The Board of Town Trustees took the following action during its regular meeting held on
Wed., July 20, 2005 regarding the above matter:
WHEREAS, Charles R. Cuddy, Esq. on behalf of BIEL ASSOCIATES, LLC applied to
the Southold Town Trustees for a permit under the provisions of Chapter 97 of the
Southold Town Code, the Wetland Ordinance of the Town of Southold, application
dated May 25, 2005 and,
WHEREAS, said application was referred to the Southold Town Conservation Advisory
Council for their findings and recommendations, and,
WHEREAS, a Public Hearing was held by the Town Trustees with respect to said
application on July 20, 2005, at which time all interested persons were given an
opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are familiar with the
premises in question and the surrounding area, and,
WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application, and,
WHEREAS, the structure complies with the standards set forth in Chapter 97 of the
Southold Town Code,
WHEREAS, the Board has determined that the project as proposed will not affect the
health, safety and general welfare of the people of the town,
RESOLVED, that the Board of Trustees approve the application of BIEL ASSOCIATES,
LLC to construct a single-family dwelling and to remove the existing sanitary system
and install a new sanitary system on the landward side of the dwelling, with the
conditions of a 50' non turf, non disturbance buffer landward of the bulkhead that would
allow for no use of fertilizers or pesticides in that buffer, the jetty on the west side be
removed, the shed be removed, haybales placed at the 50' non disturbance buffer,
drywells to contain roof runoff, and all as depicted on the plan prepared by John
Schnurr, PLLC, last dated October 12, 2005.
Permit to construct and complete project will expire two years from the date the permit
is signed. Fees must be paid, if applicable, and permit issued within six months of the
date of this notification.
Inspections are required at a fee of $50.00 per inspection. (See attached schedule.)
This is not a determination from any other agency.

Dear Members of the Board of Trustees:
We own the property at 1355 Watersedge Way, adjacent to 1315 Watersedge Way where
Biel Associates proposes to build a 3-4 bedroom home. Our home was built on our
property in the late 196o's. We sent an e-mail to you on June 2o regarding our concerns,
at that time, regarding this proposed plan. We would like to again mention some of
these concerns as well as an added concern about the bulkhead at this time:
1. The high tide mark as shown on the survey prepared for Biel Associates is incorrect.
The tide hits our bulkhead and also hits the adjacent bulkhead and at high tide is up to at
least 2' on the bulkhead and higher in a storm or in certain calendar seasons. We have a
basement in our home. We often have flooding in our basement and not just during a
storm. How can the proposed site have a crawlspace over such a high water table?
2. We have some serious concerns about the placement/proximity of the cesspools to
our fresh water well and our sanitary system. They appear to be too close to the required
distances from our property line and septic and water systems.
3. The bulkhead and the jetty on the applicant's property appear to be in disrepair.
There is sand seeping out behind the bulkhead along the entire run of it. We are
concerned about the environmental issues this raises as well as the affects on our
bulkhead and the safety of ourselves and friends and family.

