Meeting held on Wed, September 20, 2006:
RESOLVED, that the Southold Town Board of Trustees APPROVE the Emergency
Amendment to Permit #5688 to repair the northeast corner of the existing retaining wall
with plastic sheathing, which collapsed during a heavy rainfall.
This is not a determination from any other agency.

Dear Mr. Schwartz:
The Board of Town Trustees took the following action during a Regular Meeting, held on
January 22, 2003 regarding the above matter.
WHEREAS, Mark Schwartz on behalf of Arnold & Geraldine Barton applied to the
S outhold Town Trustees for a permit under the provisions of the Wetland Ordinance of the Town
of Southold, application dated January 2, 2003
WHEREAS, said application was referred to the Southold Town Conservation Advisory Council
for their findings and recommendations, and
WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on
January 22, 2003 at which time all interested persons were given an opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are familiar with the premises in
question and the surrounding area, and,
WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application, and,
WHEREAS, the structure complies with the standard set forth in Chapter 97-18 of the Southold

Town Code.
WHEREAS, the Board has determined that the project as proposed will not affect the health,
Safety and general welfare of the people of the town.
NOW THEREFORE BE IT,
RESOLVED, that the Board of Trustees approved the application of.,trnold & Geraldine Barton
for Wetland Permit to construct cribbed retaining walls bring in new clean fill with revenue slope
and new site drywell for runoff drainage recharge into existing grade with the condition the wall
be placed ten feet - as per new plans - stamped dated 1/24/03
BE IT FURTHER RESOLVED that this determination should not be considered a determination
made for any other Department or Agency, which may also have an application pend'mg for the
same or similar project.
Fee must be paid, if applicable and permit issued within six months of the date of this
notification.
If inspections are required, at a fee of $5.00 per inspection (See attached schedule).

The Southold Towfl BOard of Trustees reviewed the survey dated September 19, 2002 an altered
on 12/30/02 to indicate proposed structure determined that the structure to be out of the Wetland
Jurisdiction trader Chapter 97 of the Town Wetland Code.
Therefore,' in accordance With the current Tidal Wetlands Code (Chapter 97) and the
Coastal Erosiotl Hazard Area (Chapter 37) no permit is required. Please be advised however that
no construction~ sedimentation, or disturbance of any kind may take place seaward of the tidal
wetlands jurisdictional boundary or seaward of the coastal erosion hazard area as indicated
above, without a permit. Itls your responsibi~t~ to ensure that all necessary precautions are
taken to prevent any Sedimentation of other ~tior~ or disturbance to the ground surface or
