Vanderbeck applied to the Town Board for permission to'lay a water main under a Town Road (namely, West Creek Drive) in Cutchogue, New York, NOW, 'THEREFORE, BE IT RESOLVED: That Raymond Dean, Superintendent of Highways, be and he hereby is authorized to issue a permit to Robert W. Vanderbeck, said permit to be drawn by Town Attorney Tasker. Vote of Town Board: Ayes-Supervisor Martocchia; Councilmen Valentine and Rich; Justices ~emarest and Suter. Moved by Justice Suter; seconded by Justice Demarest; RESOLVED: That Superintendent of Highways Dean be and he hereby is authorized to attend New ~ork State Highway SUperintendent Conference, Niagara Falls, New York on September 16, 17 and 18, 1970, and that all necessary expenses be a legal expense against the Town. Moved by Councilman Valentine; seconded by Councilman Rich; BOND AND CAPITAL NOTE RESOLUTION OF THE TOWN OF SOUTHOLD, NEW YORK, ADOPTED SEPTEMBER 8, 1970, AUTHORIZING THE CONSTRUCTION OF POLICE HEAD- QUARTERS BUILDING ON LAND NOW OWNED BY THE TOWN, SITUATE ON THE-NORTH SIDE OF ROUTE 25, ~N THE HAMLET OF PECONIC, IN SAID TOWI~, STATING THE ESTIM3~TED MAXIMUM COST THEREOF IS $130,000, APPROPRIATING SAID AMOUNT THEREFOR AND AUTHORIZING THE ISSUANCE OF $6,500 CAPITAL NOTES TO PROVIDE THE UOWN pAYMENT AND $123,500 SERIAL BONDS OF SAID TOWN TO FINANCE THE BALANCE OF SAID APPROPRIATION. The Town Board of the Town of Southold, in the County of Suffolk, New York, hereby resolves (by the favorable vote of not less than two- thirds of all the members of said Board); as follows: Section 1. The Town of ~Southold (herein called "Town"), in the County of Suffolk, New York, is hereby authorized to construct a police headquart'ers 'building on land now owned by the Town, situate on the north side 'of ~Route 25, in the'Hamlet of Peconic, approximately 500 £eet west of Peconic ~Lane, in the Town, including ~rading and improving the site, all-in~accordance with plans, ~specifications and estimates of cost pre- pa~ed by Donald Brown, a licensed architect of the State of New York, on file in the office of the Town Clerk and hereby approved. The estim- ated maximum cost of said specific object or purpose, including prelimin- ary costs and costs incidental thereto and the financing thereof, is $130~b00 and the said amount is hereby appropriated therefor, The plan of financing includes the issuance of $6,5Q0 capital notes to provide the down payment required by law, the issuance of $123,000 serial bonds to finanCe the balance of said appropriation and the levy of a tax upon all th~ taxable real property in the Town to pay the interest on said notes and bonds a~d the principal thereof When due and payable. Section 2. Capital notes in the principal amount of $6,500 and serial bon~ds in the prin'cipal amou'nt of' $123',500 o~f thee Tow~ are hereby a~thorized to be issued pursuant to the provisions of the Lo'ca~ Finance Law, constitutfng Chapter 33-a of the Consolidated Saws of the State ~of New York (herein cal'led "Law")¥ t~ f~i~ance said approp'riation~ Section 3. The following additional matters ~are hereby det~'rmined and stated: ~ (a) The said police headquarters building to be constructed is of Class '~" construction, as defined by Section 11.-~00 a. 11 (b) of the Law and the period of probable usefulness~of the' specific object or pur- pose~for which said capital notes and seri~ bonds are to be issued, is twenty'(~0)~ yea~s and the maturity of Said bonds will exceed five (5) years. ~ ' ~ (b) 'Current funds are required by the Law to be provided prior to the issuance of the bonds authorized by this resol6tion or any bond aniic- ipation notes issued in anticipation thereof and such current funds will~ be provided from the proceeds of the capital notes herei~ auth0r~i~ed tO be issued. The Supervisor is hereby authorized and direc.ted~to set aside' said current funds and to apply the same solely to the said Specific ~bject or purpose described in Section 1 hereof. Section 4. Each of the notes and bonds authorized b~ this res- olution and any notes issued in anticipation of said bonds shall ~c0ntain the recital of validity prescribed by Section 52.00 of the Law and said notes and bonds and any ~otes issued in anticipation of said bonds ~shall be general obligations of the Town and the Town hereby irrevocabl~pledges its faith and credit to the punctual payment of the principal thereof a~d interest ~hereon and there shall be raised annually by tax on all tbs taxable real property in the Town a sum sufficient to pay the principal of and interest on said notes and bonds as the same shall become due. Section 5. Subject to the provisions of this resolution and of the Law, and pursuant to the provisions of Section 30.00 relative to the authorization of the issuance of bond anticipation notes and of Section 50.00 and Sections 56.00 to 68.00 of the L~w, the powers and duties of the Town Board relative to prescribing the terms, form and contents and as to the sale and issuance of Said notes and bonds and any no~es issued in anticipation of said bonds, or the renewals thereof, are delegated to the Supervisor, the chief fiscal officer of the Town. Section 6. The validity of said notes and bonds authorized pursuant to this resolution and of any notes in anticipation of said bonds, may be contested only if: (a) such obligations are authorized for an object or purpose for which the Town is not authorized to expend money, or (b) the provisions of law which should be complied with at the date. of the publication ~f such resolution, are n6t substantially complied' ~ith, and an action, suit or proceeding contesting such validi%y~ is commenced within twenty days after ~he date of such publication, or (c) such obligations are authorized in violation of th~ provisions of the constitution. Moved by Councilman Valentine; seconded by Councilman Rich; RESOLVED BY THE TOWN BOARD OF THE TOWN OF SOUTHOLD, IN THE COUNTY OF SUFFOLK AND STATE OF NEW YORK, AS FOLLOWS: Section 1. The Town Clerk of the Town of Southold, in the County of Suffolk, New York, shall, within ten .(10) days after~ the adoption of the bond and capital note resolution referred to in the form of No.rice hs~einafter set forth in Section 3 hereof, cause, to be published at ~least once in "THE LONG ISLAND TRAVELER MATTITUCK WATCHMAN", a newspap~er pub~ lished in Southold, New York, having a ~eneral circulation within said Town and hereby designated as the official newspaper of said Town, and to be posted on the sign board maintained pursuant to subdivision 6 of Section 30 of the Town Law, a Notice which shall set forth the date ~6f a- doption of said foregoing resolution and contain an abstract thereof- con- cisely stating its purpose and effect. Section 2. After said bond and capital note resolution shall take effect, the Town Clerk is hereby directed to cause said bond a~nd capital note to be published, in full, in the news~paper 'hereinabove re-~ ferred to in Section 1 hereof, and hereby designated the official n~ws- paper for said publication, ~oge~her with a notice in substantiai~y the form as provided by Section 81.00 of the Local Finance Law, constituting Chapter 33-a of the Consolidated Laws of the State of New York. ~¥ Section 3. Post ~803, Southold, N.Y. applied to the Town Clerk for a Bingo License, and WHEREAS, the Town Board has examined the application and after ~nvestig- ation duly made findings and determinations as required by law, NOW, THEREFORE, BE IT RESOLVED: That the Supervisor be and he hereby ~s authorized and directed to execute on behalf of the Town Board the find- ings and determinations as required by law, and it is further RESOLVED: That the Town Clerk be and he hereby is directed to issue a Bingo License to the Southold American Legion G.T.G.
