Moved bY Justice Clark; seconded by Councilman Valentine; RESOLUTION OF THE TOWN OF SOUTHOLD, NEW YORK, ADOPTED JUNE 24, 1969, AUTHORIZING THE REDEMPTION, IN PART~ OF A $17,500 ~OND ANTICIPATION NOTE FOR LAND ACQUIS- IT~ON-~968, TO THE EXTENT OF $3,500, AND APPROP~IATING SAID AMOUNT THEREFOR. RECITAL WHEREAS, the Town of Southold (herein called "Town") in the County of Suffolk, New York, has heretofore duly authorized, sold and issued its $17,500 Bond Anticipation Note For Land Acquisition-1968 and it is now desirable to redeem ~aid Note to the extent of $3,500 from a source othe~ than the proceeds of ~he bonds in anticipation of which said N6te has been issued; now, therefore, be it RESOLVED BY THE TOWN BOARD OF THE TOWN ~OF SOUTHOLD, IN THE COUNTY OF SUFFOLK, NEW YORK, AS FOLLOWS: Section 1. The $17,500 Bond Anticipation Note For Land'Acquisition- 1968 of the Town, hereinabove referred to in the Recital of this resolut~ion, is hereby authorized to be redeemed on or before July 1, I969,~he extent of $3,500 from funds o f the Town now available to said purpose, said funds being a source other than the proceeds of the bonds in anticipati0n of which said Note was issued, and the said amount of $3,500 is hereby appropriated therefor. Moved by Councilman Valentine; seconded by Justice Suter; BOND ANTICIPATION NOTE RESOLUTION OF THE TOWN OF SOUTHOLD, NEW YORK, ADOPTED JUNE 24, 1969, AUTHORIZING THE RENEWAL, IN PART, OF THE $17,500 BOND ANTICIPATION NOTE FOR LAND ACQUISITION_1968, BY THE ISSUANCE OF A NEW NOTE IN THE PRINCIPAL AMOUNT OF $14,000. RECITAL WHEREAS~, The Town of TS~uthold, New York, (herein called "Tow~") in the County of~Suffolk, has heretofore duly authorized, sold and issued its $17,500 Bon~'~A~tic~pation Note For Land Acquisition-1968, and has duly authorized the redemption of the Note to ~he extent of $3,500 and it is now desirable and necessary to provide for the renewal, in part, Of said Note by the issuance of a new Note ~n the principal amoUnt of $14,000; now, therefore, be it RESOLVED BY THE TOWN ~OARD OF THE TOWN OF SOUTHOLD, IN THE COUNTY ~OF SUFFOLK, NEW YORK, AS FOLLOWS: Section 1. The $17,500 Bond Anticipation Note For Land Acquisition-1968 of the Town , dated July 2, 1968, maturing July 1, 1969, subject to priOr redemption, numbered 1, heretofore duly authorized, sold and issued pursu- ant to the bond resolution duly adopted by the Town BC~ rd On March. 12,~ 1968, is hereby authorized to be renewed, in part, by the isSuanCe of a new Note in the principal amount of $14,000, said Note dated July 1, 1968, having been heretofore duly authorized to be redeemed from a source other than the proceeds'of the bonds in anticipation of which~said Note has been issued, to the extent of $3,500, all as herein above referred~to in the Recital hereof, pursuant to the provisions of-the~Local Finance Law, con- stituting Chapter 33-a of the Consolidated Laws of the State of New York (herein called "Law"). The maturity of said renewal Note herein authorized shall not be later than one year from its date, and said Note may be fur- ther renewed pursUant to the provisions of the Law. Section 2. The terms, form and details-of said renewal Note shall be as follows: Amount and Title: $'14,000 Bond Anticipation Note For Land Acquisition-1969 Dated: July 1, 196'9 Matures: July 1, 1970, subject to prior ~demption No. R-1 D~nomination: $14,000 Interest Rate: 3-~ per annum, payable a't maturity Place of payment of principal and interest: Supervisor"s Office, Greenpcr t, New York Form of Note: Substantially in accordance with form prescribed by Schedule B,2 of the Law. Section 3. Said Note is hereby sold to the SECURITY NATIONAL BANK~ OF LONG ISLAND, Rive~head, New'York, at the purchase price'of $t~4,000 to bear interest at the rate of three and one=half per centum (3L~)-per