Surer, WHEREAS, Wunneweta Pond_ Association, Nassau Point, New~ York, applied to the Town Bfoard for financial assistance in dredging the entrance of Wunneweta Pond, NOW, THEREFORE, BE IT RESOLVED, that Supervisor Martocchia be and he hereby is authDmized to contribute half of the total cost up to but not to exceed the sum of $475_.00 toward ~he cost of dredg- ing the entrance of Wunneweta Pond, Nassau Point, Cutchogue, New. Moved by Justice Suter, seconded by Justice Demarest, it was RESOLVED, that this Town Board approves the recommendation of Joseph Lite, attorney for the Town of Southold, in the settlement of assessment for the property of Fir. John Evans, Fishers Island, New York. Vote of the T~wn Board: Ayes: Supervisor Martocchia, Councilman Rich, Councilman Homan, Justice Suter, Justice Demarest. Moved by Justice Demarest,-seconded by Councilman Rich, it was RESOLVED, that the Southold Town Board approves the action of the Fishers Island Ferry District, Fishers Island, N~w York in the lease of building ~888 to William J. Faulkner, Fishers Island, New York, for a term of three (3) years at a rental of $900.00 per year. Vote of the Town Board: Ayes: Supervisor Martocchia, Councilman Rich, Councilman Homart, Justice Suter, Justice Demarest. Moved by Justice Suter, seconded by Justice Demarest, it was RESOLVED, that Theodore J. Heuser be and he hereby is appointed a~member of the Board of Assessment Review, to ~ill the vacancy left by John Paris who resigned. Moved by Justice Suter, seconded by Councilman Homan, it was RESOLVED, that John Talbot be and he hereby is appointed to the Boar~ of Housing Appeals to fill the vacancy left by Stanley Sledjeski who resigned. Moved by ~ouncilman Rich, seconded by Justice Demarest, In the Matter of the Petition of the Owners of more than one-half of the Real Property fronting on LONGVIEW LANE, -RAMBLER ROAD, PLEASANT.PLACE and WATERSEDGE WAY for the improvement, of said streets. -- RESOLUTION FOR STREET IMPROVEMENT. WHEREAS, a'written petition dated September.~ll, 1971~ was duly .filed with this board requesting the permanent improvement of highways in this Town known as: All those certain lands at Bayview in the Town of Southold known add designated as Longview Lane, Rambler Road, Pleasant Place and Watersedge Way on a certain 'map entitled "Map of Terry Waters at Bayview, Town of Sour. hold, Suffolk County, New York" filed in the Suffolk County Clerk's 0ffiee on December.29, 1958, as Map No. 2901. WHEREAS, said petition was:duly signed by owners .of'real estate owning real estate to the extent of at least one-half of-~the entire- frontage or Bounds on both-sides of such~highways and also s~i~gned by resident owners-owning no% less than one-half of the frOnta'ge owned by resident owners re~iding,.~n or along such highways, and : . Recitals WHEREAS, foll0w~ng receipt of a petition in due form,~ :a pub~lic hearing duly called-and held for: th~ improvement of the existing highways known as Longview Lane, Rambler Road, Pleasant~ P~lace and Watersedge Way (herein called "Improvement" and ~"Streets" respectively) in the Town of Southol~-(.herei-n. ca~!led "T~") in the County of Suff$1k,lNew York, by ~he~permanent~ pavement of the same and the construction of such curbs, gutters, catch, basins and drainage facilities as may be neeessary, at an estimated maximum cost of $10,500.00, the Town Board of the Town determined pursuant to~resolution duly~ adopted on J~une 6, 1972, that the notice of such hearing was published and posted as required by law and is otherwise suff~icient and~that it is in the public interest to make the Improvement pursuant to the definite plans, specifications and estimate of cost to be prepared by the Town Engineer; now therefore, be it RESOLVED BY THE TOWN BOARD OF THE TOWN OF SOUTHOLD IN THE COUNTY OF SUFFOLK, NEW YORK (by the~favorable vote of not .less than two- thirds of all the members.of said Board), AS. FOLLOWS: Section 1. The Town hereby appropriates the-amount of $10,500.00 for ~the. permanent pavement of Lon~view Lane, Rambler Road, Pleasant Place and Watersedge Way and the construction of ~uch curbs, g~tte.r~, catch basins, and drainage facilities as may be necessary on and along the... The estimated maximum cost of said specific object or purpose, including preliminaryacQsts-and costs i~ncidental hereto and the financing thereof, is $10,500.00 and the plan of financing includes ~the issuance of serial bonds of the Town in the principal amount of $10,500.00 and the assessment, levy and collection of assess- ments from the several lots and parcels of land which the Town Board shall~ deem eppecialty benefi~ed~hereby to pay the prin~cipa.! of said bonds and the interest thereon so much upon and from each as shall be in just proporation to ~he amount of bene~fit which the Improvement shall confer upon the-same. Section 2. To finance such appropriation, serial bonds the Town are hereby authorized to be issued in the prmnc~pal amount of $10,500.00 pursuant to the provisions