the application of THOMAS
CAVANAGH to replace in-kind the existing bulkhead within 18", dock and steps,
maintenance dredge, and install a new 4'X 20' floating dock, install a 10' non-turf buffer
landward of the bulkhead, install a Iow sill bulkhead at the bluff and planted with
Spartina alterniflora, and as depicted on the site plan prepared by Thomas F.
Cavanagh, AIA last dated Mamh 8, 2004.
Permit to construct and complete project will expire two years from the date the permit
is signed. Fees must be paid, if applicable, and permit issued within six months of the
date of this notification.
Inspections are required at a fee of $5.00 per inspection. (See attached schedule.)

On 2/4/0~, my application for a Wetlands Permit to replace, inkind/inplace the existing
bulkhead, fixed dock and steps, maintenance drMge, and install a new floating dock at
the above address was respectfully submitted to the Board of Towia Trustees.
My Hearing on Wetland Applications is scheduled for 2/25/04.
Thc site was inspected by the Town Trustees on Friday 2/20/04.
My review of the Application Instructions, Board of Trustees Policies, as well as the
proposed Local Law 2004, raised a few questions for which I request clarification.
Rather than raise these questions at thc hearing, being respectful of The Boards time, I
have documented my concerns as indicated below.
1. Thc Board ailows for a one time request to exteuad the existing bulkhead seaward.
This would be of help in using the spoils as backfill. How do I request this
consideration?
2. The plans currently indicate removal and disposal of the existing dock and
bulkhead. As thc plans are developed and priced, it may be advantageous from an
ertvirollrnental mid/or an economical perspective, to leave the existing bulkhead in
place arid build in front of the abandoned structure. How do I request this
consideration?
3. During the course of planning and construction there maybe times when
consultation is appropriate with the Town Trustees to ensure compliance. How do
I submit my questions?

chaired by the Board of Trustees, Town of Southold. The application was conditionally
approved based on required modifications. A copy of the correspondence to the Board of

Maintainance Dredging Permit has been previously granted to the Wunneweta Pond
Association.
If so, please provide proof of prior dredging.
1) Wunneweta Pond Association permit from DEC expired 12/31/03. En Consultants has
applied for new permit. Survey is underway as requested by DEC.
2) Wunneweta Pond Association permit from Southold Trustees in effect till 2009.
3) Wunneweta Pond Association permit from Army Corp of Engineers in effect till 2005
Please prov-ide profile plan of in kind/in place replacement of existing dock and
proposed floats showing AHW/ALW and water depth. This can be done on the same
plan as the dredging profile if you wish.

The bluff stairs appear to be proposed to be made ofconcrele on grade, but this is
not "in kind" as indicated on plans since the steps are currently wood. Please
correct.
The term "in kind" is used to reflect that steps are being replaced with steps. The
definition used is as clarified by the Board of Trustees Town of Southold They state that
"in kind" does not necessarily mean with the same materials. The use of concrete is
proposed in lieu of CCA or creosote treated lumber as being an environmentally
preferred option.

After our phonc conversation about your neighbors desfre to erect it guzebo on the
waterfront of his property, ! wanted to express my concern surrounding the situation.
First, it is unfortunate that your neighbor would not compromise and place the gazebo at
the other end of Ms property. Second, and most important, that your vtew of the water will
be interrupted by the struemr~ We all love Nassau Point for its s~roltlt~ and natural
beauty, and I thought we had adequate safeguards fn place to insm'e that bufldi~tgs were
not erected to alter that vfew.

The Wunnewete Pond As$ocation 0NPA) was organized in 1977 and includes as members all property
owners with property on Wunnewe~e Pond. At present their are 34 property Owners in the WPA.
in addition to providing and arranging for the cars and maintenance of the pond's ~hennet and bulkheads,
the purpose of the WPA, as stated in it's co~sUtution, L~ to prevent abuse of the pond to the delriment of their
members, Further, the Association represents the membership in proceedings before the Town, the County,
and the State and Federal agen,'ie~, in pure,Jif of the above purposes.
In my capasity as President of the As~-ocialton, and on behalf of our membemhip, I am writing to the
Board to document our cenoam for the residual effeofs that approval of the re~'e~need ameridment will have on
our pond community.
'i'he construction and placement of the proposed gazebo is entirely inoonoletent w~th the landscape Of
our pond community. AIIOwanoa of such ath. lctums within the individual property's watertront violate~ town
setback requirements. The cumula[Ive affect of such approvaJs will $o negatively impact the Town's general
environmental conoams on our wat~re' edge and aa such, is wholly inconsistent with the national and local
con,em for both protection and utilization of our natural resoumas.
On behalf of Association, I ask that the Board determine that the~. are virtually no benefits to allowing
this $1~'ucture. Whereas, the reasonaly foreseeable negative impact of this structure, and similar structures,
located on our waterfronts, is of great magnitude to our eemrnunlty and our town. We request that the applicant's
pal~it with regard to the proposed gazebo be denied.

As adjacent property owners, we have been notified that our neighbor, the applicant; Thomas
Cavanagh is requesting to amend the referenced permit to include the addition of a boardwalk along
the newly constructed bulkhead. Additionally, the applicant is requesting permission to construct
a gazebo directly abutting this boardwalk which will place the gazebo 6 feet from the bulkhead.
The gazebo, as designed, is approximately 10 feet in diameter and ;[4 feet hi~h. A 6 foot high roof
is supported by 4 columns which are 8' in diameter.
Although we see no objection to the construction of the boardwalk, we are strongly opposed to
the proposed structure and it's placement so near to the bulkhead for several reasons.
We are genuinely concerned about preserving the natural beauty of our coastal waterways on
on the North Fork. The allowance of such structures defaces the aesthetics of our presently untouched
landscape. The development of our waterfronts threatens the preservation that we work so hard to
retain through your Board, as well the Department of Environmental Conservation and the U8 Army
Corps of Engineers.
We request that the Board consider the substance of this request and rule consistent with the
goals and objectives of Southold Town with respect to the protection of our natural resources as well a:
the reasonably foreseeable detriments to our community's landscape.
