MEETING OF MAY 20, 1969 The Southold Town Board met at the office of Supervisor Albert M. Martocchia at Greenport, New York, on May 20, 1969 with the following present: Supervisor Martocchia; Councilmen Demarest and Valentine; Justices Clark and Suter; Town Attorney Tasker; Superintendent of'High- ways Dean and Town Clerk Richmond. Moved by Councilman Valentine; seconded by JuStice Clark; RESOLUTION OF THE TOWN OF SOUTHOLD, NEW YORK, ADOPTED MAY' 20, 1969, AUTHORIZING THE REDEMPTION, IN PART, OF A $41,000 BOND ANTICIPATION NOTE FOR LAND ACQUISITION-1968, TO THE EXTENT OF $14,000 AND APPROPRIATING SAID AMOUNT THEREFOR. Recital WHEREAS, the Town of Southold (herein called "Town"X, in the County of Suffolk, New York, has heretofore duly authorized, sold and issued its $41,~000 Bond Anticipation Note For Land Acquisition-1968 and ilt is now desirable to redeem said Note to the extent of $14,000 from a source other ~than the proceeds of the bonds in anticipation of whichsaid Note has been issued; now, therefore,be it RESOLVED BY THE TOWN BOARD OF THE TOWN OF SOUTHOLD, IN THE COUNTY OF SOUTHOLD, NEW YORK, AS FOLLOWS: Section 1. The $41,000 Bond Anticipation Note For Land ~cquisit- ion-1968 of the Town, hereinabove referred to in the Recital of th:is resclution, is hereby authorized to be redeemed on or before June 6, 1969, to the extent of $14,000 from funds of the Town now available to said purpose, said funds being a source other thanthe proceeds of the bonds in anticipation of which said Note was ~ssued, and the said amount of $14,000 is hereby appropriated therefor. Moved by Councilman Valentine; seconded by Justice Clark; BOND ANTICIPATION NOTE RESOLUTION OF THE TOWN OF SOUT~{OLD, NEW YOtLK, AD~PTED MAY 20, 1969, ~UTHORIZING THE RENEWAL, IN PARTs OF THE $41,000 ~ONd ANTICIPATION NOTE FOR LAND ACQUISITION-1968, BY THE ISSUANCE OF A NEW NOTE IN THE PRINCIPAL AMOUNT OF '$27,000. Recital Recital WHEREAS~ the Town o3 Southold (he, rein called ~"Town") in the County of Suffolk, New York, has heretofore duly authorized, sold and issued its $4.1,000 Bond Anticipation Note For Land Acquisition-1968, and has duly authorized the redemption of Note to the extent of $14,000 ahd it is now necessary and desirable to provide for the renewal, in part', of said Note by the issuance of a new Note in the prinCipal amount of $27',000; now, therefore, be it RESOLVED BY THE TOWN BOARD OF THE TOWN OF SOUTHOLD, ~N THE COUNTY OF SUFFOLK, NEW YORK~ AS FOLLOWS: Section i. The $41,000 Bond Anticipation Note For Land Acquisition-1968, of the Town, da~ed June 7, 1968, maturing June 6, 1969, subject to prior redemption, numbered 2R-l, heretofore d~ly auth- orized, sold and issued pursuant to the bond anticipation note resolution duly adopted by the Town Board of the Town on June 11, 1968, is hereby authorized~to be renewed, in part, by the issuance of a new Note in the principal ~mo~nt of $27,000, said Note dated June 7, 1968, having been heretofore duly authorized to be redeemed f~o~ a source other than the proceeds of the bonds in anticipation of which said Note has been issued, to the extent of $14,000, all as hereinabove referred to in the Recital hereof, pursuant to the provisions of the Local Finance Law, constituting Chapter 33-a of the Consolidated Laws of the State of New York (herein called "Law"). The maturity of said renewal Note herein authorized shall not be later than one year from its date, and said Note may be further renewed pursuant to the provisions of the Law. Section 2. The terms, form and details of said renewal Note shall be as follows: Amount and Title: $27~000 Bond Anticipation Note For Land Acquisition-1969 Dated Matures: No. 3R-1 Interest R~te: June 6, 1969 June 5, 1970, subject to .prio~ redemption Denomination: $27,000 3-3/4% per annum, payab~le at maturity -Place of payment of principal and interest:' Supervisor's