Alberts~n, at Greenport, New York, with the following present: Supervisor Albertson; Councilmen Demarest and Valentine; Justices Tuthill and Clark; Supt. of Hig~ays Dean; Town Attorney .Tasker and Town-Clerk Richmond. The Hearing on the Preliminary Budget for the year 1968 was opened by th~ Supervisor at 3:00 P.M. and the minutes were taken by Barbara Dimmannn. Moved by Justice Clark; seconded by Councilman Demarest; WHEREAS, the Town Board of the Town of Southold, New York~ has met at the time and place specified in the notice of public hearing on the pre- liminary budge~, and heard all persons desiring to be heard thereon; now, THEREFORE, BE IT RESOLVED: That the Town Board of the Town of Southold does hereby adopt such preliminary budget as originally compiled, as the annual budget of this Town for the fiscal year beginning on the 1st day of January, 1968~ and that such budget as so adopted be entered in de- tail in the minutes of the proceedings of this Town Board, and befit FURTHER RESOLVED: That the Town Clerk of the Town of Southold shall pre- pare and certify, in duplicate, copies-of said ann~al budget as adopted by the Town Board of the Town of Southotd, together with the estimates, if any, adopted pursuant to Section 202-a, subdivision 2, of the Town Law, and ~detiver one copy thereof to the Supervisor of l his Town to be presentedl by him to the Board of Supervisors of the County of Suffolk. Albertson, Town of Southold, be and he hereby is authorized to sign the following agreement: SETTLEMENT AGREEMENT This agreement, made the 2nd day of November, 1967, by'and between TOWN OF SQUTHOLD, Southold, N.Y. party of.the first part, and the COUNTY OF SUFFOLK, A Municipal Corporation of t~e State Of New York, party of the second part, in manner f611owing: WHEREAS~ the said party of the first part was the owner of the foll~ing described reeal property, situate, lying and being in Town of Southold, county.~of Suffolk, State of New York, as shown on Map No. 175 of~Map Showing Property. to be Acquired fore'the Reconstruction of C. R. 27 Riverh~ad-Greenport Road. In consideration, and upon payment WY the County of Suffolk $3,000 'THREE THOUSAND and no/100 ....... SDollars, and other good and valuable consideration as herein set forth, the said party of the first part and each of them so hereby release the said County.of Suffolk from any further claims for compensation and/or damages as to the taking of said property which he ever had against the County of Suffolk. Moved by Councilman Valentine; seconded by Councilman Demarest; whereas, this Board deems it in the public interest and in the promotion of the health, safety, moral or general welfare of the Town of Southold that certain premises west of Greenport, n.y., Town of Southold, County of Suffolk, hereinafter more fully described be re~oned and zoned to "M" Multiple Dwelling District, NOW, THEREFORE, BE IT RESOLVED: That the Building Zone Ordinance of the Town Of Southold, including the Building Zone Maps, forming a part thereof, be amended by the Town Board on its own motion, by changing from "B" Bus~ness and non-conforming uses to "M" Multiple District on the following described property: BEGINNING at the intersection of the westerly line of Silvermere Road with the southerly line of a 20 foot private road known as "Silver Lane"; from said point of ~eginning running across said Silvermere Road in the direct extension easterly of said southerly line, S. 85o31'40" E-50.92 feet to the easterly line of said Silvermere Road; thence continuing in said direct extension easterly through land of Jurzenia, S. 85© 31' 40" E.-600.0 feet; thence through said land of Jurzenia at right angles to the last described course, S. 4© 28' 20" W.-500 fee~ more or less, to ordinary high water mark of Pipes Cove; Thence westerly along said high water mark, 860 feet more or less, to land of Steinmetz; thence along said land of Steinmetz, N. 13°45' 00" E.-695 feet more or tess, to said southerly line of "Silver Lane"; Thence along said southerly line, S. 85 31' 40" E.-198.74 feet to the point of beginning. A letter was,read from the $outhold Town Trustees requesting the extension of the appointment of William Januic~i Bay ~nstable, Town of Southold, for policing of regulations and permits of the Town Trustees as regards dredging, docksj bulkheads and moorings. The Town Board agreed to this request ~and wilt notify Mr. Januick of the extension of his appointment. Mr. John Fo Rapp appeared~before the Board to request a sidewalk-on Oaklawn Avenue, Southold, and street lights on Gardiner's Lane,~ Southold. One ('1) ~5~MVOH street light on-NYTCO pole ~7, Aldrich Lane &~Route 25, ~aurel, N.Y. On Westphalia Road, Mattituck, N.Y.-place 175 MVOH street lights (.removing cp lights whenever necessary)"on the following poles: NYTCO pole ~6, LILCO pole ~10, NYTCO pole ~21, NYTCO pole ~27, pole'S29½, N/fTCO pole ~8 and NYTCO pole ~56, Vote of Town Board: ~yes-Supervisor Albertson; Councilmen Demarest and Valentine; Justices Tuthzll and Clark.
