BE tT RESOLVED, by the Town Board of the Town of Southold, Suffolk County, New York, as follows: Section 1. The Town of Southold, in the County of Suffolk, New York, hereby authorizes the acqUisition by purchase of a certain piece or parcel of land bounded on the north by Manhanset Avenue, on the east by Gardiner's.Bay, on the south by land of Morris, and on the west by land of the Town of Southold, in said Town of Southold, as a site of a Town, Beach and recreation area, said piece or parcel of land being more particularly described as follows: ALL that certain plot, piece or parcel of land, situate, lying and being east of the Villa~ of Greenport, in the Town of Southold, Suffolk County, New York, bounded and described as follows: BEGINNING at a point formed by the intersection of the south- erly line of Manhanset Avenue with the high water mark of Marion or .Gardiner's Bay and running thence southerly along. said ordinary high water mark of Marion or Gardiner's Bay ~275 feet, more or less, to the northerly line of land now ar formerly of Lillian S. Morris; running thence along land last mentioned 150 f~eet, more or less, to the easterly.line of Gull Pond Inlet; running thence northerly and northwester- ly along the easterly line of Gull Pond Inlet to said south~- erly line of Manhanset Avenue, thence easterly along.said south- erly line of ~Manhanset Avenue 200 feet, more or less.., ~o the .... ordinary high water mark of Marion or Gardiner's Bay and the point or place of beginning. Reserving, however, unto the sellers a right-of-way 20 feet in width along the westerly boundary line of the. above des~ cribed premises for the purposes of ingress and egress to and fr%m Manhanset_Avenue and other, lands ~of the sel~lers lying south of the above described premises. Subject to rights-ofuway of record, if any, of others over tke above described premises. Section 2. The estimated maximum cost of said speci£ic object or purpose:,~including preliminary costs of maps, plans, surveys and est- imates and costs incidental thereto and the financing thereof is $18,500.00 and~the said amount is hereby appropriated therefor. The plan qf financ- ing the aforesaid object or purP0seis by the issuance of a~ $18,500.00 capital note, which is hereby authorized to be issued pursuant~to ~he provisions%of the Local,~inance Law. Section 3. It is hereby determined that subdivision 2.L(a) of paragraph a of.section 11.00 of the Local Finance Law appli~s-_~Q such object or. purpose, and that the period of probable usefulness~tkereof is_thirty years, but the maturity of the capital note hereby authorized will not exceed five years. Section 4. It is hereby determined that no down payment is necessary in connection with the aforesaid object or purpose. Section 5. The faith and credit of the Town of Southold, Suffolk County, New York, a=e hereby irrevocably pledged to the payment of the principal of and interest on.such note. An amount sufficient to pay the principal~and interest on such capital note.shall be included · n the~nnuaI.budget and levied as a part of the taxes for the fiscal year in'which.the same matures. Section.'6. Subject to the provisions of the Local. Finance Law, the power.to sell such note is hereby delegated to the Supervisor, the chi~ef fiscal officer, Such note,sha~l be of such terms, form and con- tents, and sha,ll be sold in such manner, as may~be prescribed ~o~ the Supervisor, Consistent with the ~ro~isions of the Local Finance~Law. only if: ~ Section 7. The validity of such note may be contested (1) .Such~Note is authorized for an object or purpose for which said Town of Southold is not authorized to expend money,~ or (2) The provisions o~ law which should~be compled with _ at the date.of publication of this resolution are not substantially complied with, and an action, suit or proceeding contesting ~uch validity is comm- enced within twenty days after the date of-such p~b- lication, or (3) Such-note is authorized in violation or. the provisions of the Constitution. Section 8. This res61ution takes effect immediately and shall be published in full in "THE SUFFOLK WEEKLY TIM~S", Greenport,~ New York, the official newspaper of the Town of Southold, together with a notice of the Town Clerk in substantially the form provided in Section 81:00 of the Local Finance Law. The resolution having received at least a two-thirds vote of the members of the Town Board, was declared by the Supervisor to be duly adopted. The meeting was recessed to reconvene at '7:30 P.M.
