Dear Mr. Kraus:
The Board of Town Trustees took the following action during its regular meeting held on
Wednesday, October 19, 2005 regarding the above matter:
WHEREAS, ALLEN KRAUS applied to the Southold Town Trustees for a permit under
the provisions of Chapter 97 of the Southold Town Code, the Wetland Ordinance of the
Town of Southold, application dated September 23, 2005, and
WHEREAS, said application was referred to the Southold Town Conservation Advisory
Council for their findings and recommendations, and,
WHEREAS, a Public Hearing was held by the Town Trustees with respect to said
application on October 19, 2005 at which time all interested persons were given an
opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are familiar with the
premises in question and the surrounding area, and,
WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application, and,
WHEREAS, the structure complies with the standards set forth in Chapter 97 of the
Southold Town Code,
WHEREAS, the Board has determined that the project as proposed will not affect the
health, safety and general welfare of the people of the town,
RESOLVED, that the Board of Trustees approve the application of ALLEN KRAUS to
construct a 28' x 60' single family dwelling, on site sewage disposal system, and
pervious driveway with the condition of a line of staked haybales on the northern
property line and the west side of the project, 50' non turf buffer, and roof drains and
drywells to contain all run off, and all as depicted on the plans surveyed by John Ehlers
and last dated 1/22/03.
Permit to construct and complete project will expire two years from the date the permit
is signed. Fees must be paid, if applicable, and permit issued within six months of the
date of this notification.
Inspections are required at a fee of $50.00 per inspection. (See attached schedule.)
This is not a determination from any other agency.

Regarding the above matter, which the Board is conSidering
tomorrow, September 24, we wish to reassert our belief that
proposed action, and all the proposed construction for lots 78, 79,
110. and 111 in Peconic will negatively impact the environlllent of
the area.
The proposed well and construction are very closed to Autu/3l.n
Pond, a freshwater pond that provides drainage for a large
catchment area. We believe that this construction is too clo~ to
this important freshwater wetland, and should therefore not be
built.
A sluice pipe runs between Autumn Pond and Goldsmith Inlet
exactly in front of the proposed CODstruction. The last time
building took place on Second Avenue. the sluice pipe was
damaged, and residents of the area experienced significant
flooding for many months. As heavy machinery will have to cross
the pipe system for this proposed constructioD, it is likely, it not
inevitable, that the pipe will again be damaged, resulting agllin in
significant flooding for tbe residents of Second Avenue, and for
major Town expenditure to repair it.

construct a 28'X 60' single-family dwelling, on-site sewage disposal system and pervious
driveway, with the condition of a 50' buffer consisting of 30' non-disturbance from the edge of

We wish to go on record regarding the above matter. The
information submitted by Catherine Mesiano, applicant's
"expediter,>> is incorrect in the following ways:
1. The house adjacent ro the proposed construction at 230 Second
Avenue is not, as listed, a ~Seasonal residence." It is a fully
heated, year-round home, used frequently during winter
months.
2. "Well and septic unknown.>> This information is a matter of
record, and is available on town maps in the Southold Town
Office. In addition, we, as owners, supplied Mr. Kraus With this
information, showing him the exact location of theSe systems.
We cannot attend tonight'S meeting, but wish to go on record that,
like many of our fellow citizens of Southold, we are concerned
about the limitations on potable water in the area. Second Avenue
has significant drainage problems, and is subject to flOOding. We
are also concerned about the environmental impact of an
additional dwelling close to Autumn Pond, a designated wetland.
Each structure in the area has the potential to inflict
environmental damage on what is an extremely sensitive and
critical environment.

