RECITAL WHEREAS, the T~wn of $outhotd (herein called "Town"),~ in the County of Suffolk, New York, has~hereto~ore'~duly authorized,, sold ~nd ~ssued its $L6,000 Bond Anticipation Note For Land Acquisition-l~968 and it is now desirable to redeem said ~ote~to th~ extent of $8,000 from a source other than the proceeds of the bonds in anticipation of which said Note has been issued; ~now, %therefore be it RESOLVED BY T~E TOWN BOARD OF THE TOWN OF SOUTHOLD, IN THE COUNTY OF SUFFOLK, N~W YORK, AS FOLLOWS: Section 1. Form of Note: SubStantially in accordance with form- prescribed by Schedule B,2 of the Law. Section 3. Said Note is hereby sold to the SECURITY NATIONAL BANK'OF LONG ISLAND, Southold, Office, Southold, New York, at the price,of $8,000 to bear interest at the rate of three and one-quarter per centum (3-1/4%) per annum~ payable at maturity, and the Supervisor is hereby authorized to deliver said Note to said purchaser upon receipt of the purchase price, plus accrued interest, if any, from the date of said Note to the date of delivery. Section 4. Said Note shall contain the recital of validity prescribed by S.52.00 of the La~ and shall be a general obligation of the Town, payable as to both principal and interest by a general ta~ upon all the taxable real property within ~he Town, without limitation of rate or amount. Th~ faith and credit of the Town are hereby irrevoc- ably pledged ~o the punctual payment of the principal of~and interest on said Note and provision shall be made in the budget of the Town by appropriation for the redemption of the Note t~ mature in'such year and for the payment of interest~ to be due ins~ch year. Section 5. Said Note shall be exeeuted in the ~ame of the Town by its Supervisor and the corporate ~eal of said ~6w~ shall be affixed thereto and attested by its Town Clerk. Section 6. Moved by Justice Clark-; seconded by Councilman Demare'st; RESOLVED: That this Town Board go ~n record as'-being opposed to the following Bill: AN ACT to prohibit subdivisions of the state 'from discriminating in the use of public parks-, beaches or recreational facilities to residents ~f' the state because Of non-residency in the aforesaid political 'sub- divisions. The People~of the~ Sta~e of New York, represented in~S~nate an~ Assembly, do enact as follows: Section 1. Any agreement or covenant which limits or restricts such access or use, to residents of such political subdivision shall~ be unenforceable. This act shall take effect immediately. 150 Moved by Councilman Demarest; seconded by Councilman Valentine; RESOLVED: That the Town Board of the Town of Southold recommends the passage of Senate Bill 2799-A~sembly 5166 as follows: AN A~.~££o~ amend the town law, in relation to screening facilities re- quired by zoning boards~of appeals and zoning, ordinances in the county of Suffolk. The people of the State of New York represented in Senate and A~sembly, do enact as follows: Section 1. Subdivision fifteen-c of section one hundred thirty of the town law, as last amended by chapter eight hundred twenty of the laws of nineteen hundred sixty-eight, is hereby amended to read as follows: 15-c. Screening facilities in the towns of the counties of Nassau, Suffolk, Rockland and Westchester required by zoning boards of appeals or zoninq ordinances. Any town in the counties of Nassau, Suffolk, Rockland-and Westchester may adopt an ordinance giving to the appropriate officials of such tow, upon the directio~ of the town board, the right and power to erect, replace, repair or maintain fences, trees, plantings, shrubbery or. other screening on land located~in such town where such screening facilities are required by direction of a ~own board of zoning appeals or by xoning ordinance and there is a failure to comply with such direction, and if, after giving thirty days' notice by registered mail addressed to theowner of record of such land at the address shown on the last preceding assessment roll, such fences, trees, plantings, shrub- bery or other screening are not so erected., replaced, repaird or main- tained by or on behalf of such o~wner; and the town,board, may provide for the assessment of all costs and expenses so incurred by the town, in connection with any_action taken as above, against the land on which such screening facilities are located.