annum, payable at maturity, and the Supervisor is hereby authorized to deliver said Note to said purChas~ upon receipt of the~purchas~ ~rice, plus accrued interest, if any, from the date'of said Note to the date of delivery. Section 4. SAid Note shall contain the recital of validity pre- scribed by Section 52.00 of the Law and Shali be a geBeral obligation of the Town, payable as to both principal and interest by a general tax upon all the taxable real propSrty within the~Town, without limitation o~rate or amount. The faith and credit of the Town are hereby irrevocably ~ledged to the punctual payment of the principal of and interest on said Note and provision shall be~ made in the budget of the Town by appropriation for the redemption of the Note to mature in such year and for the~ payment of interest to be due in such year. Section 5. SAid Note shall be executed in the name of the Town-by its Supervisor an'd the corporate s~al of said Town shal~ be affixed there- to and a~tested by its Town Clerk. Section 6. Moved by Councilman Valentine; seconded by Justice Surer; WHEREAS~ the Board of Commissioners of the Cutchogue-New Suffolk Park District has duly p~tit~oned this Town Board on May, 1969, pursuant to Chapter 763 of the Laws of 1960, to call a public hearing on the question of authorizing, on behalf of said District, the acquisition ~f certain real p~operty and the construction thereon of a buildin~ for use as a comfort station and the acquisition of miscellaneous equ~ipment~for use in connection with a bathing beach including a~ alumin~mmboat~and a life guar~nd -- WHEREAS, this Town Board duly adopted a resolution on May 20, L969, call- ing a public hearing on the ~foresaid acquisition and improvement to be held at Cutchggue School West, Depot Lane, in Cutchogue, L.I.,N.y. on June 12, 1969 at 7:00 o'clock P.M., Eastern Daylight Tim~; and WHEREAS, the no~ice of such hearing was duly Published'and posted in the manner pr~scribed by law and proof of such publication and posting has been presented to this Town Board; and WHEREAS, said hearing was duly held at the time and place af0reSaid~at which time all persons ~interested in the subject'matter thereof were duly heard; and WHE~S, this Town Board has duly considered the evidence given at said hearing; .... EoW~ THEREFORE~ BE IT RESOLVED: By the Town Board Of the Town of Southold, 'Suffolk County, New York, as follows: Section 1. It is hereby found and determined upon the evidence given at ~he hearing prescribed in the~ream~les hereof that it is in the public interest to acquire the aforesaid real property for such District at an estimated cost of $11,000, and to improve and embellish the same by the construction of a building for use as a comfort station in conjunction with a bathing beach at an estimated cost of $11,000, and to acquire mis- cellaneous-equlpment for use in connection wit~ such bathing beach includ- ing an aluminum boat and life guard stand at an estimated expense of $1,500. Section 22 The power is hereb~ delegated to the Board of Commissioners of said District to conduct all further proceedings in connection with the aforesaid acquisition and construction as provided in and subject to the limitations of Section 216 of the Town Law. Ernest Middleton, Recreation Leader-~ J. B. Hartsfield .... Edmund White, Clerical Aid all effective as of June 22, 1969. Terrfand George Fisher, Building Inspectors, Town of Southold, be and they hereby are authorized to attend Building Inspectors School starting September 17, 1969 to go for one night a week for 14 weeks, said charge of $25.00 and necessary expenses to travel to be charged against the Town. Kent and others appeared before the Town Board protesting the building of a boat ramp and parking lot at Gull Pond Area. A petition was presented to the Supervisor.
