Dear Ms. Mitcheh
The following action was taken by the Southold Town Board of Trustees at their Regular
Meeting held on Wednesday, March 17, 2010:
RESOLVED, that the Southold Town Board of Trustees APPROVE the Amendment to
Wetland Permit #6228 to construct a 4' wide boardwalk along the landward side of the
existing bulkhead and to trim the phragmites to 12", as needed, and as depicted on the
revised site plan prepared by Teri Mitchel, received on February 18, 2010, and stamped
approved on March 17, 2010.
Phragmite Special Conditions: Trimming does not include mowing to ground level.
Do not disturb native vegetation during the hand cutting of Common Reed (Phragmites
australis), including but not limited to; Eastem Red Cedar (Juniperus virginiana),
Northern Bayberry (Myrica pensylvanica), Marsh Elder (Iva frutescens), and Groundsel
Bush (Baccharis halimfolia).
Any other activity within 100' of the wetland boundary requires a permit from this office.
This is not a determination from any other agency.

Dear Mr. King:
Attached please fred an application to amend the captioned Wetlands Permit due to a request by
the New York State Department of Environmental Conservation that one +18' section of
bulkhead in the "North Marina" be replaced on its seaward side rather than on its landward side
due to the presence of some vegetation on the landward side of that section of bulkhead.
Pursuant to §95-5(A) and the corresponding definitions of"action" and "minor action" by §95-3,
the submission of a LWRP Consistency Assessment Form is not required for this application for
amendment, as the proposed work involves only the "maintenance or repair involving no
substantial changes in an existing structure or facility." Therefore, an LWRP CAF is not
attached hereto.

approx. 226 linear ft. of existing timber bulkhead on the South Marina, with vinyl
bulkhead and backfill with approx. 18 cy. sand spoil to be maintenance dredged from ·
most southeasterly boat slip (to max. depth of -4' ALW). Remove and replace
(inkind/inpiace) existing floating docks attached to existing bulkhead and existing shed
landward of bulkhead, with the conditions that the backfill will not exceed 6" below the
top of the bulkhead, there will be a 12' non tug buffer landward of the North Marina
bulkhead, and a 10' non turf buffer landward of the South Marina bulkhead, and a

Dear Mr. Herrmann:
The Board of Town Trustees took the following action during its regular meeting held on
Wednesday, October 19, 2005 regarding the above matter:
WHEREAS, En-Consultants as agent for LAUGHING WATER PROPERTY OWNERS
ASSOCIATION applied to the Southold Town Trustees for a permit under the provisions
of Chapter 97 of the Southold Town Code, the Wetland Ordinance of the Town of
Southold, application dated September 28, 2005, and
WHEREAS, said application was referred to the Southold Town Conservation Advisory
Council for their findings and recommendations, and,
WHEREAS, a Public Hearing was held by the Town Trustees with respect to said
application on October 19, 2005 at which time all interested persons were given an
opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are familiar with the
premises in question and the surrounding area, and,
WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application, and,
WHEREAS, the structure complies with the standards set forth in Chapter 97 of the
Southold Town Code,

WHEREAS, the Board has determined that the project as proposed will not affect the
health, safety and general welfare of the people of the town,
RESOLVED, that the Board of Trustees approve the application of LAUGHING WATERS
PROPERY OWNERS ASSOCIATION to resheathe (on the landward side) approx. 264 linear ft.
of existing timber bulkhead on the North Marina with vinyl bulkhead and backfill with approx. 65
cy. of clean sand fill to be trucked in from an upland source, and remove and replace
(inkind/inplace) existing shed landward of the bulkhead. Remove and replace (in-place) approx.
226 linear ft. of existing timber bulkhead on the South Marina, with vinyl bulkhead and backfill
with approx. 18 cy. sand spoil to be maintenance dredged from most southeasterly boat slip (to

LAUGHING WATERS .PROPERS' OWNERS ASSOC. requests a Wetland Permit to resheathe
(on the landward side) approx. 264 linear ft. of existing timber bulkhead on the North Marina
with vinyl bulkhead and backfill with approx. 65 cy. of clean sand fill to be trucked in from an
upland source, and remove and replace (inkind/inplace) existing shed landward of the
bulkhead. Remove and replace (in-place) approx. 226 linear ft. of existing timber bulkhead on
the South Marina, with vinyl bulkhead and backfill with approx. 18 cy. sand spoil to be
maintenance dredged from most southeasterly boat slip (to max. depth of-4' ALVV). Remove
and replace (inkindlinplace) existing floating docks attached to existing bulkhead and existing
shed landward of bulkhead. Located: 555 Minnehaha Blvd. & 2360 Minnehaha Blvd., Southold.

The reconstruction of the bulkhead, in-kind, is an exempt Minor Action and not subject to
LWRP review pursuant to Chapter 95 of the Town of Southold Town Code. This review will
address the backlllling of the bulkhead with 65 e.y. and 18 c.y. of clean ~l and the
dredging of the 18 c.y. of fill from the most southeasterly boat slip.
The proposed action has been reviewed to Chapter 95, Waterfront Consistency Review of the
Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy
Standards. Based upon the information provided on the LWRP Consistency Assessment Form
submitted to this department, as well as the records available to me, jt is my recommendation
that the proposed action is generally CONSISTENT with the Policy Standards and
therefore is CONSISTENT with the LWRP provided the following best management
practice is applied;
To further the intent of the LWRP and the policies, assess the project area for the
use of a floating turbidity screen silt/boom during re-construction of the structure to
minimize turbidity in the water column.
Pursuant to Chapter 95, the Board of Trustees shall consider this recommendation in preparing
its written determination regarding the consistency of the proposed action.

Attached please find an application for a Town Wetlands Permit to maintain existing bulkheads
and one of the existing boat slips at the captioned marina properties.
Pursuant to §95-5(A) and the corresponding definitions of"action" and "minor action" by §95-3,
the submission of a LWRP Consistency Assessment Form is not required for this application, as
ail of the proposed work--including the maintenance dredging of one of the boat slips, which
was previously authorized and undertaken in 1999 pursuant to Town Wetlands Permit 4933--
involves only the "maintenance or repair involving no substantial changes in an existing
structure or facility." Therefore, an LWRP CAF is not enclosed herewith.

Resheathe (on landward side) approximately 264 linear feet of existing timber bulkhead with
vinyl bulkhead and backfill with approximately 65 cubic yards of clean sand fill to be trucked in
from an upland source. Remove and replace (in-kind/in-place) existing shed landward of
bulkhead.
"South Marina:"
Remove and replace (in-place) approximately 226 linear feet of existing timber bulkhead with
vinyl bulkhead and backfill with approximately 32 cubic yards of clean sand fill to be trucked in
from an upland source and with approximately 18 cubic yards sand spoil to be maintenance
dredged from most southeasterly boat slip (to max. depth of-4'ALW). Remove and replace (in-
kind/in-place) existing floating docks attached to existing bulkhead and existing shed landward
of bulkhead.