ALLEN KRAUS requests a Wetland Permit to construct a 28'X 60' single-family dwelling, on-
site sewage disposal system and pervious driveway. Located: 110 Second Ave., Peconic.
SCTM#67-4-20.6.
THE TAX MAP ON THE SURVEY IS INCORRECT.
The structure is located in the AE elevation 11 flood zone. The lowest proposed elevation
of the structure is approximately 7' NGVD. Surface and subsurface hydrologic flow is
expected to be towards Second Avenue. THE LOCATION OF THE PERVIOUS
DRIVEWAY APPEARS TO BISECT WETLAND VEGETATION IN AN AREA THAT
THE 2001 AERIAL PHOTOS SHOWS ALSO AS FLOODED (ATTACHED).
ADDITIONALLY THE DRIVEWAY IS LOCATED OVER A DRAIN PIPE NOT ON
THE SUBJECT PROPERTY.
The proposed action has been reviewed to Chapter 95, Waterfront Consistency Review of the
Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy
Standards. Based upon the information provided on the LWRP Consistency Assessment Form
submitted to this department, as well as the records available to me, it is my recommendation
that the proposed action is INCONSISTENT with the following Policy Standards and
therefore is INCONSISTENT with the LWRP. The Board should assess any adverse
impacts to the adjacent properties and require any necessary amendments to make the
action consistent with the LWRP.
The proposal does not support Policy 4.1 "Minimize losses of human life and
structures from flooding and erosion hazards." The following management
measures to minimize losses of human life and structures from flooding and
erosion hazards are recommended:
A. Minimize potential loss and damage by locating development and structures
away from flooding and erosion hazards.
Pursuant to Chapter 46 of the Town of Southold Town Code, FEMA Flood
Insurance Rate Map (FIRM) and the Flood Insurance Rate Map for Suffolk
County, New York; THE BOARD SHOULD HAVE THE APPLICANT
DETERMINE WHETHER ANY PROPOSED DEVELOPMENT/GRADE
CHANGES IN AN AREA OF SPECIAL FLOOD HAZARD MAY RESULT IN
PHYSICAL DAMAGE TO ANY OTHER PROPERTY OF LOWER
ELEVATION.
2. Additionally, pursuant to Chapter 46 of the Town of Southold Town Code:
C. Encroachments.
(1) Within Zones A1 - A30 and AE, on streams without a regulatory floodway,
no new construction, substantial iml~rovements or other develooment (including
fill) shall be I~ermitted unless:
(a) The applicant demonstrates that the cumulative effect of the proposed
development, when combined with all other existing and anticipated
development, will not increase the water surface elevation of the base flood more
than one (1) foot at any location; or
(b) The Town of Southold agrees to apply to the Federal Emergency
Management Agency (FEMA) for a conditional FIRM revision, FEMA approval
is received and the applicant provides all necessary data, analyses and mapping
and reimburses the Town of Southold for all fees and other costs in relation to
the application. The applicant must also provide all data, analyses and mapping
and reimburse the Town of Southold for all costs related to the final map
revision. THE APPLICANT HAS NOT DEMONSTRATED THE ABOVE AND
SHOULD BE REQUIRED TO DO SO.
3. The proposal does not show erosion and sediment controls (haybales, silt
fencing) for the non-disturbance area during construction.
Pursuant to Chapter 95, the Board of Trustees shall consider this recommendation in preparing
its written determination regarding the consistency of the proposed action.

LWRP CONSISTENCY ASSESSMENT FORM
A. INSTRUCTIONS
All applicants for permits* including Town of Southold agencies, shall complete this CCAF for
proposed actions that are subject to the Town of Southold Waterfront Consistency Review Law. This
assessment is intended to supplement other information used by a Town of Southold agency in
making a determination of consistency. *Except minor exempt actions including Building Permits
and other ministerial permits not located within the Coastal Erosion Hazard Area.
Before answering the questions in Section C, the preparer of this form should review the exempt
minor action list, policies and explanations of each policy contained in the Town of Southold Local
Waterfront Revitalization Program. A proposed action will be evaluated as to its significant
beneficial and adverse effects upon the coastal area (which includes all of Southold Town).
If any question in Section C on this form is answered "yes", then the proposed action may affect the
achievement of the LWRP policy standards and conditions contained in the consistency review law.
Thus, the action should be analyzed in more detail and, if necossapj, modified prior to making a
determination that it is consistent to the maximum extent practicable with the LWRP policy
standards and conditions. If an action cannot be certified as consistent with the LWRP policy
standards and conditions, it shall not be undertaken.