of the Local Finance Law, constituting Chapter 33-a of the Consolidated Laws of the State of New York, (herein called "Law"). Section 3. The period of probable usefulness of the specific object or purpose for which the bonds authorized pursuant to this resolution are to be issued, within the limitations of Section ll.00a 20. of the Law, is five (5) years. (A) Current funds are not required to be provided prior to the issuance of the bonds authorized pursuant to this resolution, or any bond anticipation notes issUed in anticipation thereof, pursuant ~o the provisions of Section 107.00 of the Law (B) The proposed maturity of the bonds authorized~ pursuant to this resolUtion will not exceed fiue ~5) years. Section 4- Each of the bonds authorized pursuant to this resolution, and any notes, issued in anticipation thereof, shall contain the recital of valifity prescribed by ~52.00 of the Law and said bonds and any notes issued in anticipation of said bonds shall be general obligations of the Town,.payable as to bo~h. principal and interest by general tax upon all the taxable real property within the Town without limitation of rate or amount. The faith and credit of the Town are hereby irrevocably pledged to the punctual payment of the principal of and interest on shid bonds and provision shall be made annually in the budget of the Town by appropriation for (a) the amortization and redemption of the bonds to mature in such year and. (b) the payment, of interest to be due and' payable in such year. Section 5. Pursuant to the provisions of .this resolution and pursuant to the provisions of ~30.00 relative to the authorization of the issuance of bond anticipation notes and of ~50 and $$56.00 to 60.00 of the Law, the powers and. duties of the Town Board relative to prescribing the terms, form and contents and as to the sale and issuance of said bonds and any notes issued in anticipation of said bonds, or the renewals ~hereof, are hereby delegated to the Supervisor, the chief fiscal officersof the Town. Section 6. The validity of the bonds authorized pursuant to this resolution may be contested only if: (a) Such obligations are authorized for an object or purpose for which the Town is hot authorized to expend moeny, or (b) The provisions of law which should be complied with at the date of publication of such resolution, are not substantially complied with, and an action, suit or proceeding contesting such va~id~ty, is. commenced~within twenty days after the date of such publication, or (c) Such obligations are authorized in violation of the provzsions of.the constitution. The re~olution was declared unanimously adopted. Justice~Demarest offered the fol~0win~.~esolution and moved for its adoption: ~ ~ESOLVED BY THE TOWN BOARD OF THE TOWN OF SOUTHOLD IN THE COUNTY OF. SUFFOLK, NEW YORK, AS FOLLOWS: .. Section 1. The Town Clerk of the Town of Southold, in the County of Suffolk, New York, ~s hereby directed to publish ~he foregoing bond resolution zn full,, in the "LONG ISLAND TRAVELER- MATTITUCK WATCHMAN" a newspaper, published in the Town of Southol~d, New York, and having a general circulation zn~the Town, which newspaper, is hereby designated as the official newspaper of the Town for such publication, together with the Town Clerk's statutory Notice in substantially the form as prescribed in Section 81'.00 of the Local Finance Law of the State of New York. Section 2. This resolution shall take effect immediately. Moved by Justice Suter, seconded by Councilman Rich, WHEREAS, the Senior citizens, Mattituck, New York, request the use of two [2) buses for transportation to Sterling Forest, New York on September 28, I972, NOW, THEREFORE, BE IT RESOLVED, th'at the TOwn of Southold furnish said transportation for the Senior Citizens at a cost not to exceed Vote of the Town Board: Ayes: Supervisor Ma~tocchia, Councilman Rich, Councilman Homan, Justice Suter.~ Justice Demarest._ . York, be and hereby is appointed Chairman of the-Southold Town Conservation Advisory Council, term to e~pire December~ 31, 1972. On motion of Justice Suter, seconded-by Justice Demarest, it was RESOLVED, that Supervisor Martocchia ~s hereby authorized to purchase, under the County contract, two cars:- ~ 6 cyl. 4 door sedan at $2,226.25, and a station wagon at $2,896.66 for the Building Department and Assessor's 0ffiee. On motion of Justice Demarest, seconded by Justice Suter, it was RESOLVED, that Supervisor Martocchia is hereby authorized to sell two Town vehicles, one police car and one building department car. Moved by Councilman Homan, seconded by Councilman Rich, WHEREAS, the Nassau Point Lagoon Association, Cutchogue, New York, applied to the Town Board for financial assistance in dredging the entrance of The Lagoon, NOW, THEREFORE, BE IT RESOLVED, that Supervisor Martocchia be and he hereby is authorized to contribute h~f of the total cost up to but not to exceed the sum of $475.00 toward the cost of dredging the entrance of The Lagoon, Nassau Point, Cutchogue, New York.
