Ehlers dated January 26, 2006 and determined the proposed construction of a one-car garage to be out of the Wetland jurisdiction under Chapter 97 of the Town Wetland Code and Chapter 37 of the Town Code. Therefore, in accordance with the current Tidal Wetlands Code (Chapter 97) and the Coastal Erosion Hazard Area (Chapter 37) no permit is required. Please be advised, however, that no construction, sedimentation, or disturbance of any kind may take place seaward of the tidal wetlands jurisdictional boundary or seaward of the coastal erosion hazard area as indicated above, or within 100' landward from the top of the bluff, without further authorization from the Southold Town Board of Trustees pursuant to Chapter 97 and/or Chapter 37 of the Town Code. It is your responsibility to ensure that all necessary precautions are taken to prevent any sedimentation or other alteration or disturbance to the ground surface or vegetation within Tidal Wetlands jurisdiction and Coastal Erosion Hazard Area, which may result from your project. Such precautions may include maintaining adequate work area between the tidal wetland jurisdictional boundary and the coastal erosion hazard area and your project or erecting a temporary fence, barrier, or hay bale berm. r 2 This determination is not a determination from any other agency. If a second story is added to her small cottage, my home wiU suffer a significarrt d scraase in Eastern morning light as well as view of Arshamomaque Pond upon H rich both homes are located. Both of my bedrooms ors located on the Eastern side o my home and this wonderful morning light is a big part of why I enjoy my home so n uch. It is also of major value to the property and would be very important were I to s .II this hame_ Losing this light and having a large home within a few feet would s ~nificantly decrease my property's market value. C ur homes are only 30 feet apart. In fad, the land upon which the 5chpoont cottage i~ located was, until, 1974, my cottage's side yard. The previous owners sold off this I~ nd Irti 1974 and their boat house was pu#led up from the pond and turned into what is now the Schpoon# cottage. 1 will attend the Dec. 17 meeting and provide p iotographs which clearly show how close these homes are. T ~e proposed addition to the Schpoont cottage will reach a center ridge line height of 24 feet, significantly blocking my light and view. Most of the homes on this side of n ,r private road are low bungalow-type structures and the few 1.5 and 2-story homes tl at have been built have large side yards that separate them from their neighbors. I~ closing, 1'd like #o say that as much as I regret upsetting my neighbors, I must p otect my property's value acid the quality of life !enjoy in it.
