HomeMy WebLinkAboutTB-12/27/1972-S SOUTHOLD TOWN BOARD MINUTES Special Meeting of December 27, 1972 WAIVER OF NOTICE OF TOWN BOARD MEETING WE, the undersigned, being members of the Town Board of the Town of Southold, Suffolk County, New York, do hereby severally waive notice of the time, place and purpose of the meeting of the Town Board to be held at 16 South Street, Greenport, New York, in the Town of Southold, on Wednesday, 10 A.M., December 27, 19~2, and do hereby consent that the same be held on said date for the trans- action of any business which may properly come before said meeting. The Southold Town Board met at the office of Supervisor Albert M. Martocchia, 16 South Street, Greenpott, New York, for a special meeting of the Board at 10:00 A.M., Wednesday, December 27, 1972, with the following present: Supervisor Albert M. Martocchia, Councilman James H. Rich, Jr., Councilman James F. Homan, Justice Martin Surer, Justice Louis M. Demarest, Superintendent Raymond C. Dean, and Town Clerk Albert W. Richmond" · he following resolution was offered by Justice Demarest, and seconded by Councilman Homan, to wit: WHEREAS, certain real property owned by the United States, .located in the County of Suffolk, State of N~w York, has been declared surplus and at the discretion of the General Services Administration, may be assigned to the Secretary of the Interior for disposal for public park or recreation purposes, under the provisi~ns of Section 203(k) (2) of the Federal ,~rqp. er~tY:and_ A~dm_~inistrative Services Act of 1949 (63 Stat. 387), as amended, and rules and regulations promulgated~pursuant %he.reto, more particularly described..as fo 1 lows: _~ (1-) The Com-plete..name ,and Location of the property being requested: Fishers Island Station Communi~ations Antenna Site, (2) GSA Control Number of the subject property: GSA No. T-NY-404E. -(3)-Aureage..of the total property or.portion thereof being requested u~der this application for park an,d recr.eation pnmposes only: 2.12 acres. WHEREAS, the Town.of Southold needs,~an,d w, ill utilize, said p~operty in perpetuity for a public park or recreation areas as. set for,th in its application and in aceDrdance with the requirements of said Act and the rules and regulations promulgated thereunder; ~ NOW, THEREFORE, BE IT-RESOLVED, that The Town of South,old shall make application to the Secretary.~of the Interior for and secure the transfer to it of the above mentioned property for said use upon and subject -to such exceptions, reservations, terms, covenants, agreem~n~, conditions and restrictions as the Secr,etary~of the Interior, or his authorized representative, may require in connection with the disposal of said property under said Act and the rules and regulations issued pursuant thereto; and BE IT FURTHER RESOLVED that the Town of Southold, has legal authority, is willing and is in a position to assume immedia.se care and maintenance of the property, and that Albert M. Martoc~hia, $~pervisor of the Town of Southold be and he is hereby authorized for and on behalf of the Town of Southold, to do and perform any and all acts and things which may be necessary to carry out the foregoing resolut'ion, including the preparing, making, and filing of plans, applications, reports, and other documents, the execution, aceeptance, delivery, and recordation of agreements, deeds, and other instruments pertain- ing to the transfer of said property, includihg the filing of copies of the application and the conveyance documents in the records of the governinq body, and the payment of any and all sums necessary on account o~ the purchase price thereof or fees or costs incurred in connection with the transfer of said property for survey, title searches, recordation of instruments, or other costs identified with the Federal surplus property acquisition. Vote of the Town Board: Ayes: Supervisor Martocchia, Councilman Rich, Councilman ~oman, Justice Suter, Justice Demarest. I, ALBERT W. RICt~MOND, hereby certify that I am the Town Clerk of the Town of Southold, Suffolk County, New York; and that the foregoing resolution is a true and correct copy of the resQlution adopted by the vote of a majority of the members of ~h&d Town Board, present at a meeting of said body on the 27th day of December, 1972, at which a quorum was present. /s/ Albert W. (SEAL)~ Moved by Councilman Rich, seconded by Justiee