Dear Mr. Costello:
The Board of Town Trustees took the following action during its regular meeting held on
Wed., May 18, 2005 regarding the above matter:
WHEREAS, Costello Marine Contracting Corp. on behalf of PAUL MALONEY applied
to the Southold Town Trustees for a permit under the provisions of Chapter 97 of the
Southold Town Code, the Wetland Ordinance of the Town of Southold, application
dated February 7, 2005 and,
WHEREAS, said application was referred to the Southold Town Conservation Advisory
Council for their findings and recommendations, and,
WHEREAS, a Public Hearing was held by the Town Trustees with respect to said
application on May 18, 2005, at which time all interested persons were given an
opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are familiar with the
premises in question and the surrounding area, and,
WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application, and,
WHEREAS, the structure complies with the standards set forth in Chapter 97 of the
Southold Town Code,
WHEREAS, the Board has determined that the project as proposed will not affect the
health, safety and general welfare of the people of the town,
NOW THEREFORE BE IT,
RESOLVED, that the Board of Trustees approve the application of PAUL MALONEY to
remove and replace the existing 4'X 25' catwalk inkind/inplace and install access stairs
at the off-shore end, with the condition the fence parallel to the creek is removed, and
all as depicted on the plans prepared by Costello Marine Contracting Corp. last revised
September 1, 2005.
Permit to construct and complete project will expire two years from the date the permit
is signed. Fees must be paid, if applicable, and permit issued within six months of the
date of this notification.
Inspections are required at a fee of $50.00 per inspection. (See attached schedule.)

At the meeting of the Southold Town Conservation Advisory Council held Tues., March
15, 2005, the following recommendation was made:
Moved by Don Wilder, seconded by Tom Schlichter, it was
RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL WITH
A CONDITION of the Wetland Permit application of PAUL MALONEY to remove the
existing 4'X 25' catwalk and dispose of same. Replace with new 4'× 25' catwalk, in-kind
leading to a 32"X 16' ramp onto a 6'X 20' floating dock secured by (2) 2-pile dolphins.

Dear Costello Marine Contracting:
The Department of Environmental Conservation (DEC) has completed its review of your client's
Tidal Wetlands application for permit to reconstruct a catwalk, and install a ramp, float and
pilings, and we have the following comments.
The DEC objects to the current proposal because your application falls to meet the several
standards for permit issuance pursuant to Tidal Wetlands Land Use Regulations (6NYCRR Part
661) as explained be]ow.
Department staff conducted an inspection of the property and found the depths shown on the plan
to be inaccurate. Staff found the depth on the seaward side of the proposed float to be -2 feet
below apparent low water and the maximum water depth in the channel to be -3 feet below
apparent low water. Highly biologically productive tidal wetlands exist at the site. These
shallow water areas provide valuable habitat for a variety of marine invertebrates, bait fish,
migratory fish and water fowl. In addition, the area acts as a nursery for juvenile finfish. During
access and egress of vessels from the proposed dock, propeller turbulence and turbidity plumes
would continually chum up and destroy the valuable benthic habitat. The lack of water depth
would pose the potential fo~' future dredging and destruction of this bottom habitat. The
proposed float would cause shading impacts and would rest on the bottom habitat, causing
compaction impacts. These potential disturbances would result in significant impacts to the
existing and potential values of this tidal wetland for marine food production and wildlife habitat,
as well as other values associated with tidal wetlands. Therefore, the project does not meet the
standard for permit issuance as per section 661.9(b)(1)(i).
The site plan submitted does not accurately depict the existing conditions north of the proposed
structure. Department staff found that an intertidal marsh island exists 60 feet north of the
shoreline. Due to the existence of this island, the Department finds that the propoged structure
will extend into the creek approximately 45% of the creek's total width. This will create a
navigation and safety hazard to boaters using the creek. Therefore, the proposal is not
compatible with the public's health and welfare and the proposal does not meet the standard for
permit issuance pursuant to section 661.9(b)(1)(ii).
We also find that the proposed dock does not meet the standard for permit issuance pursuant to
Part 661.9(b)(1)(iii). Specifically, the proposal is not reasonable and necessary taking into'
account that reasonable alternatives exist. A catwalk with a set of stairs at the seaward end may
be constructed over the vegetated tidal wetland area.
In order to avoid the Department's objections, we suggest you revise the plans as indicated
above. Be advised, the revised plans must accurately depict all existing conditions, including the
correct water depths and the island 60 feet north of the shoreline. Please submit 5 copies of
revised plans. You must respond to this request in writing.

3. That the project which is subject to Environmental
Review under Chapters 32, 37, or 97 of the Town Code is
open to public comment on Wednesday, March 23, 2005 on or
about 7:00 pmk. You may contact the Trustees Office at 765-

The above referenced proposal is under review of the Board
of Trustees of the Town of Southold and does not reference
any other agency that might have to review same proposal.