Office, Greenport, N.Y. Form of Note: Substantially in accordance with form prescribed by Schedule B, 2 of the Law. Section 3. Said Note is hereby sold to the NORTH FORK BANK AND TRUST C0MPANY~ Mat~i~ck, New York, at the price of $27,000 to bear interest at the rate of three and three-quarters per centum (3-3/4%) per annum, payable at maturity, and the Supervisor is hereby authorized to deliver said Note to said purchaseYupon receipt of the purchase przce, plus accrued interest, if any, from the date of said Note to the date of delivery. Section 4. Said Note shall contain the recital of validity prescribed by S. 52.00 of the Law and shall be a general obligation of the Town, payable as to both principal and interest by a general tax upon all the taxable ~eal 'property within the Town, withou~ limitation of rate or amount. The faith and credit of the Town are hereby irrevoca- bly pledged %o the punctual payment of ~h~ pk~ncipal of and interest on said Note and provision shall be made in the budget of the Town by appropriation for the redemption of the Note to mature in such year and for the payment of interest to'be due in such year. Section 5. Said Note shall be executed in the neme of the Town by its Supervisor and the corporate seal of the Town shall be affixed thereto and attested by its Town Clerk. Section 6. Tuthill has applied to the Town Board for a single trailer renewal permit dated May, 1969,'" NOW, THEREFORE, BE IT RESOLVED: That the application uf John C. Tuthill Mattituck, N.Y. for a' single trailer to b~ placed on Elijah Lane, Matt- ituck, N.Y. be granted for a periDd of six (6) months. Moved by Justice Suter; seconded by C6uncilman Dema~e~st; WHEREAS,~the Board of Commissioners of the Cutchogue~NeW Suffolk Park District has duly petitioned this Town Board, pursuant to Chapter 763 of the Laws of 1960, to callaa public hearing on the q~estion of authorizing, on behalf of said District, the acquisition of the real property'here~n- after described, a~d the 6ons%ruction thereon of a building for use as a comfort station and the acquisition of miscellaneOus equipment for use i~ connection with a"bathing beach including an aluminum boa~ and a life guard stand; and ~ WHEREAS, it is now desired to call said public hearing, now, therefore, be it RESOLVED: by the Town Board of {he T6wn of Southold, Suffolk County, New York, as follows: Section 1. The Town Clerk is hereby authorized and d directed to cause a notice of said public hearing to he'published in the Suffolk Weekly Times, the official newspaper, and posted within said Park District in the manner and ~ithin the time prescribed by Section 193 of the Town Law. Such notice shall be in subs{antially the following form: NOTICE OF PUBLIC HEARING NOTICE IS HEREBY GIVEN tha.t the Town Board of the Town.of Southold, Suffolk County, New York, will meet at Cutchogue School West, Depot Lan$., Cutchogue, New York, in said Town, on the 12th day of June, 1969, at 7:00 o'clock P.M., Eastern Daylight Saving Time, for the purpose of conducting a public heaEing on the question of authorizinq, on behalf of the Cutchogue-New Suffolk Park District, the acquisition of the real property hereinafter described, at an estimated expense of $11,000, the construction thereon of a building for use as a comfort station, at an estimated expense of $11,000, and the acquisition of miscellan-e eous equipment for use in connection with a bathing beach, including an aluminum boat and a life stand, at an estimated expense of $1500. Mrs. Eckhart spoke to the Board concerning the water problems in the Pipes Neck Road and Wickham Park Area, and was advised by the Town Attorney of the steps that must be taken. Mr. John Rapp, Chairman of the Suffolk County Safety Council, appeared before the Board with several recommendations for safety. , Mr. Alfred Rebenklau asked about a Dog Ordinance.
