Section 1. Notwithstanding the provisiQns of~ subdivision four of section four.hundred sixty~seven of the real property tax law, ~persons sixty-five years of age or over who .had previo~s!y applied-~ and qualified for partial exemption from the tax on r~a~ property : ~ pursuant 5o the provisions of said section and who failed to reapply for such~exemption for the fiscal year nineteen hundred sixty-nine or the fiscal year nineteen sixty-nine-nineteen hundred seventy,. whichever applies; may file late applications for such exempt±on with- in ninety days after this act becomes law, proveded that the munic- ~ ipality in which the real property is situated passes a resolution or local law permitting such late filing and providing, for the credit- ing of such exemption.~against the taxes levied or to be levied during the aforesaid fiscal year. This act shall take effect immediately. WHEREAS~ by Chapter 724 of the Laws of 1969 section 467 of the real proper~y tax law, which granted~partial tax exemption of-real ~st&~e ~--owned by persons of limited income over the age of 65 years, was m0d~ified to permit the filing of late applications for such exemption for 't~e fiscal year-1969 or the fiscal year 1969-1970, and WHEREAS~ said chapter requires the municipality ~nvolved to adopt a resolution permitting such late filing, and W~EREAS, it is the desire of the Town Board of the Town of Southold to make the privilege of such late application applicable to all eligible elderlypersons within its boundaries, NOW, TF~EREFORE~ BE IT RESOLVED: That the Town Board of the Town of S~uthold, pursuant to section 467 of the real property tax law as amended by Chapter 72~ of the Laws of 1969 hereby grants to persons of 65 years of age or over who have premiously applied and qualified for partial exemption from the tax on real property and who failed to rea~ply for such exemption for the fiscal year 1969 or the fiscal year 1969-1970, the privilege tD file late applications for such exemptionsas provided in said Chapter 724 of the Laws of 1969, and it is further RESOLVED: that a certified copy of this resolution be forwarded by the Clerk of this Board to the Assessors of the Town of Southold. Moved by Justice Cuter; seconded by J~stice Clark; RESOLVED: That the Superintendent Of .~ighways of the Town of SoUthold, be'authorized to advertise for bids and to purchase from the l~west r~sponsible bidder, the following items, more or less,'as needed:- 20,000 lin. feet of snow fence with pickets 1~ x ~ inches, spaced 2 inches apart, 4 feet high stained red, wi~h five (5) double strands of 12~ gauge galvanized wire, in 100 lin. foot rolls. 2,000 - 6 ft. steel fence posts. Moved by Justice Suter; seconded by Justice Clank; RESOLVED: That Chester Melot, Mattituck, N.Y. be and he hereby is appointed Attendance Officer, subject to the written approval of the District Superintendent of Schools, throughout the Town, except such schools as are otherwise provided ~or by Section 3213 of the Education Law, and be it further RESOLVED: That such attendance officer shall be removabl~ at the pleasure of the District Superintendent of Schools, and be it further RESOLVED: .That the compensation of such attendance officer be fixed at $1200.0.0 per year, payable in regular monthly installmentS, he to pay his own expenses, and be it further ~ RESOLVED: That the Town Clerk be and he hereby is instructed to notify Chester Melot and the District Superintendent of Schools Of the appointment. Moved by Councilman Valentine; seconded by Justice Suter; WHEREAS~ the Senior Citizens, Southold Town, request the use of four (4) buses for transportation to Na~ume's Gardens, up the Hudson, NOW~ THEREFORE, BE IT RESOLVED: That the Town of Southold furnish transportation for the Senior Citizens as requested. Moved by Councilman Valentine; seconded by Councilman Demarest; WHEREAS, the Town of Southold, in order to provide for ~ planning ~tudy contributing to an overall program for its future community, desires to participate in th~ federal-state Urban Planning Assistance Program as authorized by Section 701 of the Housing Act of 1954, as amended, and Article 19-k of the New York State Executive Law, and WHEREAS~ the New York State Office of Planning Coordination, under authority of Article 10-k of the New York ~tate Executive Law, iss the official state agency designated to administer state funds under the'provisions of Section 701 of the Housing Act of 1954, as a~ended, now, therefore be it RESOLVED: That the Town Board of the Town of Southold hereby requests the New York State Office of Planning Coordination to provide planning assistance under authority of Article 19-k of the New York State Executive Law, with such financial assistance as may be provided by'the United StatesDepartment of Housing and Urban Development, under author- ity of Section 701 of the Housing Act of 1954, as amended, and Article 19-k of the New York State Executive Law. Such planning assistance is more particularly described in the project application attached hereto 1:84 and made a part of this resolution as if fully set forth herein. RESOLVED~ that if~the aforesaid application is approved an~ accepted by both'the Director of the New York State office of Planning Coordination and the Department of Housing and Urban Development, the Southold Town Planning Board shall enter into a formal agreement with the New York State Office of Planning Coordination to undertake the project described in the approved application and to pay to the State of New York its share of the estimated total cost of the said project, together with such other terms and conditions as may be deemed necessary and appropri- ate to carry out the said project. RESOLVED: That the Southold Town Planning Board hereby agrees~to have available, in the year the project is to be completed, the sum of $367.00 dollars, or so much thereof as may be mecessary to Contribute a sum not to exceed 16 2/3 per centum (16 2/3~)of the total cost of said p~oject, to be paid to the State Of New York, on condition that the above-mentioned application is approved by both the Department of Hous- ing and Urban Development and the Director of the New York State Office of