Section 3. It is hereby determined that~subdivision 21(a) of paragraph a of Section 11.00 of the Local Finance Law applies to such object ~or purpose, and.that the period o£ probable ~sefulness thereof, isAthirty years, but the maturity of the capital note hereby authorized will not exceed five years. ~ Section~4. It is hereby determined that. no down pa~ment~ isAnecessary in connection'.with the aforesaid object oE purpose. Section-5.-~The..faith and credit of the Town of Southold, Suffolk County, New York, arehereby irrevocably pledged.to the~ payment of. the principal of and .interest on such note. An amount sufficient to pay the principal and interest on such capital note shall-be included in~the, annual'~budget and levied as a part of~.the taxes~ for the fiscal ~ear in which the same matures. Section 6. Subject to~ the provisions of the Local FinanceLaw, the power to sell such note~is hereby delegated to the Supervisor, the chief fiscal officer. Such note~ shall he.of such terms, form and contents, and shall be sold in such manner, as may be pre- scribed by the Supervisor, consistent with the~provisions of the Lo~al Finance Law. . Section 7. The~v~iidity of such note may be contested only if~:(1): Such-note isauthorized_for an object or purpose for which said Town of Southold is not authorized.to expend money, and_ (2) The provisions of law which should be complied with at the date of publication of. this resolution are not substantially, complied with, and an. action% suit or proceeding contesting~.such ~alidity ~secommenced.within twenty days after the date of'such publication, or (3:) Such note is authorized in-violation of the. provisions: of the constitution. Section 8.
