SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type I1' category of the State's List of Actions, without an adverse effect on the environment if the project is implemented as planned. PROPERTY FACTS/DESCRIPTION: The applicant's 6.967 acre vacant parcel has 158.25 feet along the east side of Kenney's Road, lot depth of 733.44 feet along the south/easterly property lines, and 886.35 feet along the rear property line. The property is referred to as Lot 3 on the Map of Argirios Papadopoulos and George Maragos filed September 13, 1988 in the Suffolk County Clerk's Office. BASIS OF APPLICATION: Building Department's January 23, 2004 amended Notice of Disapproval, citing Code Section 100-31C in its denial of a building permit application concerning a proposed horse barn and corral on a lot which contains less than ten (10) acres of land, the minimum size required for keeping, breeding, raising, and training of horses. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on March 18, 2004, at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant: AREA VARIANCE RELIEF REQUESTED: Applicant wishes to keep the family horses for personal use in a proposed horse barn and corral, without breeding, raising or training of horses. The relief requested is an area variance to allow keeping of the family horses on a 6.967-acre parcel, which is less than the code requirement of ten (10) acres and to build a 40' by 60' horse barn and fenced corral area. The original application requested a horse barn location at 50 feet from the westerly lot line of adjacent Subdivision Lot 2. /~J~D RF! !F:E: After testimony and'questions were answered at the March 18, 2004 public hearing, the applicant amended the plan, proposing the location of the horse barn at 100 feet from the westerly lot line of adjacent Subdivision Lot 2, approximately 85 feet from applicant's easterly lot ,Page 2 -April 8, 2004 ' Z0A Ref. #5493 - George g Penny IV CTM 59-3-'17.3 line, and at least 250 feet from applicant's northerly lot line adjacent to land of the Suffolk County Water Authority. The proposed open corral was also shown at 20 feet from the rear lot line and approximately 70 feet from the northerly lot line as shown on the survey amended 3-18-03 prepared by John C. Ehlers, L.S. REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and personal inspections, the Board makes the following findings: 1. An undesirable change will not be produced in the character of the neighborhood or a detriment to the nearby properties, the applicant's stated intent to build a barn to keep horses for personal use only, which is allowed in this residential AC zone. 2. The benefit sought by the applicant cannot be achieved by some other method feasible for the applicant to pursue, other than an area variance, because there is no abutting land for sale to purchase the additional acreage to fulfill the 10-acre minimum requirement of the Code. 3. The amount of relief requested is substantial because it represents 30% decrease in the minimum requirement to keep, breed, raise, and train horses, however, this part of our code seems the refer to a commercial or farming type of activity conducted on the property and this applicant/owner will limit the number of horses to those of personal use which is allowed in most residential zones in the town on lots with much smaller acreage. 4. There was no evidence that the grant of the variance will have an adverse effect or impact on the physical or environmental conditions in the neighborhood or district. Similar lots adjacent to the applicant's property are allowed to have horses for personal use. 5. Grant of this relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a barn and corral for the owner's horses, while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Dinizio, seconded by Member Goehringer, and duly carried, to GRANT the variance as applied for, as shown on the map prepared by John C.