Planning Coordination. RESOLVED: that the Planning Board shall assume the costs of eperating and maintaining its own planning board or commission incl~uding such services as clerical, personnell office space, equipment, materials, communication and travel, as such costs cannot be charged to the Urban Planning Assistance Program. RESOLVED: That it is understood that current planning services may not be charged to the Urban Planning ~ssistance Program. RESOLVED: That the Chairman ~f Planning Board of the Town of Southold - be and hereby is authorized and empowered to execute in the name of the Town of Southold all necessary applications, contracts and agreements to implement and carry out the purposes specified in this resolution. Moved by Councilman Demarest; seconded by Councilman Vale~ine;~ WHEREAS, the petition of Frank Murphy, Mattituck, N,Y. and Stephen Doroski, Southold, for a change of zone f~m "A" R~sident~l and Agr~ic- ultural District to "B" Business District have been sent to the Planning Board for their recommendation and report, and WHEREAS, it is required to send all property within 500 feet of County Roads or property to the Suffolk County Planning Board, NOW~ THEREFORE, BE IT RESOLVED: That these petitions be sent~ the~Suffolk County Planning Board for their recommendation and report. Moved by Justice Clark; seconded by Councilman Valentine;- ~ WHEREAS~ a petition was received from Abe'Goldrich requesting a dhange of zone of certain property on Middle Road, ~Southold, N.Y. described in said petition from "A" Residential and Agricultural District to 'B" Business District, NOW~ THEREFORE~ BE IT RESOLVED: That th~ Town Clerk of the Town of Southold be and he hereby is directed to transmit this application to the Planning Board in accordance'with Section 901, Subdivision-C of Article IX of the Building Zone Ordinance of the~Town of Southold. Moved by'Councilman Demarest; seconded by Justice Suter; WT~EREAS~ Stephenson Beach Inc. is the owner of real property at Or~ a~d East Marion, New York, consisting of a beach fronting on Long Island Sound and meadow and wetlands fronting on Orient Harbor, and " WHEREAS~ a meeting of the stockholders of Stephenson Beach, Inc. was held on July 27, 1969, at which time the following resolution was adopt- ed, to wit:- "RESOLVED, that the Officers of the CorporatiOn ate herebY authorized a~d directed to take such action as may be appropriate to arrange for all or substantially all of the real property o%rned by this Corporation, or all of the stock of this Corporation, to be given to a new park district to be created for the Orient-East Marion area, subject to appropriate conditions regarding the maintenance of the wet lands and the beach area of suck proper~y." and WHEREAS~ this board deems it in the public interest that a park district be created for the Orient-East Marion area in the Town of Southold for the purpose of taking title to the real property of Stephenson Beach, Inc. in accordance with the resolution o~ the stock~01ders of said corporation, hereinbefore set forth ~ ~ NOW, THEREFORE, BE IT RESOLVED pursuant to the provisions of Article 12-A of the Town Law, the sum of $200.00 be and the same hereby is appropri- ated to pay the cost of preparing a general map showing the proposed Orient-Bast Marion Park District, and it is further~ RESOLVED: That this resolution is subject to a permissive referendum. Justice Martin Suter reported on the Conference he attended stating that it w~s most educational. ~!c~ve~ by Councilman Valentine congratulated Chief Carl Cataldo and the Sout~old Police Department on the award received by them from the State Traffic Safety Council of New York, which read as follows: Southold Police Department For Outstanding Achievement in Accident Prevention. A C~rtificate of Recognition In appreciation of outstanding performance for Traffic Safety. This interest and support has contributed to safety on our highways for all citizens and is hereby gratefully acknowledged. July, 1969. Mr. Nelson Axien appeared before the Town Board requesting the Board to restrict the beaches to residents and house guests only, as the beaches have been crowded the last few weeks. Firs. Theodore Bittner requested an ordinance on Aerial spraying, suggesting that permission ~from property owners within 1500 feet be required. Mr. Kingsley Smith requests a Building Code for the Town of Southold. Mr. Robert ~rubenbach reported on the speed on Hobart Road, Southold, Moved by Justice Suter; seconded by Justice Clark; RESOLUTION OF THE TOWN OF SOUTHOLD~ NEW YORK, ADOPTED JULY 29, 1969, APPROPRIATING $4,250 FOR THE' REDEMPTION, IN PART, OF THE $8, 500 BOND ANTICIPATION NOTE FOR URCHASE OF A PAYLOADER'1968. Recital WHEREAS, the Town of Southold (herein called "Town"), in the County of Suffolk, New York, has heretofore duly authorized, sold and issued its $8,500 Bond Anticipation Note For Purchase of a Payloader-1968, and it is now desirable to redeem said Note to the extent of $4,250 from a source other than the proceeds of the bonds in anticipation of which said Note has been issued; now, therefore, be it RESOLVED BY THE TOWN BOARD OF THE TOWN OF SOUTHOLD, IN THE COUNTY OF SUFFOLK, NEW Y~RK~ AS FOLLOWS: Section 1. The amount of $4,250 is hereby appropriated from funds now available to said purpose to redeem,~ in part, On or before August 8, 1969, the outstanding $8,500 Bond Anticipation.Note For Purchase of a Payloader-1968 of the Town hereinaD~ referred to in the Recital of this resolution, said funds~being a s~urce other than the proceeds of the bonds in anticipation of which sai~ Note has been issued. ~ 186 Section 2. Recital Wt{EREAS~ the Town of Southotd (herein called "Town"), in the County of Suffolk, New York, has duly authorized, sold and issued its $8,500 Bond AntiCipation Note For Purchase of a Payloader~1968 and'has duly appropriated $4,250 for the redemption, in part, of said Note and it is new necessary and desirable to provide for the renewal, in part, of said Note by the issuance of a new Note in the principal amount of $4,250; now, therefore, be it RESOLVED BY THE TOWN BOARD OF THE TOWN OF SOUTHOLD, IN THE COUNTY OF SUFFOLK, NEW YORK, AS FOLLOWS: Section 1.