Suter, WHEREAS, the Burton Potter Post ~185, American Legion, Greenport, New York, applied to the Town Clerk for a Bingo License Amendment, and ~qEREAS, the Town Board has examined the application, and after investigation, duly made findings and determinatiQ~s as required by law, NOW, THEREFORE, BE IT RESOLVED, that the Super~i~endbe and he hereby is authorized and directed to execute on behalf of the Town Board, the findings and determinations required by law, and it is further RESOLVED that the Town Clerk be and he hereby is directed to issue an amended B~ngo License to the Burton Potter Post ~185, American Legion, Greenport, New York. Vote of the Town Board: Ayes: Supervisor Martocchia, Councilman Rich, Councilman Homan, Justice Suter, Justice Demarest. Town Clerk Richmond informed the To~rn Board that he had received a notice of reS'ignation from Justice E. Perry Edwards, Fishers Island, '~ew York, ~o be effective as of December 31, 1972. The Town Clerk also informed the Town Board that he had receiued the notice of resignation from Dorothy B. Edwards, Deputy Town Clerk and Sub-Registrar, Fishers Island, New York, effective December 31, 1972. The Fishers Island Ferry District requests the Town Board to post "No Hunting" signs on the Fishers Island Airport property. Moved by Councilman Rich, seconded by ~ouncilman Homan, it wa~s RESOLVED that $3,450.00 be transferred~from General Fund to Capital Account for the purchase of, and other expenses pertaining to land at Grand Avenue, Mattituck, New York, for the bridge. Vote of the Town Board: Ayes: ~pervisor Martocchia, Councilman Rich, Councilman Homart, Justice Suter, Justice-Demarest. Moved by Councilman Rich, seconded by Justice Surer, it was ~ RESOLVED that the following monies be transferred: From: Undistributed Salaries - Whole Town - $800.00 · o: Assessor's Salaries - Personal Services - A1355.1 - Whole Town. From: Whole Town Surplus - $9,200.00 To: Whole Town - Federal Emergency Employee Program. From: Part Town - Undistributed Salary Adjustments - $25.00 To: Part Town - Police Salaries - Personal Services - B3120.1 289 From: Part Town - Undistributed Salary~Adjustments - $7,500.00 To: Part Town - Federal Emergency Employee Program Vote of the Town Board: ~yes: Supervisor Martocchia, Councilman Rich, Councilman Homan, Justice Suter, Justice Demarest. Moved'by Justice Demarest, seconded by Councilman Rich, WHEREAS the Southold Town Board on its own motion proposed a change of zone from "A" Residential and Agricultural District to "B-l" General Business District on certain property situated at Orient, New.York, and WHEREAS~the said.petition was referred to the .Southold~Town Plan- ning Board for official recommendation and report,-and WHEREAS the Town Board, pursuant to due notice, held a public hearing thereon on the 19th day of December, 1972, at 3:30 P.M., at which time all interested persons were given an opportunity to be heard, NOW, THEREFORE, BE IT RESOLUED that the..Building Zone Ordinance of the Town of Southold, including the ~uilding Zone Maps be amended by the,Town Board on its own mo~ion ~by changing from "A" Residential and Agricul~nmal District to B-I" General Business~ District, the following described~property:~ BEGINNING at a .point on the southerly line of Main Road (Route 25) at the northeasterly corner of the existing B-1 General Business Zone, from said point of beginning running thence along the southerly line of Main Road, North 76 degrees 26 minutes 40 seconds East 93.64 feet to a concrete monument of land now or formerly of Pappas; running thence along land last mentioned the following five courses and distances, to wit: (1) North 26 degrees 33 minutes 20 seconds West, 13.48 feet; thence .. ~2) North 75 degrees 55~minutes 40 seconds East, 95.96 feet; thence ' (3) South 13 degrees 49 minutes 10 seconds East, 14.0 feet; thence -(4) North 76 degrees 26 minutes 40 se~-onds~East,~-68.0 feet to land of La%ham~ thence (5) Along land last mentioned South 19 degrees 58 minutes 40- seconds Eas~, ~575 feet,-more or less,-to the ordinary,high water mark of Ga~d~.ners Bay; thence in a southwesterly direction along said ordinary high water mark of Gardiner's Bay, 190 feet, more or less to said, existing B-i~ General Business Zone; thence along said B-~ General ~usiness~Zone, North- 26 degrees 45~minutes ,50 seconds West, 280 feet, more or Less~,-to the said~southerly line of!
