Martocchia, 16 ~outh Street, Greenport, New York, at 3:00 P.M., Tuesday, July 11, 1972, with the following present: Supervisor Albert M. Martocchia, Councilman James H. Rich, Jr., Councilman James F. Homan, Justice Mar~in Suter, Justice Lou~s M. Demarest, Town Attorney Robert W. Tasker, Superintendent of Highways Raymond C. Dean, and Town Clerk Albert W. Richmond. Absent: Justice E. Perry Edwards. Moved by Counci~lman Homan, seconded by Justice Suter, it was RESOLVED, that the minutes of June 20, 1972 and Special Meeting of July 5, 1972, be and they hereby are approved.' RESOLUTION AND DETERMINATION - In the Matter of the Petition of Arthur Wolpert, Wilhelm V. Krumholz, 'Joseph DeSchrage, A2 Berhstein and Lillian S. Pell for Annexation of Territory to the Village of Greenport. The following resolution was offered by Councilman Rich; seconded by Just&ce Demarest, WHEREAS, Arthur Wolpert, Wilhelm V. Krumholz, Joseph DeSchrage, A. Bernstein and Lillian S. Pell have heretofore presented a petition to this board requesting that the territory described in said petition be annexed to the Village of Greenport, and WHEREAS, a public hearing with respect to said petition was duly held jointly with the Board of Trustees of the Village of Greehport on the 13th day of April, 1972 to hear any testimony and receive evidence and information which may be presented concerning the said petition and the question of whether the proposed annexation is or is not in the 0ver-all public interest, NOW, THEREFORE, this board does hereby make the following findings ~ith respect to compliance of the said petition with the provisions of Article 17 of the General Municipal Law and with respect to the effect of such proposed annexation on the over-all public interest, to wit: I. i'That the said petition does not substantially comply in form with the provisions of Article 17 of the General Municipal Law for the following reasons, tm wit: (a) The petition and exhibits annexed to the petition state that the petitioners are the owners of all of the assessed valuation of the property in the territory sought to be annexed. Howe~e~r an examination of the assessment rolls of the Town of Southold for the 1971-72 tax year shows that the portion of the property sought to be annexed allegedly assessed to Arthur Wolpert and others is in fact assessed to Chapel Lane Associates and not to the individual petitioners signing said petition. (b) A portion of the real property sought to be annexed to the Village of Greenport is assessed on the aforesaid S0uthold Town tax rolls to Lillian S. Pell. The said Lillian S. Pell has presented a letter to this board dated July 10, 1972' Wherein she has indicated that she wishes to withdraw the property assessed t~ her from the petition for annexation. Of the total' assessed valuation of the territory sought to be annexed amounting to $17,900, the real property assessed to Lillian S. Pell with an a,ssess~ valuation of $9,800 comprises more than one-half of the assessed valuation ~f the entire territory sought to be annexed. Accordingly, the petition now does not comply with the requirements of Article 17 of the General Municipal Law since it does n~t ~Com~n ~ehnames of owners of a majority in assessed v~uation of the real property ~n such territory assessed on the last preceding assessment roll. (c) For the aforesaid reas~R$, this board determines 'that the aforesaid petition does not substantially comply with the provisions of Article 17 of the General Municipal Law. II. That the proposed annexation is not in the over-ali public interest (1) of the territory proposed to be annexed or (2) Of the Village Of Greenport to which the territory is proposed to be annexed, or (3) of the ~emaining area Of the Town of South~ld in which such territory is situated, or (4) of the~Uni0~ Free SchoOl District, both of which districts are situated partly in the territory proposed to be annexed for the following reasons, ~o ~it: (a) That as indicated on ~he~exhibits annexed to the aforesaid petition, the area of the territory Souqht to be annexed contains 29.993 acres of Vacant land. The territory in question is contiguous along a portion of its easterly boundary line with land within the incorporated limits of the Village of Greenport. The land within the incorporated Village of Greenport to which the territory is sought to be annexed is contiguous is owned by the- Village o4 Greenport, is uninhabited and is used by the Village of Greenport as a water-shed area a~d was annexed to the Village of Greenport several years ago. That said lands of the Village of Greenport were permitted to be annexed tO the Village of Greenport by action of this board in order-to eliminate the payment of taxes on said property by the Village of Greenport to ~he. Town of Southold since said lands at that time weme outside the incorporated limits of .the Village of Greenport and under applicable law were then subject to Southold Town taxes. (b) That with the exception of that portion of the territory sought to be annexed ajdacent to "oid highway" to a distance of 200 feet, all of the territory sought to be annexed is within the "~" Residential and Agricultural District under the Town of Southold Building Zone Ordinance which provides for a minimum size lot of 40,000 square feet if public sewer and public water are not provided and 20,000 square feet if public sewer and public water is provided. Public water is available to the territory in question but public sewers are not. Under the provisions of the Village of Greenport Zoning Ordinance, all territory annexed to the Village of Greenport shall be placed in the "R-l" One-family Residence District which requires a minimum size lot of 10,000 square feet without regard to whether public sewer or water is provided. Therefore, if the territory in. question were annexed to the Village Of Greenport, the Village of Greenport Zoning Ordinance would permit the territory to .be developed with. four times~the number of dwellings as is permitted by the Southold .Town Zoning Ordinance. It was testified to at the hearing in this matter that the Town of Southold including the_Village of Greenport has a limited supply of fresh water. The Master Plan of_the Town_of Southold including the water resources_study forming a part thereof ~has recommended the conserva- tion of the limited fresh water resources~.of_the~town by.limiting the density of the development of~the town.