SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this
application and determines that this review falls under the Type II category of the State's List of Actions,
without an adverse effect on the environment if the project is implemented as planned.
PROPERTY FACTS/DESCRIPTION: The applicant's 10,531 sq. ft. parcel has 75 feet along Locust
Lane and 137.84 feet along L'Hommedieu Lane. The property is improved with a two-story dwelling
and accessory frame garage as shown on the July 16, 2004 survey prepared by Peconic Surveyors,
BASIS OF APPLICATION: Building Department's January 12, 2005 Notice of Disapproval, citing
Sections 100-33B, in its denial of a building permit application for approval of an "as built" accessory
structure (containing a shower), for the reason that the construction is less than three feet from the
side property line.
FINDINGS OF FACT
The Zoning Board of Appeals held a public headng on this application on March 3, 2005 at which
time written and oral evidence were presented. Based upon all testimony, documentation, personal
inspection of the property, and other evidence, the Zoning Board finds the following facts to be true
and relevant:
AREA VARIANCE RELIEF REQUESTED: The applicant is requesting a setback variance
concerning the 'as built' construction of a 6' x 9' accessory (shower) structure located one foot from
the northerly (side) property line as shown on the July 16, 2004 survey, amended November 30,
2004 by Peconic Surveyors, P.C.
REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and
personal inspections, the Board makes the following findings:
1. Grant of the variance will produce an undesirable change in the character of the neighborhood or
a detriment to nearby properties. The applicant's as-built structure contains a shower facility for use
by family members, and built one foot from the property line, adjacent to the neighbor's residence to
the north. The applicant's dwelling is situated at the northeasterly portion of the property closer to

Locust Lane. The yard area is open and unobstructed, available for the applicant to properly locate
an accessory structure to meet the code's minimum setback requirement.
2. The benefit sought by the applicant can be achieved by some method, feasible for the applicant
to pursue, other than an area variance. This accessory structure can be relocated to meet the code
required setbacks at least three feet from the side lot line, without a variance.
3. The variance requested herein is substantial, representing 50%, or greater reduction, from the
code-required three ft. setback.
4. The difficulty was self-created.
5. Evidence has been submitted to suggest that the shower structure at the requested location will
have some ~impact on the physical or environmental conditions in the neighborhood.
RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing
test under New York Town Law 267-B, motion was offered by Chairwoman Oliva, seconded by
Member Simon, and duly carried, to
DENY the vadance requested.
This action does not authorize or condone any current or future use, setback or other feature of the
subject property that may violate the Zoning Code, other than such uses, setbacks and other
features as are expressly addressed in this action.
Vote of the Board: Ayes: Members Oliva (Chairwoman), Goehringer, Dinizio, and Simon.
Member Orlando. This Resolution was d~ly adopted (4-1).

addition six months. Thereafter, a new permit shall be required.

Dear Mr. Rellis,
I have been retained by Barbara Kellc to assist her in obtaining the approvals for the detached
shower structure in the rear yard of 690 Locust Avenue, Southold.
Please find attached the certified drawing of the structure by James Deerkoski, PE. As can be
seen from the drawing the shower drains onto the surface of the ground and is not connected to the
subsurface sanitary system. According to the Suffolk County Sanitary Code - Article 7; shower water
nor the sink water is defined "sewage" and as such is not required to be piped into a private sewage
disposal system and does not require an approval from the Suffolk County Health Department.
Ms. Kellc will be applying for a variance to the Southold Town Zoning Board for the side yard
setback variance.

Re:Kellc building permit application
Dear Mike:
We modified the location of the outdoor shower from that
location submitted to you with the building permit application. I
believe it remains conforming, however, we would request an amended
building permit or letter reflecting that the proposed location is
conforming. We have a contract with the builder to relocate the
structure and he is awaiting confirmation that the proposed
location is acceptable.