Dear Members of the Board of Trustees:
As homeowners of the property at 1365 Watersedge Way we would like to express a number
of concerns and questions regarding Bid Associates proposal to build a 3-4 bedroom home
adjacent (i.e., directly behind) to our home. As Trustees, we understand that you oversee
any activities, including the "structural improvement to property along the shoreline of the
Town within 100 feet of wetlands or open water". We are hoping that you carefully review
our concerns and give thoughtful consideration to our questions and suggestions regarding
the above-referenced apphcation.
1. The application by Bid Associates is premature as the Southold Town Zoning Board
needs to grant approval for the current proposed location of their house. To this end, there
are two critical setback issues:
i) Since the Biel Associates property has a bulkhead, the setback from the water
(l,itfle Hog's Neck Bay) to the current back of the proposed home should be 75'. The
measurement as reflected on the survey map is incorrect. Please refer to point #2 of James
C. Reilly's June 23, 2005 letter to the Board of Trustees regarding the Bid application. Also,
if the setback should be 75' by Southold Town Code, what factors would influence the
Trustees to agree to a 25' variance on such a setback?
(ii) The second setback issue is two-fold: (a) The current side yard setback from the
fight of way on the west side of the Biel Associates property is measured incorrectly. We
consulted the Southold Building Department and received confirmation of this fact. The
survey shows a 38' setback from the middle of the right of way. Thc Code specifies that the
measurement of a minimum of 35' as a setback from a right of way (easement) should be
taken from the edge of the fight of way and not from the middle of the right of way.
Measuring this setback correctly would necessitate mo~mg the western edge of the
proposed house 9.5' to the east.
(b) A second, but related, issue was raised by the Building Department upon review
of the survey. Since the right of way would be the sole egress/street for the proposed
home, the Building Department would require that the front of the proposed home face that
egress and not the side of the house as currently drawn on the survey map. In this case, thc
current setback of 12' on the east side of the property' would need to be adjusted to 35' to
create thc proper back yard setback. The current front and back yard setbacks fur thc
proposed home, therefore, xvould need to be adjusted respectively to correspond to the
revised location of thc proposed home.
2. The current survey shows an elevation of 14' for the first floor yet the existing Biel
Associates property has a maxkmum elevation of 10.8'. We can only assume that their plan is
to build up the home 4' above the current level of the property. We can only conjecture that
this would be accomplished by a fill of topsoil. How will this fill affect the flood pattern of
the area as it e~sts and what are the effects on our properVy- as we xvould be at a substantially
lo~ver level than the proposed structure would be?
3. We have some serious concerns regarding the sanitary systems on both the Biel
Associates property and consequently, our property:
(a) The leecking pools (i.e., cesspools) proposed for the Biel Associates home are
currently located just 5' from our back yard property fine. This is of great concern to us as
an environmental/health issue. Could these be located further away from our property line?
(b) Our current sanitary system is located at the eastern edge of the right of way.
Surely, should a home be approved for construction by Biel Associates at 1315 Watersedge
Way, the massive equipment required to build such a structure would need to use the
easement to access their property. This surely will have a most adverse affect on our sanitary
system and possibly our water fine. How will our rights and property be protected from
damage?
4. What rights Biel Associates have to construct a water line under the right of way on ()ur
property is still to be determined and is of great interest to us. It seems inconceivable that
the owner of an adjacent property, should have any right to tear up our land or build on our
land regardless of the purpose.
5. Your file on this application contains an application by Biel Associates stating that one of
the permits they possess is a "DEC letter of non-jurisdiction". Our research of aerial
photographs of this area taken in the 1970's indicates no bulkhead exists on this property
prior to 1977.
Wc look forward to expressing our views, concerns and questions at the Board of Trustees
meeting on July 20, 2005.

The survey submitted had the location of the shed and existing sanitary systems not
in the current locations.
The high water mark was indicated at 'N 650 19' 30" W, which appears as if the
location is 25' from the bulkhead. The survey of my property, which was done in
1998, has the medium high water mark at 73o 50' 20" W, which puts the tide just shy
of the bulkhead (picture #1). High tide (picture #2) is on the bulkhead.

Dear Heather, I am in receipt ora certified letter pertaining to the lot directly adjacent to my dwelling.
The attached map does not appear to have the correct information on it. My concerns as far as my
property are as follows:
1. The existing well shown is an older well that was abandoned and a new well was
drilled significantly closer to the utility pole at the comer of my lot. This would
significant impact on the distance to the proposed septic system.
2. The high water mark as shown is clearly outdated. At high tide the high
water mark is half the height of my existing bulk heading.
3. The proposed structure was not staked out for our review prior to June
21, 2005, and thereby makes my inspection impossible to be conducted by
your June 22, 2005 hearing.
4. I also question the location of my existing septic, I do not have the field
notes on hand, but I can locate them within a reasonable time frame.
My septic system is significantly closer the right of way as I recall.
5. I don't have the current building setbacks, but it appears that the
proposed structure is not suited to the lot. It is 4.44 times greater than the
existing deteriorated shed. If the proposal does meet the front, rear and
side yard town criteria, it certainly would appear to violate the set back
from the high water mark, which 1 thought was 100'.
In summary, if any variance is required for the proposed dwelling I wish that it be
known at this time I would not be in favor of granting it.

The proposed action involves the construction of a single family residence, remove old sanitary
and replace with new sanitary system on landward side of dwelling. The parcel is located on Hog
Neck Bay in REACH 7.
The proposed action has been reviewed to Chapter 95, Waterfxont Consistency Review of the
Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy
Standards. Based upon the information provided on the LWRP Consistency Assessment Form
submitted to this department, as well as the records available to me, it is my recommendation
that the proposed action is generally CONSISTENT with the Policy Standards and
therefore is CONSISTENT with the LWRP provided that the following standard best
management practices are implemented.
1. Require erosion and sediment controls (haybales, silt fencing) to protect the wetland
system to the east of the property.
2. Require water quality protection measures for areas generating runoff (gutters,
downspouts, dry wells and pervious driveways).
In addition to further protect ground water quality and conserve water supply to the greatest
extent possible it is recommended that the Board encourage the following best management
practices for landscaping and lawn establishment post construction:
1. Require native landscaping to minimize irrigation and fertilizer applications.
2. Require disease-resistant and drought-tolerant plants (where possible).
3. Retain existing vegetation within non-disturbed buffers to minimize lawn areas.
Pursuant to Chapter 95, the Board of Trustees shall consider this recommendation in preparing
its written determination regarding the consistency of the proposed action.
