Councilman Valentine Tuthill Moved by Justice Clark , WHEREAS, the proposed Local Law No. seconded by fore introduced by Justice Clark and pursuant to a resolution, public hearing was held on the matter of the adoption of the following local law on September 7, 1967, at 7:30 P.M. in the Supervisor's Office, 16 South Street, Greenport, New York, at which interested persons were given an opportunity to be heard, and WHEREAS, this Board deems it in the best interest that the following local law be enacted, now, therefore BE IT ENACTED that the following local law be enacted: 1 - Year 1967 was hereto- T©~li OF S(,UTHOLD LGCAL LAW NO. I - YEAR A local law eetabtiehin~ a housin~ code for the Town of ~outhold. $ 104 Be it enacted by the Town Board of the Town of ~outhold as follows: RI~SIDENTIA L PRICMISES ARTICLIi I General Provisiona TITLE TI~ Local Law shall be known as "The Housin~ Code of the Town of $outhold." TI~ pul'pole Of th~ Code il to provide he, Lc and uniform Ita~darc~ governln~ the condition, occupancy and maintenance of residential premises, and establishin~[ rea~onabla ~afe[u&rd~ for the safety, health and welfare of the occupants and uamr~ thereof. ~.FFECTIYE DATE This Local Law shall take effect ten (10) days from the date of filler with the Secretary of ~tate. This Code ab. all apply to residential premises as follows: a) Lots, plots or parcels of land on which residential building, buildings of mixed occupancy or acceuory structures are located; b) Residential buildings, includin~ one- und two-family dwellings and multiple dwellings, except as specifically excluded in Section 195; ~ i07 c) Residential ~ccupancies in buildings of mixed occupancy; and ct) Accessory structures~ accessory to residential occupancies. NON-A PPLICABILITY This Code shaf~ not apply to mobile homes and mobile home courts, c,r to transient type occupa.cies and uses including, but not limited to: nursing and convalescent homes, h tels, motels, tourist camps, farm labor camps, travel trailers and trailer parks, and other forms of temporary housing. Y~ £~PLICATI©N a - The provisions of this Code shall supersede local laws, ordinanceS. codes, or regulations to the ex~e:'~t that such laws. ordinances, codes or regulations are inconsistent with the provisions of this Code, provided that n thing herein contained shall be construed to prevent the adoption and enforcement of a law, ordinance, co~le or regulation which is more restrictive or establishes a higher standard than those provided in thio C de, and such more restrictive requirement or higher standard shall govern during the period in which it is in e ffe ct. b - '~here a provisio; of this Code is found to be in conflict with a provision of a zoning building, electrical, plumbing, fire, safety, health, water supply or sewage disposal law or ordinance, c,r regu- latinn adopted pursuant thereto, or other local law ordinance, code or regulation, the provision, or requirement which is the more re strictive or which establishes the higher standard shall prevail. k/t~l~ t':RENC~ TO NE~ YOB. Miscellaneous l~equirements a - Dwelling units shall be separated from each other and from other spaces outside the dwelling unit. ~ - Sleeping rooms within dwelling units shall be separated from each other and from other spaces outside the sleeping rooms to provide privacy. c - Lodgin~ units shall be separated from each other and from other spaces outside the lodging units. d - A communal kitchen or dininf room in a lodging house shall be accessible to the occupants sharing such kitchen or dining room without going through a dwellini~ unit or lodging unit of another occupant. PUBLIC SPACE Height Public space shall have a minimum hei/]ht of 6 feet 10 inches measured ~rom finished floor to finished ceiling. -10- ii Sm4 Light and Ventilation a - Public spaces shall be provided with arti/~icial light. b - In public stairs stairways and pa~sageway~ artificial light shall be electric li~hting aval[able at all times Bo as to afford safe passage for occupants and users. Such lighting shall conform to the following: (i) A sufficient number of fixtures shall be provided so that the d/stance between fixtures Il not more than 30 feet and so that no wall is more than i 5 feet distant from a fixture. (2) Incandescent lighting shall be based on n~t less than l 14 watt per square foci of floor area, except that each fixture shall have a lamp or lamps with a total of not less than 35 watta. (3) Fluorescent lighting shall be ba~ed on not Iisi than watt per square fo~, of floor area, except that each ~'ixture shall have a lamp or lamps of a total of not leea than 15 watts. (4) Where Lmder these formulas the calculated wattage does not correspond to that of a standard lamp, the next lar~er size shall be used. c - Public spaces shall be provided with either natural ventilation, conforming to the requirements for habitable space, or with mech- anical ventilation. Such mai ~tenance shall eonsist of repairs .~f roo:'lng, flashings, waterproof coaih~gs or other suitable meene. e - Structural members shall be maintained so as to be structurally sound. Such protection shall consist of shorin{ reinforcement, repair where necessary, frequent deairuction of termite tubes or othei' appropriate means. b - Chimneys and flues shall be maintained so as to be structurally sound and to prevent leakage of &,asea into the structure. Sueh m~in- tenance shall consist of clearing flue stoppages, sealing open joints, repairing masonry where necessary end other ettttable means. c - Ceilings and wells shall be maintained so that peris which become loose :~r defective do not conStitute a hazard to occu~ents. Such ~naintenance shall consLst of removing and replacin~ loose or defec- tive sections. ~ - Toilet room and bathroom floors shall be maintained so as to prevent leakage of water through the floor, under norms! conditions ~f ,,es and [~oor washing, and resultant deterioraticm or defects in structural members and ceilings below. :~a~intenance shall coaaist ~f repairs which effectively provide the moisture and waterproof qualities req~.lred for the particular floor. ARTICLE IV Fire-Safety Requirements i:'R,OHmlT~O AccuMULATIONS ANO STOR~, ,0~- It shall be prohibited: (1) to eccumulete or store on residentiel premises, except in -14- approved locations, any highly flammable or explosive matter, such as paints, volatile oils, cleaning fluids and similar materials, or any combustible refuse liable to spontaneous combustion, such as waste paper, boxes, rags or similar materials; aha (2) to accumulate or store materials on fire escapes or stairs, in stairways or passageways, at doors or windows, or in any other locations where in the event of fire such materialS may obstruct e~ress of occu~ants or interfere with fire- fighting operations. i, IRaPLAC.~ a - Fireplaces and similar construction used, or intended to be used ~or burning fuei in open fires shall be connected to approved chimneys! and shall be installed so that nearby or adtacent combustible material and structural members shall not be heated to unsafe temperatures, t~ - Hearths and limings or other paris of fireplaces exposed directly ~o flame shall be of materials that will not melt, disintegrate, spall, ~,~r shatter at high temperat,,res. c - V,,ood mantels and trim on fireplaces shall be placed and attached itc that they canno~ be heated to unsafe temperatures or l~Ttited by sparks or embers from the fire.