~ This board believes that to permit the territory in question to be developed as provided by the Village of Greenport Zoning Ordinance would severely endanger the fresh water resources cf the_Town~of~ Southold. (c) The~pe~itione~s herein have indicated that the principal reason for seeking annexation.~s to avail themselves of the public ~e~er~system. owned~and operated by the Village of Greenport. .The Superintendent~ of Utilities of the Village of Greenport has stated that said sewer system has a maximum capacity of 500,000 gallons per_day. The system ~s a pmimary treatment sys%em and ~s presentl~ in violation~of applicable r~les and regula- tions of ~he state and federa~ government. Said sewer plant_is. presently.operating at 85% of its capacity. The affluent, from said system is..discharged~.into the waters of~Aong Island Sound~ adjacent to the Town of Southold. This board belie~es~ tha~ to permit the. annexation sought herein would~ possibly cause an additional volume, of improperly treated~ sewage to be discharged into the-waters~of Long Island Sound.and thereby cause a potential pollu%iop problem. (d)~The~assessed~aluation of the~territory sough~.to be annexed amounts ~o $17,9~0. If the territory were annexed to the-~Village of Greenport it.wou~d result in an increase in the Village of-Greenport~ tax base of approximately~one~half of~on~ percent,. This~board believes~that the~detriment~ ~o.~the Town of Southold by. reason_of_~he~annexatien of the territory set forth in the aforesaid petition would far outweigh any benefit~to .be~ derived by the Village of Greenport by reason of any increase in its tax base. For the reasons hereinbefore set forth, this board does hereby DETERMINE that-it is not in the over-all public interest to approve such proposed annexation of the territory set 'forth in the petition, of Arthur' Wolpert, Wilhelm V. Krumholz, Joseph DeSchrage, A. Bernstein-and Lillian S. Pell. The foregoing reso'lution was duly put to a vote w~ich resulted as follows: Supervisor Martocchia voting yes, Councilman Rich voting yes, Councilman Homan voting yes, Justice Demarest voting yes, JusticeSuter voting-yes. - - The'res&lution was declared unanimously'adopted. ORDER - In the Matter of the Petition of Arthur Wolpert, Wilhelm V. Krumholz,' Joseph DeSchrage, A. Bernstein and Lil~ian S. Pell for Annexation of Territory to the Village of Greenportl There having been presented to this town board a petition of Arthur Wolpert, Wilhelm V. Krumholz, Joseph DeSchrage~ A. Bernstein and Lillian S. Pell requesting that the' territory described in said petition be annexed to the Village of Greenport; and a public hearing with respect to said~petition having been duly-~held jointly with the Board of Trustees of the Village-of Greenport on the 13th day of April, 1972, to hear any testimony and receive evidence and information which-may be presented~ concerning the said petition and the question of whether the proposed annexation~ is dr is not in the over-all public interest~ and this town board having, by a-resolution duly adopted~ on-the-~ llth day of July, 1972 dulydetermined that said petition does not comply with the provisions of ArtiCle 17 of the General Municipal Law and was not in the-over-all public interest to consent to the annexation of the territory described in said petition; Now, on motion of JuStice Suter, seconded by Councilman Homan, it is ORDERED that this town board does hereby disapprove such proposed annexation and does not consent to-the same; and it is fUrther ORDERED, that the town clerk shall cause a certified copy of this order, together with copies of the petition, the notice, the written objections, if any, and testimony and minutes of proceed- ings'taken and kept on the hearing, in the office of the cler~ of the Village of GreenpOrt; and it is further ~F~DERED, that the town clerk ghall cause a certified copy of this order to be filed in the office of the County Clerk of the County ~f Suffolk. /s/ Albert M.~ Ma~occhia, Supervisor, JamesF. Moved by Justice Suter, seconded by Councilman Rich, it was RES.O, LVED, that N~co Sutmoller, Southold, New York, be h~red as a part-time Bay Constable to patrol town waters, under contract for $50Q. 00 per season, and to serve at the pleasure of the Town 'Board. Moved by Councilman Homan, seconded by Councilman Rich, CONSENT OF TOWN BOARD TO PROPOSE TOWN HIGHWAY In the Matter of the Laying out of ceraain town highways in the Tow~ of Southold, County of Suffolk and State of New York, known as LONGVIEW LANE, RAMBLER ROAD, PLEASANT PLACE AND WATERSEDGE WAY. UPON READING AND FILING the application of Helen G. Cochran dated and acknowledged April 20, 1972, and the dedication and ~elease of Helen G. Cochran dedicating and releasing the necessary lands for proposed town highways to extend from Main Bay View Road through the lands of the said Helen G. Cochran, RESOLVED, that, in accordance with the provisions of Section 171 of the Highway Law of the State of New York, consent be and the same hereby is given that the Town Superintendent of Highways of the Town of Southold make an order laying out the aforesaid town highways, the said town h~hways to consist of the lands described in the said dedication and release and to extend as delineated upon the map thereto annexed, and it is further RESOLVED, that the Town Clerk be and he hereby is directed to forthwith cause such release to be recorded in the ~ffice of the Clerk of the County of Suffolk and, upon its return, to attach it hereto. Moved by Justice Suter, seconded by Councilman Homan, it was RESOLVED that Chester Melot, Mattituck, New York, be and he hereby is appointed Attendance Officer, subject to the written approval of the District Superintendent of School~, throughout the Town of Southold, except such schools as are otherwise provided for by Section 3113 of the Education Law, and be it further RESOLVED, that such Attendance Officer shall be removable at the pleasure of the District Superintendent of Schools, and be it further RESOLVED, that the ~ompensation of s~ch Attendance Officer be fixed at $1,200.00 per year payable in regular monthly installments, he to pay his own expenses, and be it further RESOLVED, that the Town Clerk be and he hereby is instructed to notify Chester~Melot~and~the District~,Su~erin~tendent of Schools of the appointment.
