Dear Mr. Samuels:
The Board of Town Trustees took the following action during its regular meeting held on
Wednesday, October 19, 2005 regarding the above matter:
WHEREAS, Samuel and Steelman Architects on behalf of WALTER GITLIN applied to
the Southold Town Trustees for a permit under the provisions of Chapter 97 of the
Southold Town Code, the Wetland Ordinance of the Town of Southold, application
dated September 15, 2005, and
WHEREAS, said application was referred to the Southold Town Conservation Advisory
Council for their findings and recommendations, and,
WHEREAS, a Public Hearing was held by the Town Trustees with respect to said
application on October 19, 2005 at which time all interested persons were given an
opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are familiar with the
premises in question and the surrounding area, and,
WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application, and,
WHEREAS, the structure complies with the standards set forth in Chapter 97 of the
Southold Town Code,
WHEREAS, the Board has determined that the project as proposed will not affect the
health, safety and general welfare of the people of the town,
RESOLVED, that the Board of Trustees approve the application of WALTER GITLIN to
renovate the existing residence with a first and second floor addition and new on-grade
stone terrace with the conditions of drywells to contain roof runoff, haybales during
construction, and a 20' non turf buffer landward of the wetland line, and all as depicted
in the plan prepared by Samuels and Steelman and last dated 9/9/05.
Permit to construct and complete project will expire two years from the date the permit
is signed. Fees must be paid, if applicable, and permit issued within six months of the
date of this notification.
Inspections are required at a fee of $50.00 per inspection. (See attached schedule.)

WALTER GITLIN requests a Wetland Permit to renovate the existing residence with a first and
second floor addition and new on-grade stone terrace and a new garage. Located: 1180 Smith
Drive South, Southold. SCTM# 76-3-12.1. The structure currently exists and is located in the
"AE Elevation 8 Flood Zone"; an area of Special Flood Hazard. There is no opportunity to
relocate the structure out if the AE 8 flood zone. The Applicant proposes surface water controls
(line ofhaybales) and subsurface drainage systems to further Policy 5.
The proposed action has been reviewed to Chapter 95, Waterfi'ont Consistency Review of the
Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy
Standards. Based upon the information provided on the LWRP Consistency Assessment Form
submitted to this department, as well as the records available to me, it is my recommendation
that the proposed action is generally CONSISTENT with the Policy Standards and
therefore is CONSISTENT with the LWRP.
Pursuant to Chapter 95, the Board of Trustees shall consider this recommendation in preparing
its written determination regarding the consistency of the proposed action.
